EXECUTIVE SUMMARY
Recommendation to accept and approve the completed alternative road impact fee calculation
study, conducted in accordance with the provisions of Section 74-204 of the Collier County Code of
Laws and Ordinances, the re\'iew completed by Tindale-Olh'er and Associates, Inc., and the
resulting Road Impact Fee rate of $68,393 per 1,000 square feet for the Taco Ben restaurant being
constructed at 4201 Tamiami Trail East
OBJECTIVE: Recommendation that the Board of County Commissioners (Board) accepts and
approves the completed altemative road impact fee calculation study, conducted in accordance
with Section 74-204 of the Collier County Code of Laws and Ordinances (Code), the review
completed by Tindale-Oliver and Associates, Inc. (Tindale-Oliver) and the resulting Road
Impact Fee rate of $68,393.00 per 1.000 square feet for the Taco Bell restaurant being
constructed at 4201 Tamiami Trail East.
CONSIDERATIONS: On August 25, 2010, the petitioner's consultant, Mr. Jeffrey Nunner,
P.E., met with County staff to discuss methodology and finalize the study approach for the
altemative road impact fee study for the Taco Bell restaurant being constructed at 4201 Tamiami
Trail East. The petitioner also paid a $2.500 review fee as required by Section 74-204(a)(1) of
the Code. The consultant submitted an initial report to the County on October 28, 2010. Staff
and the County's impact fee consultant, Tindale-Oliver and Associates, Inc., provided feedback
to the consultant in order for the report to be finalized for consideration by the Board. The study
was revised to address the comments from Tindale-Oliver and was submitted to the County on
February 3, 2011. Staff and Tindale-Oliver have rcviewed the report as well as the consultant's
methodology and raw data and verified all of the calculations to ensurc that the data collection
and analysis meets or exceeds all requirements of the Code.
The alternative road impact fee calculation study was conductcd by collecting trip characteristic
data from three similar sites in Collier County. The sites uscd were approved as part of the study
approach and consist of the Taco Bell restaurants at 2224 Tamiami Trail East, 8835 Davis Blvd.
and 28320 Trails Edge. The final analysis indicates a trip generation rate of 408 vehicle trips per
1,000 square feet, per day, an average trip length of 2.19 miles, with 59.2% being new trips on
the road network. In comparison, thc rate assessed by thc County for a Fast Food Restaurant
with Drive Through, which is the rate that would otherwise be used to assess the Road Impact
Fees for a Taco Bell restaurant, is based on trip generation rate of 522.62 vehicle trips per 1,000
square feet per day, an average trip length of 2.05 miles, with 58% of those being new trips on
the road network. The consultant's trip generation rate resulted from machine counts taken at the
above three sites, and the average trip length and percentage of new trips are the results of
origin/destination (OiD) surveys of motorists at those locations.

The calculated alternative rate of $68.393.00 per 1,000 square feet represents a downward
adjustment of$l ],344.00 per 1.000 squarc fcet from the 2011 adopted rate of $79,737 per 1,000
square feet which equates to a 14% reduction. As discussed in the analysis provided by Mr.
Nunner and the Tindale-Oliver review, Taco Bell is not a typical fast food restaurant. in that it is
not open for breakfast and it is not open 24-hours. The data suggests that this type of restaurant
generates less travel than the average fast food restaurant with driye-through. Therefore.

