Dear John:
The above reference projectwas issued an extension to the Final Subdivision Plat approval on February 1st,
2010 and is now ready for the final acceptance process to begin. On behalf of our client, we hereby request
a conditional final acceptance by the County and release of a portion of their maintenance security. The
client wishes to decrease the 10% maintenance bond and provide a decrease rider to bring the bond amount
to 150% of the remaining improvements which include portions of sidewalk and 2nd lift of asphalt that have
not been constructed in the undeveloped areas. The requested bond reduction is as follows:

The enclosed Conditional Final Acceptance Exhibitoutlines the areas of sidewalk and second lift of asphalt
that have not yet been constructed. These areas correspond to areas where no homes have been
completed. The owner is currently in the process of selling the remaining lots and the improvements will be
completed following construction of the remaining homes.

FLORIDA AUTHORIZING CONDITIONAL
FINAL ACCEPTANCE OF CERTAIN ROADW A Y
AND DRAINAGE IMPROVEMENTS IN
ANDALUCIA PURSUANT TO SECTION 10.02.05
C.8 OF THE COLLIER COUNTY LAND
DEVELOPMENT CODE, AND ACCORDING TO
THE PLAT THEREOF RECORDED IN PLAT
BOOK 43, PAGES 93 THROUGH 97; RELEASE
OF THE MAINTENANCE SECURITY, EXCEPT
TO THE EXTENT REQUIRED UNTIL
COMPLETION OF THE FINAL LIFT OF
ASPHALT; THE ROADWAY AND DRAINAGE
IMPROVEMENTS WILL BE MAINTAINED BY
THE ANDALUCIA HOMEOWNERS'
ASSOCIATION, INC.
WHEREAS, the Board of County Commissioners of Collier County, Florida, on
March 8, 2005, approved the plat of Andalucia for recording; and
~ WHEREAS, the Developer has constructed and maintained the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No. 04-41, as
amended); and
WHEREAS, the Developer is requesting Conditional final acceptance of the
roadway and drainage improvements; and
WHEREAS, the Land Development Services Department has inspected the
roadway and drainage improvements, and is recommending Conditional acceptance of
said facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that Conditional final
acceptance is hereby granted for those roadway and drainage improvements in Andalucia,
pursuant to the plat thereof recorded in Plat Book 43, pages 93 through 97, and the Clerk
is hereby authorized to release the maintenance security, except to the extent necessary
for completion of the final paving.

BE IT FURTHER RESOLVED AND ORDERED that the roadway and drainage ~.
improvements within Andalucia will be maintained privately in the future and will not be
the responsibility of Collier County.
