EXECUTIVE SUMMARY
Recommendation to approve an after- the -fact amendment between Collier County and the Area
Agency on Aging for Southwest Florida, Inc. d/b/a Senior Choices of Southwest Florida to reflect
additional grant funding in the amount of $544 for the Nutritional Services Incentive Program
(NSI P) and authorize the Chairman of the Board to authorize the necessary Budget Amendment.
OBJECTIVE: To provide additional meals to the elderly in our community.
CONSIDERATIONS: In January 2008, the Housing and Human Services Department, Services for
Seniors program, received approval from the Board to begin administering the Senior Nutrition Program.
The program in Collier County is partially funded through the Federal Nutritional Services Incentive
Program (NSIP) and currently consists of a congregate meal sites in East Naples, Golden Gate, Goodlette
Arms senior apartments and the Roberts Center in Immokalee. Home delivered meals are also provided
to frail, home bound, elderly through this grant program. The current NSIP agreement for FY 2012 in the
amount of $34,602.00 was approved by the Board on September 11, 2012, item 16.D.14. In order to
receive the additional funding for FY 2012, an amendment in the amount of $544.00 must be executed by
the Board of County Commissioners.

The amendment to the NSIP program is being presented as an after- the -fact because Collier County
received the grant amendment on October 1, 2012 and we did not learn that immediate execution was
required until after the agenda deadline for the November 13, 2012 Board meeting had passed.
Consequently, pursuant to CMA 5330 and Resolution No. 2010 -122, the County Manager authorized
Steve Carnell, Interim Administrator, to sign the contract amendments. Collier County as the Lead
Agency is responsible to respond to seniors needs and to manage the spending authority for the NSIP
program services.
FISCAL IMPACT: A budget amendment is required to recognize additional grant funding in the amount
of $544.00 within Human Service Grant Fund (707), Project 33182. No match is required.
LEGAL CONSIDERATIONS: This is a standard form amendment provided by the Area Agency on
Aging for Southwest Florida, Inc. d/b /a Senior Choices of Southwest Florida. This item is legally
sufficient and requires a majority vote. — JBW
GROWTH MANAGEMENT: There is no growth management impact from this recommendation.
RECOMMENDATIONS: To authorize the necessary budget amendment to recognize grant funding
provided through the Area Agency on Aging for Southwest Florida, Inc. d/b /a Senior Choices of
Southwest Florida in the amount of $544.00 into NSIP Grant Fund 707, Project 33182 and ratify the
amendment and all necessary forms.

STANDARD CONTRACT

THIS AMENDMENT is entered into between the Area Agency on Aging for Southwest Florida, Inc., dba Senior
Choices of Southwest Florida ( "Agency ") and Collier County Board of County Commissioners, ( "Contractor "), amends
agreement NSIP 203.12.
The purpose of this amendment is to increase allocation by $544, revise Attachment I- SECTION III —Method of
Payment and ATTACHMENT III Exhibit-1.
The purpose of this amendment is to amend the following contract sections (Paragraphs and Attachments):
STANDARD CONTRACT:
Revise the Standard Contract with the following changes:
(1) Amend section 3; and
(2) Amend section 4.

(2) Revise Attachment III, Exhibit -1.

The Standard Contract is hereby revised as follows.
(1) Section 3 is amended to read:
3. This contract shall begin on October 1, 2011 or on the date on which the contract has been signed by the last
party required to sign it, whichever is later. It shall end at midnight, local time in North Fort Myers, Florida, on
December 10, 2012.
(2) Section 4 is hereby amended to read:
4. Contract Amount
The Agency agrees to pay for contracted services according to the terms and conditions of this contract in an
amount not to exceed 35,146.00, or the rate schedule, subject to the availability of funds. Any costs or services
paid for under any other contract or from any other source are not eligible for payment under this contract.
CONTRACT ATTACHMENTS:
(1) ATTACHMENT I, 3.2 REQUESTS FOR PAYMENT, Section 3.2.1 is amended to read:
3.2.1. Date for Final Request for Payment
(1) The final request for payment is due to the Agency no later than December 10, 2012. This contract is
for services provided during the 2011 Federal Fiscal Year beginning October 1. 2011 through
September 30. 2012; however, the contract is in effect through December 10. 2012. The
additional three months (October 1. 2012 through December 10. 2012) are to allow rates to be
adjusted for the service period. This contract shall automatically terminate after the final rate for the
federal fiscal year has been established and the release of final payments are authorized by the
Agency.
(2) In the event that the final reimbursement rate is greater or less than the rate in ATTACHMENT
^ I, Section 3.1, then this contract shall be appropriately adjusted upon notice from the Contract Manager.

(3) In the event of a conflict between this paragraph and any other provision in the contract, this
section shall supercede.
(2) Attachment III, Exhibit —1 is hereby replaced with the revised Exhibit —1 and attached Hereto.
This amendment shall be effective on the last day this amendment is signed by both Parties.
All provisions in the agreement and any attachments thereto in conflict with this amendment shall be and are hereby
changed to conform with this amendment.
All provisions not in conflict with this amendment are still in effect and are to be performed at the level specified in the
agreement.
This amendment and all of its attachments are hereby made a part of this agreement.
