EXECUTIVE SUMMARY
Recommendation to accept the FY2018 State Aid to Libraries Grant funding in the amount of
$237,496 and authorize the necessary Budget Amendments.
OBJECTIVE: To carryout to the FY2018 State Aid to Libraries Grant Program and appropriate funding
in the amount of $237,496.
CONSIDERATIONS: The Board of County Commissioners (Board) approved the application for State
Aid to the Libraries Grant Program at their regular meeting on September 26, 2017 (Agenda Item 16D28).
The Florida Department of State, Division of Library and Information Services awarded Collier County
Public Library an amount of $237,496.
These grant funds can be used for any public library need except for building construction. Funds will be
used to purchase library materials, services, equipment, and other library needs, such as the hiring of
temporary personnel to provide direct services to our library customers.
FISCAL IMPACT: A Budget Amendment is required to recognize grant revenue in the amount of
$237,496 Public Services Grant Fund (709), Project 33564. This grant does not require a matching
amount.
LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this
action.
RECOMMENDATION: To accept the FY2018 State Aid to Libraries Grant award in the amount of
$237,496 and authorize the necessary Budget Amendments within Public Services Grant Fund (709),
Project 33564.

The Grantee has submitted an application and has met all eligibility requirerrenB and has been awarded
a State Aid to Libraries Grant (CSFA 45.030) by the Division in the amormt specified on the "Fiscal
Year 2017-18 State Aid to Libraries Final Grants" docurnent (which is incorporated as part ofthis
Agreerrent and entitlsd Attachment B). The Division has the authority to administer this gant in
accordance with S eclion25/ , Florida Statutes. By reference, the applioation and any approved revisions
are hereby mde a part of this agrsement.
In consideration ofthe muhul covenants and promises conbined herein, tre parties agree as follows:
L Grant Purpose.This grant shall be used exclusively for the "State Aid to Libraries Grant" the
public purpose for which these fi:nds were appropriated.
a. The Grantee shall perform the following Scope of Work as identified in Secti on257.17,

Manage or coordinate fiee library service to the residents of its legal service area. The
Grantee shall:
1. Have a single adminishative head eryloyed firll time by the library's goveming body;
2. Provide free library service, including loaning materials available for circulation free of
charge and providing reference and information services Aee ofcbarge;
3. Provide access to mate als, information and services for all residents of the area served;
and
4. Have at least one library, branch library or member library open 40 hours or more each
week
b. The Grantee agroes to provide tho following Deliverables related to the Soopo of Work for
payrnents to be awarded,

r Payment will be a fixed price in the arpunt of 100% of the grant award. The Grantee will:
o Adopt or approve crrrrent year library budget;
o Have at least one library, branch library or member library open 40 hours or more
each week (excluding holidays) during the grantee's fiscal year; and

2. Length of Agreement. This Agreement shall begin the date the agreement is signed by both the
Grantee's Governing Body and $e Division and continue rmtil all gant fi.urds have been expended,
unless terminated in accordance with the provisions ofSection 28 ofthis Agreemeul
3. Expenditure of Grant trfunds. The Grantee cannot obligate or eryend any grant finds before the
Agreement has been signod by all parties, No costs incurred after termination ofthe Ageemsnt shall
be allowed uriless specifically authorized by the Division.
4. Contract Admlnlstration. The parties are legally bourd by the requirernents ofthis agreemenL Each
party's contract Danager, named below, will be responsible for monitoring its performance under
this Agreenrnt and will be the official contact for each party. Any notice(s) or other
conrnmications in regard to this agreement shall be dirocted to or delivered to the other party's
oontract rnanager by utilizing the information below. Any change in the contact information below

7. Florida Substitute Form W-9. A corpleted Substitr:te Form W-9 is required ftom any entity that
receives a payment from the State ofFlorida that may be subject to 1099 reporting. The Departrrnt
ofFinancial Services (DFS) m:st have the conect Taxpayer Identification Nut6er (11N) and other
related infonnation in order to report accuate tax information to the Intemal Revenue Service

