AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE . _---
O. 88-26 , BY REVISING AND ADDING DEFINITIONS
UNDER SECTION 4 DEFINITIONS WHICH REVISE THE

WHEREAS, Collier County Ordinance No. 88-26 was created to
regulate excavations within Collier County, Florida; and
WHEREAS, the creation of the Development Services Department
administratively modifies the authority for decision making with
respect to Ordinance No. 88-26 ; and
WHEREAS, the Development Services Department and the County
Engineer ' s roles in the administration of the Excavation
Ordinance must be clearly defined.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE:
Section 4, paragraph D of Collier County Ordinance No. 88-26
is hereby amended to read as follows:
D. "Director" shall mean the Biyeeter-es-the-Eea.2-4---Eeunty

and-ander-the-deiegatea-authexit *-ef-the-Eeunty
Engineer-and-the-Beard- County Manager or his designee.
SECTION TWO:
Section 4 of the Collier County Ordinance No. 88-26 is
hereby amended to add Paragraph G which shall read as follows :
G. "County Engineer" shall mean the County Engineer of
Collier County or his duly authorized representative.
SECTION THREE: Conflict and Severability
In the event this ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of the
ordinance is held invalid or unconstitutional by any court of
• competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.

SECTION FOUR: Effective Date ` 1 ' _
This ordinance shall become effective upon : ecep ,.of:-..notice
from the Secretary of State that this ordinance has been filed
with the Secretary of State.
PASSED AND DULY ADOPTED by the Board of County Commissioners
of Collier County, Florida this 13th day of December , 1988 .
