EXECUTIVE SUMMARY Recommendation to approve for recording the final plat of Canwick Cove, (PL20120001486), approval of the standard form Construction and Maintenance Agreement and approval of the amount of the performance security. OBJECTIVE: To approve for recording the final plat of Canwick Cove, a subdivision of lands located in Section 27, Township 50 South, Range 26 East, Collier County, Florida, following the alternative procedure for approval of subdivision plats pursuant to Resolution 99 -199. This procedure allows for the Board of County Commissioners (Board) to approve the plat and associated construction documents for construction purposes and recording purposes concurrently. CONSIDERATIONS: Engineering Services Department has completed the review of the construction drawings, specifications, and final plat of Canwick Cove. These documents are in compliance with the County Land Development Code and Florida State Statute No. 177. This project is within the Lely Resort PUD, Ordinance 92 -15, and is consistent with the requirements of the PUD. The plat dedicates certain easements to Collier County, all with no responsibility for maintenance. The roadway and drainage improvements will be privately maintained, while the potable water and sanitary sewer facilities will be conveyed to Collier County upon acceptance. All fees have been paid. Security in the amount of 10% of the total cost of the required improvements, and 100% of the cost of any remaining improvements, together with a Construction and Maintenance Agreement for Subdivision Improvements, shall be provided and accepted by the County Manager or his designee and the County Attorney's office prior to the recording of the final plat. This would be in conformance with the County Land Development Code -- Section 10.02.05 AA.b. Engineering Services Department recommends that the final plat of Canwick Cove be approved for recording. FISCAL IMPACT: The project cost is $253,437.35 (estimated) to be borne by the developer. The cost breakdown is as follows: a) Water & Sewer $ 65,251.00 b) Drainage, Paving, Grading $188,186.35 The Security amount, equal to 110% of the project cost, is $278,781.09 The County will realize revenues as follows: Fund: Growth Management Fund 131 Agency: County Manager Cost Center: 138327 -- Land Development Services Revenue generated by this project: Total: $8,678.13 Packet Page -2212- 12/11/2012 Item 16.A.9. Fees are based on a construction estimate of $253,437.35 and were paid in July, 2012. n The breakdown is as follows: a) Plat Review Fee ($1,000.00 + $5. /ac) $1,075.00 b) Construction Drawing Review Fee Water & Sewer (.75% const. est.) $ 489.38 C) Drainage, Paving, Grading (.75% const. est.) $1,411.40 d) Construction Inspection Fee Water & Sewer (2.25% const. est.) $1,468.15 e) Drainage, Paving, Grading(2.25 0/oconst.est.) $4,234.20 GROWTH MANAGEMENT IWACT: The developer must receive a Certificate of Adequate Public Facilities prior to the issuance of the construction plan final approval letter. LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed and approved the plat and associated legal documents for legal sufficiency and has determined that this item is ready for the Board's consideration and approval. This item requires a majority vote: EP RECOMMENDATION: Recommendation that the Board of County Commissioners endorse staff's recommendation.to approve the final plat of Canwick Cove (PL20120001486) for recording with the ^, following stipulations: Approve the amount of $278,781.09 as performance security for the required improvements; or such lesser amount based on work completed, and as is approved by the Land Development Services Department. 2. Approve the standard form Construction and Maintenance Agreement and direct the County Manager or his designee: a. To withhold Certificates of Occupancy until the required improvements have received preliminary acceptance. b. To delay recording of the plat until suitable security and an appropriate Construction and Maintenance Agreement is approved and accepted by the County Attorney's office and the Board of County Commissioners or the County Manager or his designee, or his designee on behalf of the Board pursuant to Section 10.02.05 A.4.b of the Land Development Code.