8. Financial Consequences. The Departrnent shall apply the following financial consequences for
failure to perform the minimum level of services required by this Ageenrnt in accordance with
Sections 2 I 5.97 I arfr 287 .0 58, F I o rida St atu t es :

9. Credit Line(s) to Acknowledge Grant Ftrnding. The Division requires public acknowledgornent of
State Aid to Libraries Grant fi.rnding for activities and publications supported by grant fmds. Any
announcernenb, infonnation, press releases, publications, brochures, videos, web pages, programs,
etc. created as part ofa Shte Aid to Libraries Grant projeot must include an acknowledgurnt that
State Aid to Libraries Grant firnds were used to create them

10. Norallowable Grant Expenditures. The Grantee agrees to elpend all grant fimds received undor
this agreement solely for the ptnposes for whioh they wore authorized and appropriated.
Expenditures shall be in compliance with the state guidelines for allowable project costs as outlinod
in the Departnent ofFinancial Services' Reference Guide for State Expenditr:res (incorporated by
reference), which are available online at myfloridacfo.corn/aadir/reGrence_guide.
Grant fimds may not be used for the puchase or construction ofa library building or library quarters
1 I . Travel Expenses. The Subgrantee must pay any Bavel expenses, from gant or local matching firnds,
in accordance to the provisions of Section 112.061, Florida Statutes
12. Unobligated and Unearned tr\rnds and Allowable Costs. In accordance with Section 215.971,
Florida Statutes, the Grantee shall refirnd to the State ofFlorida any balance ofunobligated fimds
which has been advanced or paid to the Grantee. In additioq fimds paid in excess of the amount to
which the recipient is entitled under the tenns and conditiors ofthe ageernent nnrst be refimded to
the state agency. Frnther, the recipient may expend fimds only for allowable costs resultiog from
obligations incr:rred during the specified ageement period. Expenditr:res ofstate financial
assistance must be in compliance with the laws, rules and regulations applicable to expenditues of

13. Repaynrcnt. All refirnds or repaynents to be rnade to the Doparbrpnt rmder this agreemeot are to be
made payable to the order of "Departnent ofstate" and nrailed directly to the following address:

Services, 500 Sou*r Bronouglr Street, Mail Station #9D, Tallahassee, FL32399.In accordance with
Section 215.34(2), Florida Statutes, ifa check or other draft is returned to the Departuent for
collection, Recipient shall pay to the Departrrnt a service fee of$15.00 or five percent (5%) ofthe
face arror:nt of the retr:rned check or draft, whichever is greator.
14. Single Audit AcL Each gantee, other than a grantee that is a State agency, shall submit to an audit
pursuant to Section 215.97, F/ orida Statutes. See Attrchment A for additional information regarding
this requirernenl If a Grantee is not required by law to conduct an audit in accordance with the
Florida Single Audit Act because it did not elpend at least $750,000 in state financial assistance, it
must sr:bmit a Financial Report on its operations pursuant to Section 257.41 (3), Florida Statutes
within nine months ofthe close of is fiscal year.
15. Retention of Accounting Records, Financial reoords, supporting doowrrnts, statistioal records and
all other records, including electronic storage uredia pertinent to the Projec! shall be retained for a
period offive (5) fiscal years after the close out oftlrc grant and release ofthe audit. If any litigation
or audit is initiated or claim made before the expiration of the five-year period, the records shall be
retained for five fiscal years after the litigation, audit or claimhas been resolved.
t 6. Obligation to Provide State Access to Grant Records, The Grantee mrst male all grant records
ofexpendih:res, copies ofreports, books, and related docurnentation available to ttre Division or a
duly authorized representative ofthe State ofFlorida for inspection at reasonable tinps for the
purpose ofmaking audits, examirntions, excerpts and aanscripts.
17. Obligation to Provide Public Access to Grant Records, The Division reserves fire rigbt to
unilaterally cancel this Agreement io the event ttrat the Grantee refises public access to all
docr:rnents or other n:aterials made or received by the Grantee that are subject to the provisions of
Cfuptet 119, Florida Statutes, known as the Florida Public Records Act. The Grantee must

