EXECUTIVE SUMMARY
Recommendation to approve and ratify staff's Zero - Dollar Time Extension of
Contract #09 -5195 with Boran Craig Barber Engel Construction Co. (BCBE) in
order to process the Contractor's Final Invoice for work completed on the Marco
Island Library Rose Hall Addition; and authorize the County Manager or his
designee to sign the necessary documents.
OBJECTIVE: To obtain Board approval for a Zero - Dollar Time Extension to expired Contract
#09 -5195 - Marco Island Library Rose Hall Addition, in order to process the final Invoice for a
late evolving, owner requested, change order issued 9/29/2010, but only completed on
4/6/2011, in the previously committed amount of $2,254.84. Also, to authorize the County
Manager or his designee to sign the necessary documents.
CONSIDERATIONS: Contract #09 -5195 with Boran Craig Barber Engel Construction Co.
(BCBE) is for the construction of the Rose Hall Addition to the Marco Island Library. The
Contractor achieved substantial completion of the Rose Hall Addition (as scheduled) on
6/21/2010. On 9/24/2010, after the Hall had been in use for about three (3) months, the Library
staff requested that the project change a floor- mounted audio /video /power box, located on the
stage of the auditorium, from the type and model originally specified, supplied and installed; to a
different model that presented less of a tripping point, and was reportedly easier to use.
Change Order #5 in the amount of $2,254.84 was issued to the Contractor on 9/29/2010, but
the Contract completion date of 11/10/2010 was not extended since it was believed that the item
could be completed before that date.
Unfortunately, there was a delay in the material delivery and in addition due to the heavy
schedule of events for the auditorium, the Library staff requested that the installation be
postponed until after high, seasonal utilization of the facility subsided. In late March the Library
staff requested that the Contractor complete the installation, and BCBE completed the work on
April 6, 2011. The Contractor's final invoice was submitted on 4/7/2011, but was rejected by the
Finance Department due to the contract having expired.
In order to process the Contractor's final invoice for this project covering the last Change Order
for the work performed, it is necessary to process a Zero Dollar Time Extension to the Contract.
This change order essentially ratifies an arrangement under which the vendor has actually
performed under the Contract, following the expiration of the Contract on 11/11/2010. The
services were performed at County Staff's request, and in accordance with the project
requirements. The Contractor has successfully completed the work authorized by Change
Order #5 issued before the Contract expired, and staff recommends approval.
FISCAL IMPACT: There is no fiscal impact associated with this item. All work and costs were
covered by previously authorized Change Orders.
GROWTH MANAGEMENT IMPACT:

There is no growth management impact associated with
LEGAL CONSIDERATIONS: It is within the Board's authority to ratify staff's extension of an
expired contract to include vendor services provided from which the County has received

benefit. This item has been reviewed by the County Attorney's Office, requires a majority vote,
and is legally sufficient for Board action. - CMG

contract #09 -5195 and authorizes the County Manager or his designee to execute the related
documents.
