EXECUTIVE SUMMARY
Recommendation to approve conveyance of an Easement to Florida Power & Light
Company for providing electric services for the North Collier Recycling Drop-off Center
facility, at a cost not to exceed $27.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) to approve
conveyance of an easement for the provision of electric services for the North Collier Recycling
Drop-off Center (NCRDC).
CONSIDERATIONS: The Board, at their October 26,2010 meeting, approved Agenda Item 10E
authorizing the award of Bid No. 10-5594 for construction of the NCRDC. The construction of
the NCRDC has begun and Florida Power & Light Company (FP&L) has determined its route to
provide electric services to the facility. An Easement to FP&L for the installation of public utility
infrastructure, including, but not limited to. conduit, lines, poles, switch cabinet, splice boxes and
3phase pad mount transformer with conductor, is required.
The easement area measures a total of approximately 15,861 square feet, and is shown and
described on Exhibit "A" to the Easement. The County will not be compensated because the
Easement is a requirement for FP&L to provide utilities to the NCRDC.
A location map is attached for reference.
The Easement document has been reviewed and approved by FP&L, the Solid Waste
Management Department, and the County Attorney's Office.
FISCAL IMPACT: The total cost will not exceed $27 for recording the two page Easement.
Funds in the amount of $27 are available in the budget under Project 700131.
LEGAL CONSIDERATIONS: The attached document has been approved for form and legal
sufficiency. This item requires a majority vote for approval.-JBW
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan
RECOMMENDATION: That the Board:
1. Approves the attached Easement.
2. Authorizes the Chairman to execute the Easement.
3. Directs the County Manager or his designee to proceed to record the Easement in
the Public Records of Collier County. Florida

The undersigned, in consideration of the payment of $1 .00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to
Florida Power & Light Company, its licensees, agents, successors, and assigns, an easement
forever for the construction, operation and maintenance of overhead and underground electric
utility facilities (including wires, poles, guys, cables, conduits and appurtenant equipment) to be
installed from time to time; with the right to reconstruct, improve, add to, enlarge, change the
voltage, as well as, the size of and remove such facilities or any of them within an easement of
2,162 square feet more or less, described as follows:
An FP&L Company easement more particularly described on Exhibit "A" attached
hereto and made a part hereof. Said legal description and sketch prepared by
Johnson Engineering,
Together with the ,'ight to permit any other person, firm or corporation to attach wires to any
facilities hereunder and lay cable and conduit within the easement and to operate the same for
communications purposes: the right of ingress and egress to said premises at all times; the right
to clear the land and keep it cleared of all trees, undergrowth and other obstructions within the
easement area; to trim and cut and keep trimmed and cut all dead, weak, leaning or
dangerous trees or limbs outside of the easement area which might interfere with or fall upon
the lines or systems of communications or power transmission or distribution; and further grants, to
Ihe fullest extent the undersigned has the power to grant, if at all, the rights hereinabove
granted on the land heretofore described, over, along, under and across the roads, streets or
highways adjoining or through said property.

LYING IN
SECTION 27, TOWNSHIP 48 SOUTH, ]lA1~GE 25 EAST
COLLIER COUNTY, FLORIDA
A tract or parcel of land lying in Section 27, Township 48 South, Range 25 East, Collier
County, Florida, which tract or parcel is more particularly described as follows:
Commencing at the intersection of the south line of said Section 27 with the
easterly right-of-way line of Goodlette-Frank Road (130 feet wide) thence
North 05034'59" West on said easterly right-of-way line for] ,660.43 feet
to the Point of Beginning.
From said Point of Beginning thence continue North 05034'59" West on
said easterly right-of-way line for 1,312,90 feet; thence
North 87021 '30" East departing said right-of-way line for 74.63 feet;
thence South 02038'30" East for 20.00 feet; thence South 87021 '30" West
for 63,58 feet; thence South 05034'59" East for 1,282,36 feet; thence
North 84025'01" East for 64.16 feet; thence South 52053'13" East for
54,23 feet; thence South 86019'24" East for 27.00 feet; thence
South05032'57" East for 10.13 feet; thence North 86019'24" West for
31.63 feet; thence North 52053'13" West for 53,33 feet; thence
