CCPC Minutes 09/07/2004 W TRANSCRIPT OF THE MEETING OF THE COLLIER COUNTY PLANNING COMMISSION UDC - LDC WORKSHOP Naples, Florida, September 7, 2004 LET IT BE REMEMBERED, that the Collier County Planning Commission in and for the County of Collier, having conducted business herein, met on this date at 9:00 AM in the BCC Chambers, Main Government Complex, Building F, Naples, Florida, with the following members present: Chairman: Russell Budd Vice-Chairman: Mark Strain Kenneth Abernathy Brad Schiffer Robert Murray ALSO PRESENT: Patrick White, Assistant County Attorney Russell Webb, Principal Planner 1 eotr County UOC Industry/Public Training Sessions Agenda Thursday. August 26th (3:00 - 5:00) and Friday. August 27th 00:00 - 12:00) 1. General Introduction - Brief overview ofthe change. why it took place and how this will affect staffs review. 2. PowerPoint Presentation - Gail Easley (our consultant for the rewrite) presentation. The Power Point will consist of the following: a. Overview - general Introduction to the recodified LOC. b. Purpose - explanation of the need for the rewrite. c. Background - history of the LOC. d. Format and Structure - general layout of the LOC. e. General introduction to each Chapter. f. Benefits of the recodified LOC structure vs. the old LOC. g. Adoption date. 3. Errors/omissions in the recodification and the vehicle to handle them. 4. Appendix "H" - an extremely useful tool. 5. Question and Answer - Staffs comments/concerns/questions. 1) Introduction - Patrick White, ACA - Adoption date and municipal code. Review will be more efficient 4) Purpose of recodification 5) Commissioner Schiffer asked where provisions were relocated. - Explained that they were relocated to Code of Laws and eventually an Administrative Code 6) Commissioner Murray asked if Appendix "H" was in electronic version. - Yes. 7) Commissioner Strain asked about how we are going to deal with sections that are numerous pages so you know where you are in the document. - Patrick explained that the published version would have ears. 8) Format & Structure - Development cycle timeline 9) Chapter breakdown - Applying vs. interpreting regulations 10) Commissioner Schiffer asked about "County Manager or his designee" statement and whether the public would know who is the appropriate person. - Patrick explained that a more detailed description would be provided in Code of Laws. 11) Chapter 2 - Zoning Districts 12) Chapter 3 - Resource Protection 13) Chapter 4 - Dimensional Standards 14) Chapter 5 - Supplemental Standards 15) Chapter 6 - Infrastructure Improvement 16) Chapter 8 - Decision-Making Bodies 17) Chapter 9 - Variances, Nonconformities 18) Chapter 10 - Administrative & Decision-Making Procedures 2 - -..,-".--.--..--..-". 19) Benefits of UDC structure 20) Commissioner Strain asked about provisions in Code of Laws and how we amend them (the process). - Patrick said CCPC would not be involved in Code of Laws Amendment process, but could be. 21) Commissioner Abernathy asked for examples of provisions that were moved to Code of Laws. - One example was Division 3.6 (well construction). 22) Commissioner Strain asked about cycle 2 Amendments and how they would be implemented into LDC/UDC. - Patrick mentioned parallel cites, but that the amendments would be to UDC. 23) Commissioner Strain asked about electronic versions of supplements to UDC. - Informed that they would see them 24) Commissioner Strain and Commissioner Murray asked for a hard copy of presentation. 25) Ordinance (04-41) - Section Five (conflict and severability). Patrick explained the process of dealing with errors/omissions in the recodification. Talked about PUD's, 2nd cycle of amendments and process for unintended consequences. 26) Commissioner Schiffer asked whether there are any intended consequences of the recodification. - Patrick says a non-substantial change was all that was intended. 27) Commissioner Murray asked about errors/omissions in Administrative Code/Code of Laws provisions, as CCPC would no longer hear Code of Laws provIsIons. - Patrick says CCPC would still hear these.
