EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners set a public hearing date of September
13, 2011 for consideration of a Development of Regional Impact Development Order for the
Hacienda Lakes project, Petition Number DRI- 2006 -AR- 10147, located on the east side of Collier
Boulevard (C.R. 951) at the intersection of Collier Boulevard and Rattlesnake- Hammock Road and
north and south of Sabal Palm Road in Sections 11 through 14, 23 through 25, Township 50 South,
Range 26 East, and Sections 19 & 30, Township 50 South, Range 27 East, Collier County, Florida.
OBJECTIVE:
To set a public hearing date for the Board of County Commissioners (BCC) to consider petition number
DRI- 2006 -AR- 10147, being an application for a Development of Regional Impact (DRI) amendment for
a project known as Hacienda Lakes.
CONSIDERATIONS:
Collier County has received notification by the Southwest Florida Regional Planning Council (SWFRPC)
staff (see attached 4/20/11 letter) that the Hacienda Lakes Application for Development Approval
contains sufficient information for review and evaluation and, as such, requests Collier County to
schedule a public hearing as required by Chapter 380.06 (11), Florida Statutes. Compliance with said
Florida Statute, requires that the appropriate local government shall give notice and hold a public hearing
on the application in the same manner as for a rezoning as provided under the appropriate special or local
law or ordinance. The notice shall be published at least 60 days in advance of the hearing and shall
specify where the information and reports on the development of regional impact application may be
reviewed. Staff suggests the date for this public hearing be set for September 13, 2011.
FISCAL IMPACT:
There is no fiscal impact generated by this Executive Summary.
LEGAL CONSIDERATIONS:
The setting of the public hearing is required by Section 380.06(11)(d), FS. This item is ready for Board
consideration and approval. A majority vote is required for approval —HFAC

That the Board set a public hearing date for September 13, 2011, for consideration of a proposed
Development of Regional Impact (DRI) Development Order for Collier County petition number DRI-
2006 -AR -10147 (State of Florida DRI # 07- 0506 -175), Hacienda Lakes.

Dear Chairman Coyle:
The applicant for the Hacienda Lakes DRI has chosen the option not to answer additional
sufficiency questions in another sufficiency round as allowed under Chapter 380.06(10)(b). The
applicant has however committed to answering the remaining sufficiency questions as soon as
possible for our use in the staff assessment report. The purpose of this letter is to request Collier
County schedule a DRI public hearing for the "Hacienda Lakes" DRI.
Compliance with Chapter 380.06(l), Florida Statutes, requires that the appropriate local
government shall give notice and hold a public hearing on the application in the same manner as
for a rezoning as provided under the appropriate special or local law or ordinance, except that
such hearing proceedings shall be recorded by tape or a certified court reporter and made
available for transcription at the expense of any interested party. The Statute also requires:
(a) The notice of public hearing shall state that the proposed development is
undergoing a development of regional impact review.

(b) The notice shall be published at least 60 days in advance of the hearing and shall
specify where the inforniation and reports on the development of regional impact
application may be reviewed.
(c) The notice shall be given to the state land planning agency, to the applicable
regional planning agency, to any state or regional permitting agency participating

a conceptual agency review process under subsection (9), and to such other
persons as may have been designated by the state land planning agency as -entitled
to receive such notices.
