EXECUTIVE SUMMARY
Recommendation to adopt a resolution and to quitclaim to the Florida Department of Transportation
compensating turn lane right-of-way on Davis Boulevard (SR-84) east of the entrance to Madison Park. (Fiscal
Impact: None)
OBJECTIVE: To quitclaim to the Florida Department of Transportation (FOOT) compensating turn lane right-of-
way secured rrom Centex Homes, pursuant to one of the developer commitments contained within the Twelve Lakes
PUD ordinance (Collier County Ordinance No. 2003~20, Section 6.5 K which states "When . . . turn lane
improvement(s), whether left tum lane(s) andlor right tum lane(s), are determined to be necessary. . . compensating
right-of-way will be provided in conjunction with said improvement(s).. ,").
CONSIDERATIONS: The FOOT has begun to acquire the right.of.way necessary to improve that segment of Davis
Boulevard between Radio Road and Santa Barbara Boulevard. The compensating right~of-way previously secured by
Collier County (a Twelve Lakes PUD development commitment) is a part of the right~of-way that will be required for
the 6-laning of this segment of Davis Boulevard. The Office of the General Counsel of the FOOT has asked for
evidence of the Commission's approval ofthis conveyance by adoption of the attached resolution.
FISCAL IMPACT: There is no fiscal impact associated with this recommendation.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
recommendation.

LEGAL CONSIDERATIONS: This item 1S legally sufficient for Board action, and requires majority vote for
approval. ~JW
RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida:
1. Approve the conveyance of the compensating turn lane right~of~way to the Florida Department of
Transportation via Quitclaim Deed;
2. Authorize its Chairman to execute same 011 behalf of the Board;
3. Approve and adopt the attached resolution:
4. Authorize its Chairman to execute same on behalf of the Board; and
5. Authorize the County Manager or his designee to deliver same unto the Florida Department of
Transportation.

RESOLUTION NO. 2011-_
A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AUTHORIZING THE CONVEYANCE OF ALL RIGHT, TITLE,
AND INTERESTS IN CERTAIN LANDS WITHIN THE TURN
LANE RIGHT-OF-WAY ON DAVIS BOULEVARD (SR-84),
NORTH AND EAST OF MADISON PARK BOULEVARD, TO THE
FLORIDA DEPARTMENT OF TRANSPORTATION.
WHEREAS, the State of Florida Department of Transportation proposes to construct or
improve State Road 84, Section No. 03001-000, in Collier County, Florida; and
WHEREAS, it is necessary that certain lands now owned by Collier County, and
described in the attached Exhibit A, be acquired by the State of Florida Department of
Transportation; and
WHEREAS, said property is not needed for County purposes; and
WHEREAS, the State of Florida Department of Transportation has made application to
said County to execute and deliver to the State of Florida Department of Transportation a deed,
or deeds, in favor of the State of Florida Department of Transportation, conveying all rights, title
and interest that said County has in and to said lands required for transportation purposes, and
said request having been duly considered.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: I) The application of the State
of Florida Department of Transportation for a deed, or deeds, to certain lands now owned by
Collier County, and described in the attached Exhibit A is hereby granted; 2) Said lands are
required for transportation purposes which are in the public or community interest and for public
welfare and the land needed for transportation purposes is not needed for County purposes; and
3) A deed, or deeds, in favor of the State of Florida Department of Transportation conveying all

right, title and interest of Collier County in and to said lands should be drawn and executed by
this Board of County Commissioners. Consideration shall be $10.00.
BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be
forwarded forthwith to the State of Florida Department of Transportation at Bartow, Florida.
THIS RESOLUTION ADOPTED after motion, second and majority vote on this the 10th
day of May, 2011.
