EXECUTIVE SUMMARY
Recommendation for the Community Redevelopment Agency (CRA) to approve and
execute a Commercial Building Improvement Grant Agreement between the CRA and a
Grant Applicant within the Bayshore Gateway Triangle area. (1712 Commercial Drive,
$50,000.00)
OBJECTIVE: To approve and execute a Commercial Building Improvement Grant Agreement
between the Community Redevelopment Agency (CRA) and a Grant Applicant within the
Bayshore Gateway Triangle Community Redevelopment area. (1712 Commercial Drive,
$50,000.00)
CONSIDERA TIONS: The purpose of the grant program is to provide an incentive to revitalize
the area by providing matching grant funds to encourage the private sector to upgrade/rehabilitate
commercial properties. The CRA provides a project cost-match of 50% from Tax Increment
Funds capped at $30,000 for exterior improvements and capped at $20,000 for interior
improvements (provided the exterior improvement's costs reach the cap amount). Remaining
project dollars are provided by the applicant. The CRA's COlmnercial Building Improvement
Grant Program is funded annually at a level that satisfies existing grant obligations from prior
fiscal years and funds future grant opportunities. For FYll, a total of$151,000 is budgeted for all
grant programs. From this allocation, 114,938 dollars are committed to date. This grant
application, if approved, would exceed the allocated TIF funds by $13,398; however, there is
$14,631.16 reserved in the TIF grant budget for contingencies such as this. If this award is
granted, there will be $642.16 remaining in the reserve fund.
The Commercial Building Improvement Grant application (Exhibit A) submitted by Charles
Hallberg, authorized agent of BE Home Realty, LLC, owner of the commercial property at 1712
Commercial Drive, Naples Florida, 34112, was recommended for approval by the
Bayshore/Gateway Triangle CRA Local Advisory Board.
LEGAL CONSIDERATIONS: This item requires a majority vote. It has been reviewed by the
County Attorney Office and is sufficient for Board consideration and approval. -STW
FISCAL IMPACT: Sufficient budget exists within Fund (187) FYl1 budget to satisfy this
application. This project totals $207,300.00, and the request is for up to $50,000.00 for exterior
and interior projects (with a 50% grantee match) for a total fiscal CRA impact of $50,000.00.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the CRA Board approves and authorizes the Chainnan to execute
the Commercial Building Improvement Grant Agreement between the Community
Redevelopment Agency and Charles Hallberg, authorized agent of BE Home Realty, LLC, owner
of the commercial propeliy at 1712 Commercial Drive, Naples Florida, 34112 in the amount of
$50,000.00.

WHEREAS, in Collier County Ordinance No. 2002-38, the Board of County
Commissioners delegated authority to the CRA to award and administer CRA grants including
contracts with Grantees for CRA grants; and
WHEREAS, Ordinance No. 08-61 established the Commercial Building Improvement
Grant; and
WHEREAS, Grantee has applied for a Commercial Building Improvement Grant in the

WHEREAS, the CRA has determined that Grantee meets the eligibility requirements and
was approved for a grant award in the amount of ,~, (.:," c dollars on

NOW, THEREFORE, in consideration of the mutual covenants contained herein and
other valuable consideration, the parties agree as follows:
1. Grantee acknowledges to the CRA that Grantee has received a copy of the Collier
County Community Redevelopment Agency Commercial Building Improvement Grant Program
Information and Application (hereinafter referred to as "Grant Program"), that Grantee has read
the Grant Program, and that Grantee has had ample opportunity to discuss the Grant Program
with Grantee's counsel or advisor. Grantee further acknowledges to the CRA that Grantee
understands and agrees to abide by all of the terms and conditions of the Grant Program. Grantee
agrees to the terms and conditions of the Grant Program.
2. Grantee IS the record owner / tenant of property described as

3. Grantee has agreed to make certain improvements to the property pursuant to the

Exhibit A and incorporated herein by reference.
4. Grantee agrees to complete the construction of the commercial building
improvements within one (1) year ofCRA Approval. Grantee also agrees to fund at least 50% of
the costs of the commercial building improvements. Grantee is prohibited from paying

contractors and/or vendors with cash. All payments for approved projects must be in the form of
a check or credit card drawing on funds from Grantee's accounts.