18. Noncorryliance. Any Grantee that is not following Florida Stantes or rules, the terms of fte grant
agreernen! Florida Doparhnont of State policies and grridance, local policies, or other applicable
law or that has not submitted roquired reports or satisfied other administative requirerents for
other Division oflibrary and Infonnation Ssrvices gran6 or grants tom any other Office of
Cultural, Historical, and Infornration Programs (OCHIP) Division will be in nonconpliance stafirs
and subject to the OCHIP Granb Cornpliance Procedure. OCHIP Divisious include the Division of
Cultural Affairs, tho Division ofHistorical Resoruces, and the Division oflibrary and Ioformation
Services. Grant compliance issues must be resolved before a grant award ageemeut rnay be
executed and before grant paynrents for any OCHIP grant rnay be released.

19. Accormting Requirements. The Grantee must maintaiu an accounting system tbat provides a
couplete record ofthe use ofall grant flmds as follows:

b) Accounting records must adequately identify the sources and application offirnds for all gant
activities and must classi! and ideutiry grant funds by using ihe same budget categories that were

arnounts shown in the Grantoo's accounting records to those amormb reported to the Division;
c) An interost-bearing chooking account or accormts in a state or federally chartored institution may
be used for reveuues and expenses described in the Scope of Work and detailed in the Estimated
Project Budget;
d) The name ofthe accorm(s) must include tlrc grant award nurnber;
e) The Grantee's accounting records must have effective conaol over and accountability for all
fi:nds, properly and other assets; and
f) Accounting records must be slpported by sowce docwntation and be in sufrcient detail to
allow for a proper pre-audit and post-audit (such as invoices, bills and canceled checks)'
20. Availabllity of State [\nds. The State ofFlorida's performauoo and obligatioo to pay under this
Agreement are contingent upon an anmral appropriation by tho Florida Irgislatr:ro, In the event that
tre state fimds rpon which this Agreement is dependent are withdrawn, this Ag'eernent will be
automatically terminaGd and the Division sball have no fiirtler liability to the Grantee beyond those
amomts already expendod prior to the termination date. Srrch termination will not afect the
responsibility of the Grantee under this Agreement as to those fi:nds previously distibuted. In the
event of a state revenue shortfall, the total grad @y be reduced aooorditrgly'
21. Lobbying, The Subgrantee will not uso ary grant fimds for lobbying the sbte legislature, the state
judicial branch or any state agency.
22. Independent Contractor Status of Grantee. The Grantee, ifnot a state ageDcy, agrees that its
officers, agents and employees, in porforrrance ofthis Agreemen! shall act in lhe capacity of
indopendent contaotors and Dot as officers, agents or eryloyees of the state. The Grantee is not
ontitled to accrue any benefits ofstate erryloymont, including retiremont benefits aud any otrr riglts
or privilegos oonneoted with erryloyrrnt by tlre State of Florida.
23. Grantee's Subcontractors, The Grantee shall be respoosible for all work performed and all
experules incr:rred in connection with this Agreement. The Crantee my subconaact, as rccessary, to
perform the services and to provide cormrodities required by this Agreenent. The Division shall
notbe liable to any subcontactor(s) for any expenses or liabilities inourred under the Grantee's
subcontac(s), and the Grantee shall be solely liablo to ib subcontractor(s) for all oxponses and
liabilities incurred under its subconrac(s), The Crantee must take the neoessary steps to ensure that
each ofits subcontactors will be deemed to be independent conhactors and will not be considered
or permitted to be agents, servants, joint venhners or partters ofthe Division

