EXECUTIVE SUMMARY
Recommendation to grant final Conditional approval of the roadway (private) and drainage
improvements for the final plat of Heritage Bay Phase Two-A pursuant to Section 10.02.05 C.S of
the Land Development Code with the roadway and drainage improvements being privately
maintained and authorizing the release of the maintenance security except to the extent necessary
to ensure completion of the final paving improvements.
OBJECTIVE:
To grant final Conditional approval of the infrastructure improvements associated with that
subdivision known as Heritage Bay Phase Two-A.
CONSIDERATIONS:
1. On May 14, 2007, the Land Development Services Department granted preliminary
acceptance of the roadway and drainage improvements in Heritage Bay Phase Two-A.
2. The roadway and drainage improvements will be maintained by the project's
homeowners association. The water and sewer facilities have previously been accepted
by Collier County for operation and maintenance.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Land Development Services Department has inspected the
improvements and is recommending Conditional final acceptance of the improvements.
4. A resolution for Conditional final acceptance has been prepared and approved by the
County Attorney's OtTIce. A copy of the document is attached.
5. This PUD has been found to be in substantial compliance.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's homeowners
assoclatlOn. The original security in the amount of $ 1.607.012.00 has been reduced to the
current amount of $45,423.93 based on the previous work performed and completed. The
remaining security represents 150% of the estimated cost to complete the paving improvements.
LEGAL CONSIDERATIONS:
The County Attorney's OfJice has reviewed and approved the Resolution for legal sufficiency.
This item requires a majority vote. This item is ready for Board consideration and approval.

A R.ESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AUTHORIZING CONDITIONAL
FINAL ACCEPTANCE OF CERTAIN ROADWAY
AND DRAINAGE IMPROWMENTS IN
HERITAGE BAY PHASE TWO-A PURSUANT TO
SECTION 10.02.05 C.8 OF THE COLLIER
COUNTY LAND DEVELOPMENT CODE, AND
ACCORDING TO THE PLAT THEREOF
RECORDED IN PLAT BOOK 45. PAGES 76
THROUGH 83; RELEASE OF TIlE
MAINTENANCE SECURITY, EXCEPT TO THE
EXTENT REQUIRED UNTIL COMPLETION OF
THE FINAL LUT OF ASPHALT; THE
ROADWAY AND DRAINAGE IMPROVEMENTS
WILL BE MAlNT AlNED BY BA YVEST L.L.C.,
THEIR SUCCESSOR.S OR ASSIGNS
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
April!l, 2006, approved the plat of Heritage Bay Phase Two-A for recording; and
WHEREAS. the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-41, as
amended); and
WHEREAS, the Developer is requesting Conditional final acceptance of the
roadway and drainage improvements; and
WHEREAS, the Land Development Services Department has inspected the
roadway and drainage improvements, and is recommending Conditional acceptance of
Said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORlDA, that Conditional final
acceptance is hereby granted for those roadway and drainage improvements in Heritage
BayPha.se Two-A, pursuant to the plat thereof recorded in Plat Book 45, pages 76
through 83, and the Clerk is hereby authorized to release the maintenance security, except
to the extent necessary for completion of the final pa\~ng or sidewalk improvements.

BE IT FURTHER RESOLVED AND ORDERED that the roadway and drainage
improvements within Heritage Bay Phase Two-A will be maintained privately in the
future and will not be the responsibility of Collier County.
This Resolution adopted after motion, second and ml\iorlty vote favoring same,
this day of ,2011.
