EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve for
recording the amended final plat of Vanderbilt Reserve, (Application Number PL20180000356)
approval of the standard form Construction and Maintenance Agreement and approval of the
amount of the performance security.

OBJECTIVE: To have the Board of County Commissioners (Board) approve for recording the amended
final plat of Vanderbilt Reserve, a subdivision of lands located in Section 34, Township 48 South, Range
26 East, Collier County, Florida, following the alternative procedure for approval of subdivision plats
pursuant to Resolution 99-199. This procedure allows for the Board to approve the amended plat and
associated construction documents for construction purposes and recording purposes concurrently.
CONSIDERATIONS: On February 13, 2018, the Board approved the final subdivision plat for
Vanderbilt Reserve PL20160000157. The developer has subsequently relocated the project entrance and
adjusted the Clubhouse site, necessitating this additional approval by the Board. According to Section
10.02.04 B.5.b of the Land Development Code, following approval by the Board of the final subdivision
plat, but prior to recordation, the Board may approve amendments to the final subdivision plat.
The Development Review Division of the Growth Management Department has completed the review of
the construction drawings, specifications, and amended final plat of Vanderbilt Reserve. These
documents are in compliance with the County Land Development Code and Chapter 177, Florida
Statutes. This project is within the Wolfe Creek PUD, Ordinance No. 13-37, as amended. All fees have
been paid.
Security in the amount of 10% of the total cost of the required improvements associated with this
amended final plat, and 100% of the cost of any remaining improvements, together with a Construction
and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the
County Manager or his designee and the County Attorney’s office prior to the recording of the amended
final plat. This procedure is in conformance with Section 10.02.04 F.2 of the Land Development Code.
The Development Review Division recommends that the amended final plat of Vanderbilt Reserve be
approved for recording.
FISCAL IMPACT: The project cost associated with this amended final plat is $1,885,218.20
(estimated) to be borne by the developer. This amount represents the cost associated with the originally
approved plat and the costs associated with the proposed changes to the plat (See attached PPL and PPLA
opinions of probable cost).
The cost breakdown is as follows:
a) Water & Sewer $ 583,354.00
b) Drainage, Paving, Grading $1,301,864.20
The Security amount, equal to 110% of the project revision cost, is $2,073,740.02
The County will realize revenues as follows:

Revenue generated by this project: Total: $57,716.55

The Fees are based on a construction estimate of $1,885,218.20 and were paid in June 2016 (for the
original plat application) and February 2018 (for the amended plat application).
The breakdown is as follows:
a) Plat Review Fee ($1,000.00 + $5./ac) $ 1,160.00

GROWTH MANAGEMENT IMPACT: The developer must receive a Certificate of Adequate Public
Facilities (COA) prior to the issuance of the construction plan final approval letter and plat recordation,
except when the applicant elects to delay obtaining a COA for non-residential developments that are
required to obtain approval of a site development plan prior to the issuance of a building permit.
LEGAL CONSIDERATIONS: The applicant is requesting approval of the amended final subdivision
plat and construction and maintenance agreement. The Board shall consider the County Manager or
designee’s recommendation and shall take evidence and testimony in regard to the final subdivision plat
requirements identified in LDC sections 10.02.04 B, 10.02.04 C, and other provisions of the LDC, as well
as Chapter 177, Florida Statutes. If the Board denies or places conditions on the amended final
subdivision plat, it shall state reasons for such denial or conditions.
The original final subdivision plat was approved by the Board on February 13, 2018. In accordance with
the LDC, the applicant is required to submit the final subdivision plat to the County Manager or designee
for recording within 18 months of the date of approval of the final subdivision plat by the Board.
However, following approval by the Board, but prior to recordation, the County Manager or designee may
approve minor insubstantial changes to the final subdivision plat, and the Board may approve any changes
that are not minor and insubstantial. The applicant’s proposed changes to the ori ginally approved final
subdivision plat are not considered minor and insubstantial, and therefore this amended final subdivision
plat requires Board approval.
This item has been approved as to form and legality, and requires a majority vote for Board approval -

RECOMMENDATION: To endorse staff’s recommendation to approve the amended final plat of
Vanderbilt Reserve (Application Number PL20180000356) for recording with the following stipulations:
1. Approve the amount of $2,073,740.02 as the performance security for the required improvements
associated with this amended plat; or such lesser amount based on work completed, and as is
approved by the Growth Management Department.
2. Approve the standard form Construction and Maintenance Agreement and direct the County Manager
or his designee:
a. To withhold Certificates of Occupancy until the required improvements have received
preliminary acceptance.

b. To delay recording of the amended plat until suitable security and an appropriate Construction
and Maintenance Agreement is approved and accepted by the County Attorney’s office and the
Board of County Commissioners or the County Manager or his designee on behalf of the Board
pursuant to Section 10.02.04 F.2 of the Land Development Code.
