reco..ended as part of his budget me..age to the Board, since the fe..
eatabllshed in the Occupational License Tax system of the County have
not been changed for ten years. He said he thought the charges should
be brought Into line with fees charged elsewhere as an essential part
of the County'. revenue system and not just to h~lp the Tax Collector
offset the cost of collecting the tax. In response to Chairman
Pistor's question, Mr. Norman said that the Tax Collector and County
Attorney had developed the proposal.
Assistant County Attorney ~.n Cuyler said he wrote the additions
and deletions to the Ordinances and, in response to Commis.ioner
Wenzel, he *ald that the majority of the ordinance i. simply an
increase in fee. and that the manner in which the fees were handled in
the past would be the way they are handled in the future. Commissioner
Wenzel said he wanted to make sure that the small business person did
not pay as much as the business person who does a million dollars or
more worth of business.
Mr. Norman stated that last year th~ Legislature established
limits on how much occupational license fees could be Increas~ and
that because of the limits of 100' tor fees under $100, etc., that the
inequities which existed in the prior ordinance can not really ba
corrected at this time.
CoM~la.loner Brown asked what a huckster would pay and Supervisor
of Occupational Licen.e. Mr. Roe.toriff explained he would need a
peddler's license for $5.00 and there would also need to be . retail .
license to sell the produce which would be $30.00 under the proposed
ordinance.

Mr. Cuyler said that the licenses are a privilege to engage in
whatever business Q person applies for and it does not preempt any
other departments of the County, since the applic~nt has to co~ply witb
each department as they would Zoning, Building, etc.
Mr. Norman said that there had been a great amount of improvement
during the past year between the Tax Collector's Department and the
Building and Zoining Departm~nts and that the kind of information being
developed and vigor with which the departments have enforced the
Occupational License Ordinance has been a great help. He .ald more
work need. to be done to integrate and provide rapid co~unlcatlon of
the information which can be done when the computer programs are
develope" .
After continued discu.sion, Commissioner ~ruse said she felt that
continuity was lacking between some of the sections and that there were
too ~any ambiguities. Commissioner Wenzel moved, .econded by Conmi.-
sioner Kruse, to continue the Occupational Licens. Ordinance discu..ion
and have a workshop on ~ugust 26, 1981 and bring the ite. back for

Chairman Pistor said he has received continuous complaints trOM
peoplo Who walk the beach about obstructions which are placed on the
, beach and that he could not see w~y a f~nce ~hould b. put before the
Setback Line. Mr. Virta said that the developer has built virtually on
the Setback Line and that in order to secure the site to protect the
public, the fence had to be put seaward but he pointed out that the
fence was constructed without Board approval.
Mr. Robert Motchkavitz, Director of Environmental Service. for
Deltona Corporation, explained he was the permit agent on the applica-
tion and that the fence is 1751 from the mean highwater line. He .ald
that a ~istakel was made and identified late last year by DNR in.pector. 'j

and that De1tona acknowledged the mis~ake. He said that Deltona has
been attempting to program a solution and work with the DNR to remedy
the 8ituatiÓn and that in the course of the company's inspection, It
was discovered that there had been disruption of the dunes vegetation
on the beach by traffic from construction vehicles from another project
not owned by Deltona and that, in acknowledgment of Deltonal. placement
of the fence without obtaining proper approval, Deltona has agreed to

restore to a natural condition all the aroas which the company has
disturbed by its construction activities in addition to all other areas
that were di.turbed by construction activilies of others and have

requires that the work be done or not. He explained that the company

of Naples Bay, north of Thomasson Drive. She explained that this
rezoning is basically a cleanup from the rezoning of 1980 when the

petitioner was given approval for 749 units with œaxlmum height of
three stories, and that a portion of the rezoning was in the City and

when the petitioner applied before they did not specify what kind of
sod would be installed and that later he returned and said that flora-
tam sod, which is fairly salt tolerant, would be used. He slid thlt
one of the catamarans stored on the beach belonged to a resident and
after the signs were posted, the catamaran. were removed. ße explained
that the line of sea oat. Is a good barrier to keep people out. In
response to Commissioner Wenzel, Mr. Kelly said the developer wanted to

variance of 455-1/2 square feet in the required land area by providing
two lots totalling 12,544.5 square feet instead of the requ~red 13,000

proble~ stems from the fact that the lots have a 30' drainage rlght-
of-way which was taken from the back of the property and this has
shortened the depth of the lots. He said the Public Works DepartDent
stated that the right-of-way was taken in lieu of an easement becau.e
of a Dajor drainage way coming from one of the eÐstern streets and that
it was nece.sary that it be much larger to avoid people frOft having to

Zoning Director Perry explained that the petitioner i. asking the
Board of Zonin9 Appeals to review his Interpretation of the zoning
Ordinance specifically concerning his decision that beekeeping is not
an accessory use that is customarily incidental to the principal use.

