EXECUTIVE SUMMARY
Recommendation to approve criteria for establishing new district boundaries for the Board of
County Commissioners.
OBJECTIVE: To obtain approval from the Board .of County Commissioners (BCC) to use the
criteria outlined below for the purpose of establishing new BCC district boundaries.
CONSIDERATIONS: The Constitution of the State of Florida [Article VIII, Section1.(e)] requires
that, after each decennial census, the Board of Commissioners is to divide the County into districts
of contiguous territories as nearly ~qual in population as practicable, with one Commissioner
residing in each district elected as provided by law. Chapter 124, Florida Statutes, also provides for
more frequent redistricting to maintain population balance, but provides that redistricting shall only
occur in odd-numbered years.
In March 2011, the U.S. Census Bureau released various Census 2010 Redistricting Data for Florida
and its counties, pursuant to Public Law 94-171. This data shows the total population for Collier
County to be 321,520 as of April 1,2010, and includes details of population by race and ethnicity
(see Table 1, attached). To achieve population equity, each district would have a population of
approximately 64,304 persons.
All Commission districts have experienced population growth since the last redistricting occurred in
2001 when the countywide population as of April 1, 2000 was 251,377; however, the amount of
growth varies significantly among districts. Most notably, District IV, which includes the City of
Naples and its environs to the east, has experienced the least population increase, followed by
Districts I and II; Districts III and V have experienced the most. The net result is the need to reduce
the boundaries of Districts III and V and to increase the boundaries of Districts I, IT, and IV. (see
Table 2, helow)

On March 15, 2011, the District School Board of Collier County unanimously agreed to
coterminous district boundaries with the BCC and to provide staff support, including language

interpreters to assist at redistricting public meetings - as was the case in 2001 redistricting. Also, as
in the past, Supervisor of Elections Jennifer Edwards has made available her staff to provide
technical support as may be needed; the data calculations in Table 2 above were prepared by her
staff. Additionally, Growth Management Division staff - the lead in the redistricting task - will be
assisted by the Office of the County Attorney.
State law limits redistricting to odd-numbered years only, so this task must be completed in 2011.
Collier County is a "covered jurisdiction" under the Voting Rights Act so must provide the adopted
redistricting map (and associated district descriptions, data and analysis) to the U.S. Justice
Department for preclearance prior to enforcement of the new map. Because 2012 is an election
year, time is of the essence. The Supervisor of Elections has requested the new district map be
adopted no later than September 2011, and staff has created a sc;hedule to accommodate that
request.
Staff will prepare multiple maps (five, as in 2001) for consideration so as to provide options; each
map will necessitate some written analysis, a general description of boundaries for each of the 5
districts, an adoption resolution, etc. The schedule includes multiple public meetings to be held at
various locations throughout the County - all of which will be duly noticed in three languages, and
staff will make a presentation to both the Black Affairs and Hispanic Affairs Advisory Boards,
assuming their meeting schedules will allow it.
Independent Review
Unlike the 2001 redistricting effort, staff is taking an additional step to ensure compliance with the
constitutional and statutory requirements of redistricting via the retention of a private sector firm for
the purpose of providing an independent review of the County's redistricting process. Specifically,
the finn will:
1. Use GIS mapping teclmiques to ensure the data accuracy of map options developed by the
Comprehensive Planning Section;
2. Observe one community feedback session (public meeting);
3. Review and provide feedback to the County on the process used to garner feedback from the
community;
4. Review the five map options for compliance with redistricting criteria, prior to the
presentation to the Board of County Commissioners; and
5. Prepare a brief overview of the accuracy and completeness of the process used, for
presentation to the Board of County Commissioners when map options are presented.
The Comprehensive Planning Section has coordinated with the Purchasing Department to retain a
qualified firm to provide the above services. The Purchasing Department solicited 553 vendors of
the Request for Information (RFI); of those, 35 downloaded the RFI and two submitted bids -
Davidson Engineering, Inc., and Bond, Shoeneck & King, PLLC. Bond, Shoeneck & King, PLLC
submitted the lowest bid and established past experience with redistricting work. Accordingly, the
County has selected that fmn and is in the process of contracting with that firm for an amount not to
exceed $20,000. Funds have been budgeted by Growth Management Division for the redistricting
effort. This money has been allocated to fund advertising costs for all of the public meetings, the

required Spanish and Creole translation services for all ads and certain documents, as well as
meeting presentation materials and facilities. In addition, these funds will also satisfy the cost of the
contracted independent review.
So as to comply with the Florida Constitution, and for the convenience of the electorate, staff
proposes the following three criteria be used for the purpose of redistricting; these are the same
criteria approved by the BCC in 2001, except for coterminous boundaries which were not addressed
in the 2001 Executive Summary and the item was approved on consent agenda without discussion
(staff did draw all five maps to account for the residence of both the BCC and School Board
members):
1. The population of each district should be as similar as possible.
2. All districts should be as compact and regularly shaped as feasible.
3. The incumbent Commissioner's residence (and same for School Board members) must
remain in his or her current district.
Additionally, staff will consider racial and ethnic populations in an effort not to dilute their
concentration.
FISCAL IMPACT: The fiscal impacts to the County are for use of existing County staff and
resources; translation services; advertisements associated with public meetings; and, contractual
services for independent review and evaluation of the redistricting process - all of which costs are
included in the current fiscal year budget.
. GROWTH MANAGEMENT IMPACT: This item has no Growth Management impact.
LEGAL CONSIDERATIONS: The Florida Constitution, Article VIII, requires Commission
Districts to be adjusted following each decennial census so as to achieve population balance, if
Census data reveals a population imbalance exists. Based upon Census 2010 population data
released pursuant to Public Law 94-171, Commission District populations are disproportionate. The
proposed redistricting criteria are consistent with the Florida Constitution. This item has been
reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and
only requires a majority vote for Board approval-SRT.
RECOMMENDATION: That the BCC approve the above three criteria for redistricting.