24. Liability, The Division will not assume any liability for 6e ac6, omissions to act or negligence of
the Grantee, its agens, servants or erryloyees; nor rnay the Grantee exclude liability for its own
acts, omissions to act or negligence to the Division.
a) The Grantee shall be responsible for clairm of any nature, including but not limited to injury,
death and property damage arising out ofactivities related to this Agreement by the Grantee, its
agents, sewants, enrployees and subcontactors. The Grantee shall iudernrift and hold the Divisiou
harmless Aom any and all clairns ofany naturs ard shall investigate all suoh claims at its own
expense. Ifthe Grantee is governed by Sectiot768.28, Florida Statutes, it shall only be obligated
in accordance with this Section
b) Neither the state nor any agency or subdivision ofthe state waives any defense ofsovereign
imrnmity or increases the limits of its liability by entering into this Agreement.
c) The Division shall not be liable for attomey fees, interes! late charges or service fees, ot cost of
collection related to this Agreement
d) The Grantee shall be responsible for all work performed and all expenses incwred in comection
wittr the projeot. The Grantee may subconhact as necessary to perform the services set forth in this
Ageemen! iucluding entoring into subcontacE with vendors for services and comodities,
providod that such subcontact has been approved in writing by the Deparfrnent pdor to its execution
and provided that it is understood by the Grantee that the Deparhent shall rct be liable to the
subcontactor for any expenses or liabilities incurred under the subcontact ard that the Grantee
shall be solely liable to the subcontactor for all eryenses and liabilities incurred under the
suboontact.
25. Strict Corpliarrce with Laws. The Grantee shall porform all acts required by this Agreenent in
saiot conformity with all applicable laws and regulations ofthe local, state and federal law. For
consequences of nonconpliance, see Section 1 8, Noncorplianoo,
26. No Discrimination The Grantee may not discriminate against any errployee erryloyed rurder this
Agreement or agairst any applicant for enploynrent beoause ofrace, color, religio4 gender,
national origiq age, handicap, pregnancy or rnarital status. The Grantee sball insert a similar
provision in all of ib subcontacts for services under this Agreemenl
27. Breach of Agreement. The Division will demand the rehrrn of gant fnds already received, will
withhold subsequent payments and/or will terminate this agreement ifthe Grantee irproperly
expends and mauages grant frmds; fails to prepare, preserve or surrender records required by this
Agreenrent; or otherwise violates this Ageenent.

28. Terrdnation of Agreenrent. The Division will termiDate or end this Ageement if the Grantee fails
to firlfill its obligafrors herein In suoh eveut, the Division will provide tlre Grantee a notice of ib
violation by le6Jr and shall give the Grantee fifteen (15) calendar days from the date ofreceipt to
clre its violation. If the violation is not cwed within the stated period, the Division will termiDate
this Agreement The notice ofviolation letter shall be delivered to the Grantee's Contact Manager,
persoially, or rnailed to his/her speoified address by a mothod ttrat provides proofofroceipt. In the
Lvent that the Division terminates this Agreerent, the Grantoo will be corrpensated for any work
completed in accordance with this Agreenrcnt prior to the notification of termination if the Division
deerns this reasonable under the cLcumstances. Grant firnds previowly advanced and uot expended
on work conpleted in accordance with this Ageement shall be returned to the Division, with
interes! within thirty (30) days after termination ofthis Agreement The Division does not waive
any ofits rigtrs to additional darnages if grant fi.rnds are returned under this Section
29. Preservation of Remedies. No delay or omission to exercise any rigfut, power or rernedy accruing
to either party upon breach or violation by eitler parly rnder this Agreement shall inpair any srch
rigfrt, power or renedy of either parq4 nor shall such delay or omission be construed as a waiver of
any such breach or default or any similar breach or default.
30. NorrAssignnrent of Agreerrent. The Grantee may not assign, sublicense or othorwise trarsfer i6
righb, duties or obligations under this Agreement without the prior written consent ofthe Divisio4
which shall not rmeasonably be withheld. The agreement tansferee m$t derronstate corpliauce
with the requirements ofthe projecL Ifthe Division approves a tansfer ofthe Grantee's obligatioos,
the Grantee shall remain liable for all work performed and all expenses incurred in connection with
this Agreeurent. In the event the Lrgislan:re trarsfers the rights, duties and obligations ofthe
Division to another governmental entity, pursuant to Section 20.06, Fio rida Statutes or otherwise,
the rights, duties and obligations under this Agreernent shall be tansferred to dle succeeding
governrnental agency as ifit was the original party to this Agreement.
31. Requined Procuremut Procedures for Obtaining Goods and Sewices. The Grantee shall
provide maximum open competition when procuring goods and sorvices related to the grant-assisted
project in accordance with Section 287 .057, Florida Statutes.
a) Procurement ofGoods aud Services Not Exceeding $35,000. The Gmntee tralst use the applicable
procwenrnt method described below:
1, Purchases Up to $2,500: Procurerrent of goods and services where individual purchases do not
exceed $2,500 do not require conpetition and may be conducted at the Grantee's discrotion.
2. Purchases or Contact Amounts Between $2,500 and $35,000: Goods and services costing
between $2,500 and $35,000 require informal cornpetition and nray be procwod by purcbase
order, acceptance ofvsndor proposals or other appropriate Procwement document.
b) Procurement ofGoods and Services Exceeding $35,000. Goods and services costing over