County Attorney Pickworth reminded the Commi.sioners of a discus-
sion held a few weeks ago on the subject of impact fees and the studle.

pr.sent. Mr. pickworth said that the firm submittod a proposal in a

overall review of the County'. curr.ntly existing facilities, and
current capital I~provem.nts along with specific rec~endations as to

Chairman pistor said that if the proposal was written it would be
put into effect, hopefully, before December 31, 1981 and it. will be on
the books and be effective by the ond of this year. He said if the
proposal was written 80 that it meets legal requiremente, he felt the
County could have a successful impact fee impl~mentation and could
start to collect money for roads and parks. County Manager Norman said

he wanted tÓ point out What he perceived to be the relationship between
the .t~~y being discussed and the school impact fee study. He said the
firm has been introduced to represent the School Board and it was hi.
belief and desire that the School Board would discuss with them the
possibility of their performing consulting services directly for the
School Board and then when agreement was reached with the School Board
on a program which was acceptable to the School Board, that would be
the time for the School Board and Board of County Commissioner. to qet
toqether and develop the ordinance that is necessary to implement.

A short discussion followed regarding the ordinanc. which Ever-
91ade. City would not accept with Mr. Norman stating that there were
.ome problems with that ordinance. Chairman pi.tor noted that Broward
County has an impact fee ordinance and money has been coll.cted but the
money Is In escrow and the ordinance i. under legal consideration. Mr.
Norman said that there would probably be 2, 3 or 4 .eparate fees and
not a single impact fee because each area would have to be treated
.eparately.

Mr. Barksdale said that both the Big Cypress Basin Board and the
WMAB have recommended that the fixed crest-slide gate structure be
used. He stated that during the BCBB and WMAB meetings oppo.ition to
the location of the structure at Site A was voiced by property owner.

conducted a study to assess the eftects of the differences in benefit.
between the two locations and concluded that the loss of benefit in
locating the structure upstream would be minimal due to water level. in
the surrounding areas being maintained at elevation +3.5 msl or qreater
and that the greatest benetit is gained by the installation of the
structure at either location in light of the fact that the existing
canal is tidal. He noted that the consultant reported the cost of
construction at either site would be the same. He stated that the BeSS
and the WMAB have recommended that the structure be located at Site B
approximately 400 feet west of the Palm River Boulevard Bridge.

Commissioner Wimer, Mr. Vidzes said that the Water Management Stuðy
Plan for Di.trict 7 indicated a location of the weir but not with any
precision, and that he interpreted the study to favor Site B.

conjunction with,the Palm River Bridge and Mr. Vidzes said that pos.i-
billty was not considered but he said he felt that the weir and bridge

Commissioner ~ruse suggested that the Board approve the structure
at Site B with the stipulation that the fence be landscaped. In
response to Commissioner Wenzel, Mr. Barksdale said that the weirs
where fences have been installed have had less vandalism. Commissioner
Wimer moved, seconded by Com~i.sioner Wenzel, that the subject of the
location of the proposed wnter control structure be returned to the Bi9
Cypress Basin Board and ask them to look at the feasibility of
Installing the well' in conjunction with the bridge entering Pala River.
Mr. Vidzes said that the design budget has already been aurpas.ed
and the consultant Is already underway with the designs, plan=, and
.pecifications for the proposed structure and that to investigate a
veir in conjunction with the bridge would require f~rther expenditure

carried unanimously, that Resolution 81-194 establishing a 45 MP
H speed zone on Santa Barbara Boulevard between Golden Gate parkway and
Green Boulevard be adopted.

CETA Director Donald Norton explained the request for approval of
rlacal Year 1982 CETA Administrative Contract, Title II-B Contract,
Titl. IV-~ Contract, and Titl. VII Contract. ße said that he recently
received tentative CETA allocation levels for Collier County and he
noted that the CET~ Public Service Program no longer exists which cut.
the CETA funds by SOt. He said he was concerned with the Contract for
Title II-B, the Oeneral Training Provision, Title IV-A, Youth Employ-
.ent Training Program, the Administrative Contract and the Title VII
Contract which is the Private Sector Initiative Program and I. geared
towards increasing the involvement of the private sector In employment
and training delivery programs.
Mr. Norton said he submitted a proposal and, of 35 proposal.
.ubmitted, Collier County ranked second. He said the amount of money
available under Title VII is $100,000. He explained that th.re were
four deliverers of types of services selected statewide who will be a
public sector organization, such ðS the Board of County Commissioners,
and that the four contracts repreBent $~32,OOO that will be spent In
Collier County for employment and training services. He said he felt
confident that approximately $100,000 will be available later In the
year since the summer youth program allocations do not come out until
then.
Mr. Norton said that with the elimination of the Public Service
progra., the remaining CETA programs have sustained cuts in their
~unding levels and they will become effective October 1, 1981, and
there will have to be a gradual phase down of the enroll.ent l..el on

