EXECUTIVE SUMMARY
Recommendation to approve an amendment to the Developer Agreement with Habitat for
Humanity of Collier County, Inc. for the Neighborhood Stabilization Program 3 (NSP3) to reflect
updates to the US Census Tracts.
OBJECTIVE: Make minor administrative changes to reflect updated census tract target areas in the
developer agreement.
CONSIDERATIONS: On December 13, 2011, Agenda Item No. 10. A., the Board of County
Commissioners (Board) approved an NSP exit strategy and associated implementation actions with the
purpose of extricating the County from daily operations of the Neighborhood Stabilization Program. On
April 24, 2012, Agenda Item No. 11. B., the Board approved a Developer Agreement with Habitat for
Humanity to acquire property with the goal of Habitat using private funds to rehabilitate and resell the
properties.
On February 28, 2012, Agenda Item No 16. D. 6., the Board approved a County developed Action Plan
that was sent to the Department of Housing and Urban Development (HUD), with regard to the
implementation of the NSP3 program. Within the Action Plan, the County identified target areas as
"Areas of Greatest Need" in which to carry out programmatic activities and to reflect all planned
activities.
It was originally determined that the eligible census tracts targeted would fall under Tracts 104.09;
110—N 104.10; 104.11; and 107.01. As a result of population shifts during the most recent decennial census, the
census tract designated as 104.09 split into two completely new census tracts, 104.19 and 104.20. This
split dissolved the original census tract of 104.09, yet retained the same external boundary. HUD has
determined through email that the County is not required to update the Action Plan with the revised
census tract designations, so long as the stated activities will remain within the same census tract
boundaries that were originally designated. However, it is necessary to amend the NSP3 Developer
Agreement to reflect the newly created census tract numbers. This item is solely for that purpose.
FISCAL IMPACT: There is no fiscal impact. NSP3 funds are located in Housing Grants Fund (705),
Project 33150.
LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote for Board
action. - JBW
GROWTH MANAGEMENT IMPACT: The Neighborhood Stabilization Program facilitates the goals,
objectives and policies set forth in the Housing Element of the Growth Management Plan.
RECOMMENDATION: To approve and authorize the Chairman to sign an amendment to the NSP3
Developer Agreement with Habitat for Humanity of Collier County, Inc.

THIS AMENDMENT, made and entered into on this ` day of December 2012, to the
subject agreement shall be by and between the parties to the original Agreement, Habitat
for Humanity of Collier County, Inc, EIN 59- 1834379, (d /b /a/ Habitat for Humanity),
authorized to do business in the State of Florida, whose business address is 11145
Tamiami Trail E Naples FL 34113, (hereinafter called the "Developer ") and Collier
County, a political subdivision of the State of Florida, Collier County, Naples (hereinafter
called the "County ").

A. GENERAL
Developer will be provided NSP -3 funds in the amount of Three Million Four
Hundred Ninety Five Thousand Seven Hundred Forty Nine and 00 /100 Dollars
($3,495,749). Such funds will be used to acquire and land bank eligible properties in
the Grantees eligible target areas and to pay associated developer fees,

Properties shall only be acquired in the target areas approved by the GRANTEE and
described in the GRANTEE's NSP -3 action plan. Specifically, DEVELOPER may
