BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE

4. No claims have been made to the Owner by, nor is any suit now pending on behalf of, any
contractor, subcontractor, laborer or materialman, and further that no chattel mortgages or conditional bills of sale
have been given or are now outstanding as to the subject utility facilities placed upon or installed in the aforesaid
premises.

5. Banyan Woods, LLC, as and on behalf of the owner of the subject utility facilities, does for
valuable consideration hereby agree and guarantee, to hold the Board of County Commissioners of Collier County,
Florida, as the governing body of Collier County and as Ex-Officio the Governing Board of the Collier County
Water-Sewer District harmless against any lien, claim or suit by any general contractor, subcontractor, mechanic or
materialman, and against chattel mortgages, security interests or repair 0Zth subject utility facilities. Affiant is used

Dear Mr. Keene:
This is to inform you that the above referenced project has been granted preliminary approval by
Engineering Review in compliance with Collier County Land Development Code, Section 3. All
water and/or sewer facilities approved, accepted and required to be maintained by Collier County
shall be conveyed to the County pursuant to the provisions set forth in Collier County Ordinance
No. 97-17, as amended.
You are reminded that it is your responsibility to petition the Development Services Director for
final approval of the improvements upon the expiration of the minimum one (1) year maintenance
period. After satisfactory completion of all final inspections., the Board of County
Commissioners shall grant final approval of the required improvements establishing County
responsibility for maintenance of the required improvements ifit is the Board's desire to accept
and maintain the facilities.

the Board of County Commissioners of the specific improvements described in the
Land Development Regulations (hereinafter the "Guaranty Period").
NOW, THEREFORE, ifthe Owner shall well, truly and faithfully perform its
obligations and duties in accordance with the Land Devleopment Regulations
during the guaranty period established by the County, and the Owner shall satisfy
all claims and demands incurred and shall fully indemnify and save harmless the
County from and against all costs and damages which it may suffer by reason of
Owner's failure to do so, and shall reimburse and repay the County all outlay and
expense which the County may incur in making good and default, then this
obligation shall be void, otherwise to remain in full force and effect.
PROVIDED, FURTHER, that the said Surety, for value received hereby, stipulates
and agrees that no change, extension of time, alteration, addition or deletion to the
proposed specific improvements shall in any way affect its obligation on this Bond,
and it does hereby waive notice of any such change, extension of time, alteration,
addition or deletion to the proposed specific improvements.
PROVIDED FURTHER, that it is expressly agreed that the Bond shall be deemed
amended automatically and immediately, without formal and separate amendments
hereto, so as to bind the Owner and the Surety, to the full and faithful performance
in accordance with the Land Development Regulations. The term "Amendment,"
wherever used in this Bond, and whether referring to this Bond, or other documents
shall include any alteration, addition or modification of any character whatsoever.

FORCE MAIN PRESSURE TEST
Dear Mrs. Nix:
This is to certify that the force main extension recently constructed for the Banyan Woods project has
been pressure-tested in accordance with A WW A C600 at a test pressure of 100 PSI for a period of two
(2) hours. The test results were deemed acceptable. There are no force mains associated with the
Multi-Family Tract. The new sanitary force main is hereby certified as passing the required pressure
test.

This is to certify that the recently constructed on site gravity sanitary sewer lines for the above-referenced
project have been inspected and tested in accordance with Collier County requirements. .
(50 gallons * 8" sewer line) * 613 l.f. sewer main/5,280 = 3.9 gallons maximum allowable leakage
The actual1eakage during testing was 0 gallons. These test results were deemed acceptable. The new
gravity sanitary sewer mains are hereby certified as passing the required inspections and tests.

This letter is to certify the coating on the manholes located at Banyan Woods. Oldcastle Precast, Inc.
certifies that the coating has been applied in a minimum thickness of 18 mils on the exterior surface and a
minimum of 36 mils, in two coats, on the interior surface of the manhole. Oldcastle Precast, Inc. certifies
that the coating is Coal Tar Epoxy C-200, and approved epoxy bituminous sealant.