by the County Manager that thø County could not arbitrarily cancel the

The motion was discussed at length, during which Commissioner
WQn~el clarified that it the intent of his motion that Collier County
vill not renew any CETA contracts after the completion of FY 81-82.
County Manager Norman stated that the subject CETA contract.
repre.ent a 50' reduction from last year. Commissioner Wenzel said
that if the notification is sent now, there would not be any problem
associated with not executing si~ilar contracts in October of 1982.
Chairman Pistor stated that the County has been gradually phasing
the CETA program out anyhow, and has not been placing any new people to
replace any CETA position. Mr. Norman stated that the County {s faced
with a 50' cutback in administrative staff for this coming year and he
added that the subsequent monetary adjustments to the budget will be
discussed next week, therefore, the whole story is not before the Board
at this time. However, sðid Mr. Norman, he is peraonnally convinced
that CETA has been and will continue to be a very valuable program for
the citizens of Collier County. He said that he Is very pleased with
the work that Mr. Norton, CETA Director has been doing. He re.lnded
the Board that there are no coats related to the citizens of Collier
County for the operation of the CETA prog ram and that it Is the only
progru that he Is aware of that is entirely Federally funded and
benefit. the people of the County. ae urged the Board to reconsider
their action of this morning because he considers that It would be .
re.l trave.ty of justice to just abandon the progra~.

workshopped in the future before any decisions are made regarding
phasing out the program entirely. Commissioner Wenzel agreed, and
Commissioner Wimer seconded the amended motion, which carried
unanlllously.

workshop session this date. He said that he believes that it is In the

next week. He said that he has some ideas as to what should be the
priorities ~f the Planning Department, beginning with the dev.lopment
of the new Zoning Ordinance, and following through with the
Comprehensive Plan update, Including parks, the Beach Access Master
Plan, including Pelican Bay parks, the Beach Management Master Plan,
and, the Impact Fee Ordinance.
Referring to the Beach Access and Beach Management Master Plans,
Commisslaner Wimer stated that he considers this to be the most
l~portant issues before the BCC that needs to be handled and a.ked the
Planning staff to reconsider the amount of time being set aside for
these projects. He said that he relies on the staff to express to the
Board what it is that Is requir.d to handle the projects and, although
he doe. not favor spending a lot more money, h. consld.r. the Soard
reasonable and stated that if what needs to be don. to follow through
with the projects Is to hire more personnel, h. believes that thl. vlll

Administrative Assistant Neil Oorri11 explained that, pur.uant to
Board direction, a citizons advisory committee was formed to review the
Collier County space program. He said that the committee was formed,
in spite of the fact that there waG a general lack of interest
displayed on the part of the public with respect to participation on
this volunteer co~ittee. He said that the individuals that did
volunteer to serve have worked diligently, and are to be highly
commended. Mr. Oorrill said that the Chairman of the committee, Alva
Dlttrick, Is prepared to make a presentation of the result. of the
9roup·. review of the Polizzi/Heery space study. Mr. Dorril1 thanked
the entire committee and especially those who worked so hard all
through the entire project, on behalf of the County Manager'. office.

that this Is a most Important issue and that it could very well concern
the expenditure of a great deal of money.

into .ub-committees, and that the following area. of concern were
studied by each sub-committees Criminal Justice (Courts and Sheriff'.
Department), ~dminlstratlon (operation. of the County Manager) and,
Constitutional Officers.
Mr. Dittrick .tated that it wos the consensus of the space .tudy
committee that the consultants, report (Polizzl/Heery) was thorough and
well done, although, it may be a little too optimistic, .Ince input was
taken largely from the County officials and .taff ....b.r.. He said
that the committee feel. that tho Polizzl/He.ry projection of the need
for 294,698 .qJft. of apace by 1996 seems incompatible with the
population growth of 60,000 (72') for this same period. Øe added that
there had been little attention to personnel incre.se. anticipated and
that this is a relationship to space need.. ne said that the
reco~endation of 178,000 additional square ft. must be 'ustlfled by
occupancy or the purpo.e for which the space Is to be used. Be also