5. The CRA has approved a grant to Grantee in the amount of!' ~;( i (:," t C to
be administered pursuant to the terms of this Agreement based on an estimated cost of
zi;zc.. '7. :"c [ . If the actual costs are less than $ tU, t{t to construct the improvements, the
grant amount shall be reduced dollar for dollar in CRA funds as determined by ratio of matching
private funds required.
6. Unless prior disclosure is included in the grant application, no Grantee, or any
immediate relative of Grantee, shall serve as a contractor or subcontractor for the construction of
the improvements and no Grantee, or any immediate relative of Grantee, shall receive
compensation for labor for the construction of the improvements. An immediate relative of
Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or
family member by marriage to include mother-in-law, father-in-law, brother-in-law and sister-in-
law. Grantee has verified that all contractors who have provided bids for the approved work are
actively licensed by Collier County. Grantee acknowledges that the total grant award shall not
exceed the sum of lowest bids/price quotes for all projects. Grant funds for work perfOlmed by
contractors shall only be disbursed upon verification that said contractors are actively licensed by
Collier County.
7. Grantee agrees to obtain all necessary permits and submit any required plans to
the County's Growth Management Division. Upon completion of the work, Grantee shall
submit to the CRA. staff a Project Summary Report, two (2) 8 inch by 10 inch photos showing
the improvements, a list of materials and construction techniques used, a list of architects and/or
contractors, and any other information specific to the project or requested by the CRA staff.
The CRA, through its staff, shall confirm that the Commercial Building Improvements were
constructed pursuant to the telms of the application approved by the CRA.
8. Within forty-five (45) days after confirmation that the improvements were
constructed pursuant to the terms of the approved application, the Grantee shall be issued a check
in the amount of the grant. However, if the Grantee fails to make the improvements pursuant to
the tenns of the approved application, or if the improvements are not completed within one (1)
year of CRA approval, , the grant shall be deemed revoked and Grantee shall not be entitled to
funding.
9. This Agreement shall be govemed and construed pursuant to the laws of the State
of Florida.
10. This Agreement contains the entire agreement of the parties and their
representatives and agents, and incorporates all prior understandings, whether oral or 'written.
No change, modification or amendment, or any representation, promise or condition, or any
waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized
officer of the patty to be charged.
11. This Agreement is personal to Grantee, and may not be assigned or transfen'ed by
Grantee or to Grantee's respective heirs, personal representatives, successors or assigns without
the prior written consent of the CRA.

Description of Existine: Conditions of the site:
This older poorly maintained building has an outdated fa~ade, cracked plaster, and
deterioration both exterior and interior. The interior and exterior of the building does not meet
current county life and safety and fire code compliance. Current conditions include: Leaking
roof which has caused damage and rust throughout the walls and ceiling, gutters and rain
management systems are in disrepair, unsafe/old windows, handicap entrance not in
compliance with current county safety codes, front and rear parking lot need repair/repaving,
striping and curbs, Needs exterior fa~ade repair for functional and community beautification
purposes, structural, safety and beautification railings needed.
Interior requires completed demolition and renovation for occupancy use and property
compliance to meet current county building and fire codes.
Existing carpet has experienced damage from water due to leaking roof. Black mold prevalent,
very bad smell and a health safety issue. Drop ceiling has water damage, old electrical wiring
needs repair, bathrooms in need of repair: leaking drains, broken toilets, water damaged
drywall, A/C in need of repair,
Outline of proposed improvements:
Interior demolition of all content down to 4 bare walls ceiling to floor.
Build out to include: 8 offices, 1 conference room, 3 restrooms, kitchenette, 2800 sq ft
reception area, open office area, Large main warehouse: three 1,000 sq foot work areas, 5000
sq foot general warehouse storage
Upgrade and repair air conditioning units
Complete electrical, telephone, and fire detector upgrade and repairs
New plumbing in lavatories
New store front windows
Re-model front entrance with stone/brick mosaic decorative fa~ade
Top coat and stripe parking areas with new refurbished colored parking stops
Repair and replace external wall panels and stucco areas as needed
Remove and replace all gutters and rain control systems
Replace the existing decayed wood entry decks with concrete egress plat forms

D. Designer shall be entitled to rely on the accuracy and completeness of all infonnation,
surveys, reports or any other documentation provided by the Owner or the Owner's
Consultants. The Ow"ner shall be responsible for the expense of any additional work
required by the Designer to correct or modify tlle construction documents because of
inaccurate information.
E. The Ovmer shall give prompt 'written notice to the Designer if the Owner becomes aware of
any fault or defect in the project or nonconfOnllatlCe ",rith tlle contract documents.
Reimbursable EXDenses
Cost for duplication, printing, plotting, postage and telephone shall be in addition to the fee listed in the
agreement and shall be paid by the Client at the rate of one and fmoen one hundredth times the cost
incuned by McHanis Planning and Design for the work Mileage will be billed at $0.51 per mile. Net-
billed amounts are due and payable within 30 days oftlle TITst billing date. Finance charges will be
computed at a rate 1-1/2% per month yielding an annual rate of 18%.