approval of the alternative impact fee calculation is recommended by staff and the impact fee
consultant. Once approved, this alternative fee may be utilized for future Taco Bell restaurants
constructed in Collier County, provided the data is updated to reflect the most current costs and
other variables.
A copy of the final cover letter provided by Mr. Nunner, as well as the response letters from
Tindale-Oliver have been included as back-up to this item. The full altemative road impact fee
calculation study is on file in the 1m pact Fee Office of the Grov.1h Management Division at 2800
North Horseshoe Drive. Based on the timing of the submittal ofthe package, Mr. Nunner's letter
references the Phase 1 Road Impact Fee rate and corresponding calculated altemative rate.
However, on March], 2011, the Phase]] Road Impact Fees went into effect, providing for a
further reduction in the rate. Tindale-Oliver updated the proposed alternative calculation to
reflect the most recent adjustment, and those updated rates were utilized in the preparation of this
Executive Summary.
FISCAL IMPACT: If the Board accepts and approves the alternative road impact fee
calculation, the resulting rate is 14% ($11,344.00 per 1,000 square feet) lower than the current
rate for a Fast Food Restaurant with Drive Through. This adjustment accurately reflects the
proposed facility's proportional share of the cost of public transportation facilities needed to
accommodate the proposed development.
GROWTH MANAGEMENT IMPACT: Impact fees provide financial resources for the
construction andlor expansion of the County's capital infrastructure, as necessary to
accommodate growth. Development is rcquired to contribute its fair share of the cost of
providing public facilities necessitated by growth, however impact fees may not be collected in
excess of the amount reasonably anticipated to fund such improvements. The fee based on the
alternative road impact fee calculation for Taco Bell represents a current, localized and accurate
assessment of the facility's impact and associated cost of providing transp0l1ation-related capital
facilities attributable to the new development.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney and is
legally sufficient for Board action. This item requires majority vote for approval. -JAX
RECOMMENDA TION: Recommendation that the Board of County Commissioners accepts
and approves the completed alternative road impact fee calculation study, conducted in
accordance with Section 74-204 of the Collier County Code of Laws and Ordinances, the rcview
completed by Tindale-Oliver and Associates, Inc.. and the resulting Road Impact Fee rate of
$68.393.00 per 1.000 square feet for the Taco Bell restaurant being constructed at 4201 Tamiami
Trail East and authorize the trip characteristics to be utilized for the construction of future Taco
Bell restaurants, subject to the data being updated to reflect current costs and other variables.

We have completed a review of the Revised Independent Impact Fee Calculation Study for the proposed
Taco Bell site to be located at 420 I E. Tamiami Trail, at the intersection of E. Tamiami Trail and
Lakewood Boulevard. The study, dated February 2, 2011, is completed by Nunner Engineering Services
(the Consultant).
TOA reviewed the trip length and percent new trips data with regard to the issues mentioned in the letter
to Collier County dated December 8, 2010.
. The calculation of trip lengths of diverted trip ends has been clarified and no change was
necessary .
. The Consultant has reviewed and revised both trip type categorizations and trip lengths associated
with Sites 1 and 2. The trip lengths observed are now accurately reflected in the final variables.
. The Consultant does not weigh the trip characteristics by study site size as required by the
County's Administrative Manual. It is recommended that the variables obtained at each individual
site be accepted by the County and that the trip characteristics variables be weighted for the final
impact fee calculation.
Table] on the next page presents the results of the values for the three trip characteristics variables and
suggested change to be incorporated to obtain the weighted average values for each variable. Table 2
shows the adopted transportation impact fees in comparison to the fees calculated for Taco Bcll using the
Phase I and Phase II transportation impact fee variables.

The analysis suggests that fast food restaurants that do not offer breakfast (or another meal, such as lunch
or dinner) generate less travel than the average fast food restaurant with drive through. As such, it is
recommended that the County accept the trip characteristics variables and calculated impact fee.

TOA reviewed the trip generation rate, trip length, and percent new trips data. The calculations for trip
generation rate were found to be correct; however, three issues were identified with the final trip
characteristics variables:
. The Consultant does not weigh the trip characteristics by study site size (based on 1,000 square
feet) and instead uses a straight average.
. Based on the sample of origin-destination surveys, the Consultant does not appear to multiply the
diverted trip lengths by 2, as stated in the County's Administrative Procedures Manual as it
pertains to altemative transportation impact fees.
. The sample of origin-destination surveys validated the trip characteristics obtained from Site 3
(within 10%); however, the results obtained from TOA's sample are fundamentally different than
the variables computed by the Consultant for Sites] and 2. Specifically, in about one-third ofthe
sample surveys evaluated for Site 2, the Consultant's results incorrectly categorized trip types and
the subsequent trip lengths.
The table on the next page presents the results of the sample taken of origin-destination surveys for all
three study sites. The table shows the results calculated by the Consultant and the results of the TOA
review, as well as, the percent different between the two.

other Tindale - Oliver recommendation is not required because the calculation for
diverted trips was correct in the original report.

Tindale - Oliver has accepted the enclosed data as documented in emails attached the last
email dated February 2, 2011.
The resulting impact fee based on the revised study is $77,180 compared to the current
county rate of $91 ,307 for a typical fast food restaurant.

Please review this map as it is a common condition that brings up 2 issues:
l. Google maps takes first route away fTom Collier Blvd. My local
experience is that driver would use Collier Blvd. as 1 have shown.
2. When passing by Davis Blvd. (store close to comer) on Collier Blvd.
would this be a captured trip or diverted. Not far enough to register
distance?
#2 above is especially common condition.
As we discussed yesterday regarding Ihe other sites:
Site l. I will review and adjust based on your comments.
Site 3. This site is acceptable.
