EXECUTIVE SUMMARY
Recommendation ,to approve staff recommendation tha,t the Vanderbilt bathroom and
concession facility be built to conform to FEMA's National Flood Insurance Program
(NFIP) guidelines for VE-14 elevated facility.
OBJECTIVE: Recommendation to approve staff recommendation that the Vanderbilt
bathroom and concession facility be built to conform to NFIP guidelines of a VE-14
elevated facility.
CONSIDERATIONS: The BCC directed the staff to determine to what extent a decision
to build the proposed Vanderbilt Beach bathroom, concession, and deck facility at-grade
(below the FEMA designation of VE-14) might adversely affect our Community'Rating
System (CRS) score prior to additional engineering or permitting of for this facility.
A request was made through the Commission Chairman on 1/26/2011 to FEMA Staff in
Atlanta. On February 9, 2011, Mr. Brad Loar the Director of FEMA's Mitigation Division
responded that:
1. Collier County currently participates in the Community Rating System (CRS)
Program. Only five percent of the NFIP participating communities are members
of the Community Rating system. As a member of CRS, Collier County is
expected to have a more robust and effective flood damage prevention program.
2. Collier County is a CRS community with a Class 6 rating and it's 59,555 policy
holders enjoy a $4.3 million premium reduction each year.
3. Construction of the Vanderbilt Beach facility at grade is in violation of Collier
County ordinance requirements and the NFIP. FEMA staff is also concerned
that this would set a precedent making it more difficult for the County to deny
private party variance requests in the future.
4. As a result of these conditions, if the County proceeds with the development of
this facility at-grade, the facility will be non-compliant and FEMA staff will
recommended that Collier County's CRS score be downgraded to Class 10
which provides for no premium savings. This places in jeopardy the $4.3M in
premium savings that the residents of Collier County currently enjoy.
STAFF RECOMMENDATIONS: Staff recommends that the Vanderbilt bathroom and
concession facility be built to conform to NFIP guidelines of a VE-14 elevated facility.
With approval, staff will proceed with the design, permitting, and construction plans for
an elevated beach park facility.
FISCAL IMPACT: The Source of funds is from Category "A" Tourist Development Tax.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's
Office, requires majority vote, and is legally sufficient for Board action. - CMG
RECOMMENDATION: Staff recommends that the Vanderbilt bathroom and concession
facility be built to conform to FEMA's NFIP guidelines for VE-14 elevated facility.

Reference: Request for Specific Impacts to Collier County, FL Community Rating System
Dear Chairman Coyle:
This is in response to your letter, dated January 26,2011, to Major Phillip May, Regional
Administrator, regarding the proposed development on Vanderbilt Beach, which includes a
3,800-square-foot facility with bathrooms, concession stand, and an elevate~ deck. You stated
that the structure is proposed to be built in a VE-Zone and that the proposed draft Flood
Insurance Rate Map indicates the Base Flood Elevation (BFE) as 14 feet. Further, Collier
County intends to build this facility at grade, approximately eight feet below the BFE.
The VE-Zone requirements of the National Flood Insurance Program (NFIP) require that the
elevation of the bottom of the lowest horizontal structural member of the "lowest floor" be
elevated to the BFE. If County regulations are more restrictive, they take precedence and this
elevation will be higher than the BFE. It will clearly be a violation of the NFIP regulations, as
well as Collier County ordinance requirements, to build this facility at grade. It will also be a
violation of the free-of-obstruction requirements of the Collier County ordinance and the NFIP
Regulations.
Only about five percent ofNFIP participating communities participate in the Community Rating
System (CRS) Program. Collier County currently is a CRS community with a Class 6 rating.
Collier County's 59,555 flood insurance policyholders enjoy more than $43 million in premium
savings every year. As a result, Collier County is expected to have a much more robust and
effective flood damage prevention program compared to a non-CRS community. lbis proposed
development by the County does not reflect the CRS Class 6 standard. More importantly, this
development, ifbuilt without complying with the County regulations, we believe Collier County
may not be in a position to deny other variance requests for similar developments by private
entities.
Due to the serious nature of the potential violation and the County's inability to deny any such
proposed developments in a special flood hazard area, the County's participation in the CRS will
be placed in jeopardy. Should tlle County proceed with development of this non-compliant

Collier County intends to rebuild its public bathrooms and beach park facility on Vanderbilt Beach. We
intended to build a very modest 3,800 square foot facility with bathrooms, concession stand and an elevated
deck. The proposed draft FEMA flood map designation for this location is VE-14. In order to conform to the
FEMA Vertical Elevation eVE) guidelines ofVE 14, we would have to build a structure at least 8 feet above the
beach elevation of 6 feet This would be more expensive than a structure built at grade.
We are interested in determining the e:>..i:ent to which a decision to build at grade (below the FEMA
designation ofVE-14) might adversely affect our Community Rating System score.
