NOTICE OF SPECIAL MEETING OF THE COLLIER COUNTY
BOARD OF COUNTY COMMISSIONERS TO REVIEW
HURRICANE PREPAREDNESS PLANS
Notice is hereby given that the Board of County Commissioners of Collier County will
hold a special meeting on THURSDAY, SEPTEMBER 2, 2004, at 3:30 P.M. in the
Boardroom, 3rd Floor of the W. Harmon Turner Building (Administration Building F), Collier
County Government Center, 3301 East Tamiami Trail, Naples, Florida. The Board's Agenda
will include:
Discussion will include but not be limited to:
A. Updated track information for Hurricane Frances and its potential effect on
the citizens of Collier County.
B. Consideration of adoption of Proclamation/Resolution declaring State of
Emergency in Collier County.
All interested parties are invited to attend, to register to speak and to submit their
objections, if any, in writing, to the Board prior to the special meeting.
All registered public speakers will be limited to five (5) minutes unless permission for
additional time is granted by the Chairman.
Any person who decides to appeal a decision of the Board will need a record of the
proceedings pertaining thereto, and therefore, may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which the appeal is
to be based.
Co1Iier County Ordinance No. 2003-53, as amended, requires that all lobbyists shall,
before engaging in any lobbying activities (including, but not limited to, addressing the Board of
County Commissioners), register with the Clerk to the Board at the Board Minutes and Records
Department.

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA RETROACTIVEL Y
AUTHORIZING COLLIER COUNTY'S PUBLIC UTILITIES
DIVISION TO REMOVE ALL HURRICANE CHARLEY RELATED
DEBRIS ALONG RIGHTS OF WAY OF PUBLIC ROADS &
PRIV ATE ROADWAYS AND WAIVING SIZE AND BUNDLING
RESTRICTIONS AND WAIVING TIPPING FEES FOR RESIDENTS
WHO CHOSE TO SELF-DELIVER STORM RELATED DEBRIS TO
THE LANDFILLS.
WHEREAS, on August 11,2004, the Board of County Commissioners of Collier
County, Florida adopted Proclamation/Resolution No. 2004-244 to Declare a State of
Emergency for all territory within the legal boundaries of Collier County including all
incorporated and unincorporated areas; and
WHEREAS, Hurricane Charley has greatly effected the amount of debris along
the rights of way of public roads and private roadways of Collier County; and
WHEREAS, Collier County Emergency Management officials are
recommending that the Collier County Public Utilities Division remove all storm related
debris along rights of way of public roads and private roadways and that the restrictions
of size and bundling be waived during the storm debris removal period and the tipping
fee be waived for all residents who chose to self-deliver storm related debris directly to
the landfills, and that these actions are consistent with Collier County's Emergency
Management Plan and Collier County's Phase 1 and Phase 2 Emergency Debris Removal
Plan and are necessary to protect public health and safety.
NOW THEREFORE, IT IS RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, in special session, this
2nd day of September, 2004, that the Collier County's Public Utilities Division is
retroactively authorized to remove all Hurricane Charley related debris along rights of
way of public roads and private roadways and the Board waives horticultural debris size
and bundling restrictions and waives tipping fees for residents who chose to self-deliver
storm related debris to the landfills.
This Resolution adopted after motion, second and majority vote favoring same.

PROCLAMA TION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY
TO DECLARE A STATE OF EMERGENCY FOR ALL TERRITORY WITHIN THE LEGAL
BOUNDARIES OF COLLIER COUNTY INCLUDING ALL INCORPORATED AND
UNINCORPORATED AREAS
WHEREAS, Hurricane Frances has the potential for causing extensive damage to public utilities,
public buildings, public communication systems, public streets and roads, public drainage systems,
commercial and residential bui1dings and areas; and
WHEREAS, Col1ier County Emergency Management officials are recommending that a "State of
Local Emergency" be dec1ared due to the current and predicted path of Hurricane Frances; and
WHEREAS, Chapter 252.38 (3) (a) 5, Fla. Stat., and Collier County Ordinance Nos. 84-37,
2001-45 and 2002-50 (codified at Sections 38-56 through 38-70 in the CoI1ier County Code of Laws and
Ordinances) provide for a political subdivision such as Collier County to declare a State of Local
Emergency and to waive the procedures and formahties otherwise required of political subdivisions by
law pertaining to:
1. Performance of public work and taking whatever prudent action is necessary to ensure the
health, safety and welfare of the community;
2. Entering into contracts;
3. Incurring obligations;
4. Employment of permanent and temporary workers;
5. Rental of equipment;
6. Utilization of volunteer workers;
7. Acquisition and distribution, with or without compensation, of supplies, mateIials and
facilities;
8. Appropriation and expenditure of public funds.
NOW THEREFORE, IT IS RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, in special session, this 2nd day of
September, 2004, that Hurricane Frances poses a serious threat to the lives and property of residents of
Collier County, that voluntary evacuation is encouraged and that a State of Local Emergency be declared,
effective immediately for all territory in the incorporated and unincorporated areas of Collier County.
BE IT FURTHER RESOLVED, that the Board of County Commissioners hereby exercises its
authority pursuant to CoI1ier County Ordinance Nos. 84-37, 2001-45 and 2002-50 and waives the
procedures and formalities required by law of a political subdivision, as provided in Chapter 252.38 (3)
(a) 5, Fla. Stat. including authorization for Purchasing Director to waive existing purchasing card
limitations during the declared emergency.
BE IT FURTHER RESOLVED, that the Board of County Commissioners hereby declares that
during an emergency it shall be unlawful and an offense against the County for any person operating
within the County to charge more than the normal average retail price for any merchandise, goods or
services sold during the emergency. The average retail price as used herein is defined to be that price at
which similar merchandise, goods or services were being sold during the 30 days immediately preceding
the emergency or at a mark-up which is a larger percentage over wholesale cost than was being added to
wholesale cost prior to the emergency. The waiver and reimposition of the state gas tax(es) shall not
factor as to gasoline/petroleum products sales prices.

RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS FOLLOWING
ITS DECLARATION OF A STATE OF LOCAL EMERGENCY FOR ALL

SPECIFIED EMS FEES; WAIVER OF FEES FOR CAT SERVICE AND OPENING
NEW APPROPRIATION FUND FOR EMERGENCY SERVICES DURING
HURRICANE FRANCES.
WHEREAS, on September 2, 2004 the Board of County Commissioners of Collier County,
Florida (the "Board") in Special Session adopted Proclamation/Resolution 2004-248 declaring a state of
emergency for all territory within the legal boundaries of Collier County including all incorporated and
unincorporated areas; and
WHEREAS, The Board, having duly met in chambers on Thursday, September 2, 2004 and being
further informed that Hurricane Frances has the potential for causing extensive damage to public utilities,
public buildings, public communication systems, public streets and roads, public drainage systems,
commercial and residential building and areas and posed an imminent threat to the health, safety and
welfare of the citizens, residents and visitors of/to Collier County.
NOW THEREFORE, IT IS RESOL VED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, in Special Session, this 2nd day of
September 2004, that:
1. The Board waives the base fee(s) for convalescent transports by Collier County EMS for
evacuation only to approved shelter(s) pursuant to EMS practices and procedures for "Registered Special
Needs" persons.
2. The Board wai ves the fees for CAT service on Friday to aid in evacuation of residents.
3. The Board authorizes the opening of a new appropriation fund with $50,000.00 starting
base for emergency services during Hurricane Frances.
This Resolution adopted after motion, second and majority vote favoring same.