AUDTT REQUREWNTS
The administation of resources awarded by the Deparbrcnt of State to the Grantee nray be subject to
audits and/or monitoring by fire Departneut of State as described in this Addendum to fts Craut Award
Agreement,
MONITORING
In addition to reviews of audits conducted in accordance with 2 CFR 200.501 Section 2L5.97 , Florida
Statutes, monitoring procedures may include, but not be limited to, on-site visits by Deparhnent of State
stafi, limited scope audits as defined by 2 CFR 2 5200.425, and/or other procednres. By entering into this
agreemenl the recipient agroes to comply and cooperate with any monitoring procedwes/prgcesses
deemed appropriate by tlre Departnent of State. In the event the Deparh:ent of State determines that a
limited scope audit of the recipient is appropriate, the recipient agrees to conplywith any additional
instructions provided by the Department of State staffto the recipient regarding such audit. The recipient
firther hgrees to comply and cooperate with any inspectionq, reviews, investigations, or audits deemed
necessary by the Chief Financial Officer or Auditor General.
AUDTTS
PART I: FEDERALLY F.UNDED:
This part is applicable if the recipient is a State or local goverment or a non-profit organization as
defined in 2 CFR 200.90, 200.64 &,200.70 as revised.
1. In the event that fte recipieut expends $750,000 for fiscal years ending after Decernber 31, 2014 or
more &;ring the non-Federal entity's fiscal year in Federal awards in is fiscal year, the recipient
must have a single or program-specific audit conducted in accordance with the provisions of 2CFR
200.501. Exhibit I to this agreement indicates Federal resources awarded through the Deparfi::ent of
State. The determination of amounts of Federal awards expended should be in accordance wittr the
guidelines established by 2 CFR 200.502. An audit of the recipient conducted bythe Auditor
General in accordance with ttre provisions of 2 CFR 200.514, as revised, will meet the requirement
of this part.
2. In connection with the audit requirements addressed in Part I, paragraph l, the recipient shall firlfill
the requirements relative to auditee responsibilities as provided in 2 CFR 200.508.
3. If the recipient expends less than S750,000 for fiscal years ending after December 31, 2014 in
Federal awards in its fiscal year, an audit conducted in accordance with the provisions of 2 CFR
200.501 is not required. In the event that the recipient expends less than S750,000 for fiscal years
ending after December 31, 2014 inFederal awards in its fiscal year and elects to have an audit
conducted in accordance with the provisious of 2 CFR 200.501, the cost of the audit must be paid
fromnon-Federal resources (i.e., the cost ofsuch an audit mustbe piid fromrecipientresources
obtained from other than Federal entities). (d) Exerrption when Federal awards expended are less

Division of Library and lnforlna{ion Services staff have reviewed the Fiscal Year 2017-l 8 State Aid to
Libraries grant application submitted by your library. I am pleased to inform you that your library has met
all of the requirements of Rule 1B-2.011, Florida Administrative Code.
Grant funds will be paid in one payment, which was requested upon execution ofthe grant agreement.
A copy of the executed grant agreement and a Notification of Grant Award are enclosed. Also enclosed is
a list of the grants that libraries will receive during FY20l7-18.
Please be advised, per revised Department ofState policies, the Division will be performing desk audits
or reviews ofactive gants with the Division. Each year, 20olo ofthe active grants in the State Aid to
Libraries grant program will be selected for this review. If your grant is selected for review, you will be
notified ofthe review and of any additional information that may be needed as a part ofthe review.
