EXECUTIVE SUMMARY
Recommendation to reject proposals received under RFP No. 11-5648 for Disaster Recovery
Assistance Services to ensure compliance with the Robert T. Stafford Disaster Relief and
Emergency Assistance Act and Federal Highway Administration requirements for state and federal
contracts that qualifY for reimbursement, and authorize staff to re-solicit a modified RFP.
OBJECTIVE: To reject proposals received under RFP No. 11-5648 for Disaster Recovery Assistance
Services and authorize Staff to reissue a modified REP to ensure that the language in the RFP complies
with the language contained in the Robert T. Stafford Disaster Relief and Emergency Assistance Act and
the Federal Highway Administration (FHW A), thus maximizing the potential for reimbursement from
State and Federal agencies.
CONSIDERATIONS: The Disaster Recovery Assistance Serviccs contract is an agency-wide instrument
developed to provide disaster related scrvices on an as-needed basis in full compliance with regulatory
agency requirements. The original contract (No. 06-4056) was established to secure the services of
management/consulting finns to provide assistance with the paperwork necessary for reimbursement from
State and Federal agencies. The contracted firms provide disaster assistance with management of project
worksheets (PW), final closure and project management associated with the disaster recovery efforts to
facilitate full cost reimbursement for work conducted within the County. The contract for these services
was in its last renewal period; therefore, on February 3, 201 I, RFP No.1 1-5648 was solicited by the
Purchasing Department. Proposals were due on March 2. 20 II; ten pl'Oposals were received.
Subsequent to receiving the proposals, staff learned that disaster assistance cxpenses are prospectively
reimbursable by FEMA. Heretofore. it had been understood that these expenses were not eligible for
reimbursement. Therefore, in order to afford the County the best opportunity to submit and receive
FEMA reimbursement for these services in the future, staff will re-formulate the RFP to include language
consistent with the Robert T. Stafford Disaster Relief and Emergency Assistance Act, and the Code of
Federal Regulations Title 44, Section 13.36. and exclude language (e.g.; local vendor preference) that
would be contrary to said requiremcnts.
FISCAL IMPACT: There is no fiscal impact in the approval of this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact in approving this
Executive Summary.
LEGAL CONSIDERATION: This item is legally sufficient and requires a majority vote for approval.
