EXECUTIVE SUMMARY
Recommendation to approve procurement of background checks and fingerprinting from
the Florida Department of Law Enforcement and the Federal Bureau of Investigation as
the sole source provider for an estimated annual amOunt of $100,000.
OBJECTIVE: To authorize staff to utilize the Florida Department of Law Enforcement (FDLE)
and the Federal Bureau of Investigation (FBI) as sole source for background checks.
CONSIDERATIONS: In response to Homeland Security, the State of Florida (Section
126.5801, Florida Statutes) authorizes the Board of County Commissioners to conduct
background checks on County employees.
On July 27, 2004, the Board of County Commissioners approved an Ordinance (#2004-52, as
amended) that mandates state and federal criminal history records checks for applicants and
current employees, contractors, vendors, repair persons, and delivery persons, deemed by the
Board to be critical to security or to public safety regarding any facility owned or operated by
Collier County. The County Manager's Administrative Policy (CMA 5390) provides the
implementation of this program.
Background checks (fingerprinting) are performed by the FDLE and the FBI. The cost of the
background checks is $43.25 per person and is paid for by contractors and in the case of
employees, either by the Human Resources Department or the individual departments. It is
projected that the cost of these background checks will exceed the $50,000 purchasing limit.
The change of management contractors for the CAT bus system incurred a significant increase
in the number of background checks to be performed along with the re-checking of current
employees and contractor after 5 years. As a result, staff anticipates usage of this contract to
exceed the $50,000 purchasing limit.
Only FDLE and the FBI can perform these types of background checks (the Collier County
Sheriff's Office uses those agencies for its background checks), making this a sole source
procurement. Staff is requesting that the Board wave the formal bid process and authorize staff
to procure these services from the organizations listed above. The prices for these services will
fluctuate from year to year.
FISCAL IMPACT: Fiscal Year 2011 expenditures are expected to be approximately $100,000,
which is reimbursed by contractors and user departments.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is legally sufficient for Board action and only requires a majority vote-SRI.

RECOMMENDATION: That the Board of County Commissioners authorizes staff to utilize the
FDLE and the FBI as sole source for fingerprint type background checks. Given the nature of
the Facilities Management's security operation. staff recommends that the Board standardizes
the use of these two agencies for these types of background checks.
