EXECUTIVE SUMMARY
Recommendation to approve an amendment to authorize specific reimbursment within the
Subrecipient agreement between Collier County and David Lawrence (DLC) to operate the Collier
County Drug Court Program and authorize the County Manager or his designee to request a Grant
Adjustment Notice (GAN) to initiate a zero -cost budget amendment to the Drug Court Grant
#2010 -DC -BX -0016.
OBJECTIVE: Allow for an amendment to the subrecipient agreement and to request a zero -cost budget
amendment to the Adult Drug Court Grant Program.
CONSIDERATIONS: On May 9, 2006, agenda item 10A, the Board approved the 10 -Year Strategic
Plan (Fiscal Years 2007 -2016) which includes a Community Health and Human Services strategic goal:
"To improve the quality of life and promote personal wellness, self reliance and independence ".
Part of Collier County's tactical achievement toward this strategic goal is the receipt and management of
the Adult Drug Court Discretionary Grant from the Department of Justice (DOJ). The Agreement with
DOJ was approved on October 12, 2010, agenda item 16D3. The purpose of the Adult Drug Court
Discretionary Grant Program is to fund court supervised programs that provide treatment services for
substance abuse programs.
On January 11, 2011, agenda item number 1OD11 (formerly agenda item number 16D11), the Board
approved a subrecipient agreement with the DLC to operate the Adult Drug Court Discretionary Grant
Program. On July 24, 2011, agenda item number 16D11, the Board approved Amendment 1 to the
subrecipient agreement. Amendment 2 to the DLC subrecipient agreement is proposed to extend the
agreement, update contact information, and clearly identify governing documents, reimbursement
payment periods and match requirements.
This item also requests authorization for Housing, Human and Veteran Services staff to electronically
request a zero -cost amendment to the Drug Court Grant Program by submitting a GAN to DOJ.
The GAN is necessary to clarify which line items fall within certain categories in the budget..
If approved the GAN would modify the grant by allowing for the following:
1. Allow for reimbursement of the increased costs and new types of drug testing and laboratory
test fees under the Grant Agreement.
2. Allow for the reimbursement of the salaries and fringe benefits for the positions of Grant
Coordinator and Manager of Federal and State Grants under the Grant Agreement.
3. Allow for the reimbursement of a desktop computer and printer that was purchased on
02/15/2012 under the Grant Agreement instead of a laptop.
FISCAL IMPACT: Approval of this item will not change the funding amounts of the previously
approved subrecipient agreements. Funds are located in Human Services Grant Fund 707, Project 33131.
LEGAL CONSIDERATIONS: On July 24, 2012, the Board approved agenda item number l OD 11
16D2 which included the amendment to the subrecipient agreement that is the subject of this
item. Immediately after Board approval, it was determined that additional substantive
modifications to the subrecipient agreement were necessary. As such, the agreement was not
routed for signatures and is not legally binding. This item captures the necessary modifications
to the subrecipient agreements, is legally sufficient and requires a majority vote. - JBW

GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
item.
RECOMMENDATION: To authorize the Chairman to sign an amendment to a subrecipient agreement
between Collier County and David Lawrence Center for the operation of the Drag Court Grant Program
and authorize the County Manager or his designee to request a zero -cost budget amendment from the DOJ
for the Drug Court Grant.

15. COMPONENT PARTS OF THIS CONTRACT. This Contract consists of the attached

23. MATCH FUNDS. A match amount of $84,804.00 is required over the entire grant period
for this subrecivient agreement. The match reouirement may be satisfied by nrovidine
services, salaries. fringe, rent, office expenditures, cash or in -kind services that are not
otherwise used as match for other state or federal dollars. Match documentation shall be
submitted with each invoice equal to or greater than the invoice total until such time as
the match commitment is fulfilled.

Collier County- Housing, Human and Veteran Services is providing a total amount of
One Hundred Eighty Seven Thousand Four Hundred Four and 00/100 Dollars
($187,404.00) for funding the project scope described above for 2010 -2013. The sub
recipient shall provide a match of Eighty Four Thousand Eight Hundred Four and
0100 Dollars ($84,804.00) for the entire grant period 2010 -2013. The match requirement
may be satisfied by providing services, salaries fringe, rent, office expenditures, cash or
in -kind services that are not otherwise used as match for other state or federal dollars

We are writing to request that the Department of Justice (DOJ) allow Collier County to create a Grant
Adjustment Notice (GAN) in order to initiate a zero -cost budget amendment to the Drug Court Grant
#2010 -DC -BX -0016 with the DOJ (Grant Agreement) and for DOJ to approve same.
If approved, the GAN would accomplish the following:
1. Allow for reimbursement of the increased costs and new types of drug testing and laboratory test
fees under the Grant Agreement.
2. Allow for reimbursement of the salaries and fringe benefits for the positions of Grant Coordinator
and Manager of Federal and State Grants under the Grant Agreement.
3. Allow for the reimbursement of a desktop computer and printer that was purchased on

All-of these requests are for retroactive and prospective application so that past and future expenditures
may be reimbursed under the Grant Agreement.
Drug Testing esting and Laboratory ests
David Lawrence Mental Health Center (DLC) provides Drug Court Services under an agreement with
Collier County, dated January 11, 2011. DLC assisted the County with the creation of the application.
The budget included with the application for Drug Court Grant #2010 -DC -BX -0016 contains a budget
that included DLC's estimate of the individual cost of each drug test to be used by DLC. DLC informed
us that because new types of drug tests have been created since the writing of the application for the grant,
that the costs of the drug testing and laboratory test fees is substantially higher than originally estimated.
Approving this amendment would not increase the amounts already budgeted for costs of drug testing
($5,557) and laboratory test fees ($39,330). Accordingly, only a net -zero line item budget change would
occur.

Staffing
The budget included with the application for Drug Court Grant #2010 -DC -BX -0016 allows for the
reimbursement for the salary and fringe benefits of an Accounting Supervisor. This request is to also
allow for the salaries and fringe benefits for the positions of Grant Coordinator and Manager of Federal
and State Grants be considered allowable items for reimbursement.
Computer
The budget included with the application for Drug Court Grant #2010 -DC -BX -0016 allows for the
reimbursement of a laptop computer for up to $1,200 for the case manager. On February 15, 2011, a
desktop /personal computer and printer costing $1,183.41 were purchased by DLC for the case manager.
This request is to allow for the purchase of the desktop /personal computer and printer to be considered an
allowable item for reimbursement.
In summary, we are seeking DOJ's approval for the County to submit in the GAN, with a retroactive and
proactive effect with regards to the budget. HHVS believes that by making these changes, it will allow the
County and the DLC to make the best use of grant funds while achieving the goals of the Drug Court
Program. If not approved retroactively, the County and DLC will have to utilize other resources in
carrying out the Drug Court program resulting in a severe drain of their collective resources.

The County procurement policies will be followed regarding sole source procurement.
Justification: The DLC is the only comprehensive substance abuse provider in the county.
They receive funding from the state Substance Abuse & Mental Health (SAMH) office to
support drug court treatment. DLC is the only treatment provider on the Collier Drug Court Team.
Salary: Drug Court Case Manager. Full time equivalent at $30,900 annual salary
The salary is commensurate with similar positions at the agency. 100% of the
Case manager's salary is 100% Federal Funds.
Fringe @24.71% is the agency rate applied to all full time empolyees. 100% Federal funds.
