EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney’s Office to participate and represent the Collier
County Canvassing Board during the 2018 Election Cycle.
OBJECTIVE: To obtain authorization from the Board of County Commissioners for th e County
Attorney’s Office to participate and represent the Collier County Canvassing Board during the 2018
Primary and General Elections.
CONSIDERATIONS: Florida Statutes §102.141 describes the composition of the County Canvassing
Board; and as approved and agreed upon, the following members comprise the 2018 Collier County
Canvassing Board: Judge Robert L. Crown, Chairman; Judge Michael J. Provost, alternate to the
Chairman; Commissioner William L. McDaniel, Jr.; Commissioner Burt L. Saunders, alternate; and
Jennifer J. Edwards, Supervisor of Elections.
As in the past, it has been strongly recommended by the Florida State Association of Supervisors of
Elections and the Florida Division of Elections that each Canvassing Board secures legal counsel who is
familiar with case law, election statutes, public records laws, etc. The Supervisor of Elections Office,
once again, requests that the County Attorney’s Office provide such counsel for the Collier County
Canvassing Board during the 2018 Primary and General Elections and seeks authorization from the Board
of County Commissioners to utilize its attorneys.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney,
and was made at my request. The County Attorney’s Office has historically participated and represented
the Collier County Canvassing Board during the election cycle, a practice I continued when I became
County Attorney. Although we have always enjoyed working with the Supervisor of Elections and her
excellent staff in representing the Canvassing Board, the representation technically falls outside the scope
of my employment contract with the Board (although by statute a Commissioner is a member of the
Canvassing Board, the Canvassing Board does not fall amongst the County Commission’s boards or
committees). This was not an issue with the old Board in place, as in my view there was an expectation at
that time from the Commissioners that we would be present at Canvassing Board meetings. With a
largely new Board in place, I thought it an appropriate time to allow the Board to determine whether it
wishes this Office to continue this practice. This item requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners authorizes the County Attorney’s
Office to participate and represent the Collier County Canvassing Board during the 2018 Primary and
General Elections.
