EXECUTIVE SUMMARY
Appointment of members to the Pelican Bay Services Division Board
OBJECTIVE:. To appoint 2 members representing Residential to serve 4 year terms, expiring
on March 31, 2015, to the Pelican Bay Services Division Board, Declare a vacancy for the 1 term
representing Residential expiring March 31, 20 I] that did not receive an applicant.
CONSIDERATIONS: This 1] member Board was established by Ordinance 2002-27 as
amended, The Division provides landscaping services, including all public road maintenance
and park areas, street lighting services, aquatic management services, beach cleaning, and the
Clam Bay Restoration Project. It is the Division's responsibility to provide the framework of
long-term community planning so that residents can enjoy the benefits of Pelican Bay while
ensuring both the social and financial well being of the Pelican Bay Community, A list of the
current membership is included in the backup,
Ordinance 2002-27 states that the Board of County Conunissioners shall publish the list of
nominees and the positions on the Committee for which they have been nominated and deliver a
conformed copy to the Clerk of Courts, The Clerk shall cause the name of each nominee as
reported and published by the Board of County Commissioners to be included on the mail ballot,
which ballot shall be mailed to all of the non-governmental property owners of the class (i.e.
"Residential or Commercial/Business/Other") corresponding with the class for which the
balloting is occurring ("Residential or Commercial/Business/Other") within the Unit no less than
thirty (30) days prior to the balloting date. Said balloting date being set by the Board of County
Commissioners,
The terms for John Iaizzo (resident), Michael H. Levy (resident), and Theodore J. Raia (resident)
will expire on March 31, 2011. A press release was issued and resumes were received from the

RE: Pelican Bay Services Division Board - Election of Board Members
Collier County eode of Laws and Ordinances, Chapter 122, governs the composition and appointment of
members to the Pc1ican Bay Services Division Board (the "Board"), The Board is comprised of eleven
(II) members; nine (9) members are representatives from the residential portion of the taxing unit and
two (2) members are representatives of the commercial and business interests,
Three (3) vacancies were advertised seeking applications to till the vacant positions in December 20]0 as
required by Section 122-1 662(c) of the Ordinancc, Only two (2) applications were submitted, I am
responding to your question as to how those two applications should be processed for the vacant positions
and what procedure should be followed for the remaining vacant position, J will answer those issues in
order.
A. The Two Applicants
In instances where the number of applications exceeds the number of available positions, the ordinance
provides a process where the Clerk of Court is involved in a process of mailing out ballots to
nongovernmental propelty owners in Pelican Bay to votc for either residential or commercial candidates,
The mail ballots are then cast directly to the Clerk who opens and counts the ballots at a designated time,

If. however, the number of applications does not exceed the number of open members, Section 122-
1662(f) states: "",there shall be no balloting for such position, Rather, the list of nominees for the
position shall simply be forwarded to the Board of County Commissioners who, following public hearing
on the matter will make the necessary appointments to fill the position," Therefore. the names of the two
applicants, if otherwise qualified, should be forwarded to the Board of County Commissioners for
appointment.
B, The Remaining Vacant Position
As to the third remaining vacant position, I would recommend re-advertising the position and seeking a
recommendation from the PBSD Board, The exact situation we have in this instance is not addressed in
thc ordinancc but thcrc is somc authority that would support following the advertising and selection
procedure in the County's general Advisory Board Ordinance No, 2001,55, Notably, all appointments of
members to the PBSD Board are at thc sole and complete discretion of the BCC - although when thc
process works the way it is supposed to. the BCC is to give "great weight" to the recommendations of the
properry owners as represented in their ballots,

This 15 member committee was created by Ord. No, 90-111 and amended by Ord, No, 91,22
and 93-15 to aid and assist the County manager and the Board of County Commissioners in
determining the need and quantity of extraordinary law enforcement in Pelican Bay. Also to aid,
assist, and provide input to the County Manager and the Board in effecting a smooth and
expeditious transfer of street lighting, water management and beautification services,
responsibilities and obligations from the Pelican Bay Improvement District. On 11/3/98 the BCC
reduced the membership from 15 to 13 members. Terms are 4 years, On April 11 ,2000, the
BCC adopted Ord. No, 2000-22 reducing the membership from 13 members to 11 members,
On 5/28/02 the BCC adopted Ord. 2002-27 establishing the 11 member committee,
Membership shall be 9 representative of the residential interests within the Unit and 2 shall be
representative of the commercial & business interests within the unit
