EXECUTIVE SUMMARY
Recommendation to terminate the Utility Facilities Reimbursement Agreement dated February 20,
1996, relating to property located at the northeast corner of the intersection of Collier Boulevard
(CR 951) and Johns Road in Section 23, Township 50 South, Range 26 East, Collier County.
OBJECTIVE: Terminate the Utility Facilities Reimbursement Agreement dated February 20,
1996, relating to property located at the northeast corner of the intersection of Collier Boulevard
and Johns Road.
CONSIDERATIONS: On February 20, 1996, Winter Beach - Naples Investments, Inc., entered
into an agreement with Collier County to construct certain wastewater utility facilities for the
county. The agreement was recorded in the Official Records of Collier County at OR Book 2151,
Pages 748 -758. Recently Wilton Land Company, LLC, as successor to Winter Beach - Naples
Investments; Inc., requested to terminate the agreement. The Public Utilities Department
reviewed the request and has no objection and, therefore, recommends termination of the
agreement.
FISCAL IMPACT: None.
LEGAL CONSIDERATIONS: The proposed Termination of Agreement is legally sufficient and
requires a majority vote of the Board for approval. (HFAC)
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with
this action.
RECOMMENDATION: That the Board of County Commissioners as the Governing Body of
Collier County and as Ex- Officio the Governing Board of the Collier County Water -Sewer
District approve the termination of the Utility Facilities Reimbursement Agreement, and
authorize its Chairman to sign the Termination of Agreement.

TERMINATION OF AGREEMENT
THIS TERMINATION OF AGREEMENT is made this day of . 2012, by
and between WILTON LAND COMPANY, LLC, a Florida limited liability company, AS SUCCF-SSOR
IN INTEREST TO WINTER BEACH NAPLES INVESTMENTS, INC.. a Florida corporation
(hereinafter referred to as "Developer") and the BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, Florida, as the Governing Body of Collier County and as Ex-Officio the Governing
Board of the Collier County Water-Sewer District (hereinafter referred to as "County").
RECITALS
WHEREAS, on February 20, 1996, Winter Beach-Naples Investments, Inc. and County entered into
that certain Utility Facilities Reimbursement Agreement to construct certain wastewater utility facilities
for County (the "Agreement"), as recorded in O.R. Book 2151, Page 0748, Public Records of Collier
Countv, Florida; and
WHEREAS, Developer and County wish to terminate said Agreement.
NOW THEREFORE, in consideration of the mutual covenants contained herein and in the
Agreement, and other valuable consideration, Developer and County agree that the Agreement is hereby
terminated and the parties shall have no further rights and obligations thereunder.
IN WITNESS WHEREOF. Developer and County have executed this Termination of Agreement on
the day and year first above written.

upsizing of a force main within the right- of-way along CR 951.
CONSIDERATIONS: The developer of Kountree Kampin is will -. i to
construct a wastewater force main along CR 951 to serv_. the
Rountree Kampin Campgrounds. The Public works Division reco:_:-.izes
a benefit to upsizing the wastewater line for future servi,2 to
additional developments along the route.
The County has participated in upsizing agreements previously to
the benefit of the Collier County Water -Sewer District. The
upsized lines are to be conveyed to the County prior to p::;nent
being released to the developer.
Approval of this agreement is contingent on the review of this
document by the County Attorney's office.
FISCAL IMPACT: This project is not currently budgeted. The
maximum fiscal impact for the .wastewater line, will cost $24,308.
A budget amendment moving $24,808 dollars from sewer capital fund
414- 919010- 993010 reserves is necessary.
42OWTE MAIMGEMENT IMPACT: The agreement would meet with the
objectives of the Growth Management Plan.
RECOMMENDATION: The Public Works Administrator recommends tha•: the
Board of County Commissioners, Ex- Officio the Governing Boar..; of
the Collier County Water -Sewer District of Collier County, Florida,
approve the agreement and necessary budget amendment and auth-:.ize
recordation of document.

Project in advance of the County's current capital improvement schedule; and
WHEREAS, the County Utillties Division has recommended to the Board of Country
Commissioners that it will be advantageous to the public for Developer to install certain wastewater utility facilities

among other things. up -sized wastewater utility facilities which are larger in size and will carry capacity in excess of
the size and capacity determined by Developer to be needed solely to accommodate Developer's Project; and
WHEREAS, Developer has submitted to the Collier County Public Works Division staff an
acceptable proposed plan and estimate of casts for the Utility Project. wbkb include:
a) A narrative description of the Utility Project; and
b) An acceptable proposed time schedule with the completion of the Utility Project prepared
by a professional architect or engineer: and
c) Acceptable additional profeasiotsal opinions of the probable construction costa for C.t Utility