Mr~ Dittrlck stated that the committee feel. that the .xpan.i~n
program should be planned for ten years with provisions made for
further d.velopment as required for fifteen years.
Regarding the jail, he commented that the committee has endorsed
the .ingle cell conceptr and, that all prisoners should be housed In
on. c.ntral facility, thus eliminating the Immokalee Gtockade.
Regarding the Courts area, Hr. Dittrick stated that tho committee
feel. that the projected increase of 27,000 sq. ft. 18 extremely
ambitious and that they recommend that the jusiclary areas be
re.tudied. However, said Mr. Dittrick, the committee agrees that the
construction of a Criminal Justice Center should be given urgent
priority, including the Courts, Jail, Sheriff's Department, State
Attorney, Public Defendor and other ancillary services. He added that
the centrali%ation of the operations in the newly constructed center
would free space in existing buildings to be renovated for additional
office space required by other departments.
Mr. Dittrick atated that m.etl~g the demands for additional spac.
need. will be a costly venture and the commltee believes that the
projections by department heads are overly ambitious and that there I.

Mr. Plummer said that his job on the committee was to analyze the
department needs under" "the County Mañager;' and that he has found that
,there Is a great deal of .catching up· that needs to be done in ~any of
the.e departments. He said that most are overcrowded, and that the
worst is the Health Department and the Museum. ~lso, in need of more
.pace, as soon as possible, is the Building Inspection Department and
the Planning Department. Mr. Plummer said that he only considers that
there are two departments within the entire complex which fall under
the County Manager with sufficient space allocations, the Veterans
Affairs office and the Utilities Division.
There was a lengthy discussion regarding the comments made during
the aforementioned presentations, including a statement by Clerk Reagan
that he believes that the basis on which projections for the Criminal
Justice areas should be made should come from the fac~s presented
through the State Attorney's Office, because he feel. that this I. the
office from which all the others will receive their Individual work
loads, i.e. the number of judges that will be required is based on the
number of cases handled in the State Attorney's office, as are the
number of courtrooms that will be needed.
Clerk Reagan also took e~ceptlon to the term -fat- being applied
to his projections for required space.

Mr. Balles explained the differenc~ In theories for basing the
'number of projected judges for Collier County that have caus.d certain

thÀt Judge Cart'ton Is opposed to basing projections on historical
caseload numbers converted to a ratio, based on population and current
caseloads. Mr. Bailes stated that the ratio between caseload and
population has not been static in the past, thus, the Judges fe.l this
Is not the optimum methodology to use.
Mr. Bailes said that he tends to rely on the agencies, department
heads and personnel involved, because he feels that they know beat
about what they need. He said that there is a 6ubstantial difference
between the sub-committees report and that of the Judges which could
result in an impact of several thousand square f.eet. He said that, if
the answer is not forthcoming today, this will have to be settled aome
time in the near future.
Chairman pistor said that he has received another letter from
Judge Carlton, which indicated that he feels that the space study
requirements must be broadcast over the next fifteen years for the
JUdges in order to avoid problems similar to what ia happening now ten
years down the road. He said that Judge Carlton urges the optimistic
figures be used, rather than those of the sub-committee. Chairman
Pistor said that Judge Carlton has stated in his letter that, -to allow
enough square footage to grow into would be so much easier and wiser
than to build for ~oday and then worry about tommorrow-. He said that
Judge Carlton states, -the committee report of two additional judge.

1981 for consideration of the adoption of the new proposed No-Smoking
Ordinance.
RESOLUTION Bl-l9S, ESTABLISHING AND APPOINTING AN ADVISORY COMMITTE! TO
THE MARCO ISL~ND BEAUTIFICATION UNIT - ADOPTED
County Attorney Pickworth explained the method of selection of the
members to the Advisory Committee re the Marco Island Beautification
Unit. He said that the Committee shall be made up of one represen-
tative who shall be appointed by the President of each of the following
interested organizationsl Marco Island Chamber of Commerce, the Marco
Island Civic Assoc., the Marco Island Taxpayers Assoc., the Marco
Island Jaycees1 and, the Marco Island Women's Club. He said that there
will also be an alternate member chosen by the BCC and that the
responsibility of membership shall be up to the five aforementioned
organi zations.
Commissioner Kruse moved, seconded by Commissioner Wenzel and
carried 4/0, that Resolution 81-195, establishing and appointing an
advisory committee to th& Marco Island Beautification Unit be adopted.
