EXECUTIVE SUMMARY
Appointment of member to the Collier County Planning Commission.
OBJECTIVE: To appoint one member to the Collier County Planning Commissioner to a term
expiring on October 1, 2016.
CONSIDERATIONS: The Collier County Planning Commission has one vacancy to fulfill a
term that expired on October 1, 2012. The vacancy is for a representative of District 2. This nine
member committee assists in the formulation and review of the Comprehensive Land Use Plan,
Land Development Code, and amendments to both, and then submits their recommendations to
the Board for final decision. Members are required to file a Form 1, Statement of Financial
Interest each year with the Supervisor of Elections. Terms are four years.

The term of Bradley W. Schiffer, District 2 expired October 1, 2012. A press release was issued

LEGAL CONSIDERATIONS: This is a District 2 seat. The Planning Commission
ordinance provides that "Candidates for the Planning Commission must be nominated by the
Commissioner of the District in which the candidate resides for both initial and subsequent

RECOMMENDATION: That the Board of County Commissioners considers the
recommendation for appointment, appoint one member, and direct the County Attorney to
prepare a resolution confirming the appointment.

As noted in your memorandum of November 16, 2012, there is currently one vacancy for the above
referenced advisory board. For this advertising period, two applicants (Brad Schiffer and Ray Allain)
have applied to fill the District 2 vacancy. As you know, Brad Schiffer is seeking to be reappointed in
District 2.
It should be noted that Section 2 -1157 (CCPC Membership qualifications) of the Code of Laws and
Ordinances requires the members of the CCPC to be permanent residents and qualified electors of Collier
County. The CCPC members are also to reside in the Commission District allocated for each vacancy.
Please be advised that both applicants are permanent residents of Collier County and are registered voters
as noted on their applications. While Brad Schiffer resides within Commission District 2, the address
(6090 Cedar Tree Lane) provided by Mr. Allain is located outside the District 2 boundary.
Furthermore, this section states that although no specific experience requirements shall be necessary as a
prerequisite to appointment, consideration shall be given to applicants who have experience or who have
shown interest in the area of planning, zoning, and related fields. Further consideration in the appointment
of Planning Commission members shall be made so as to provide the Planning Commission with the
needed technical, professional, business, and /or administrative expertise to accomplish the duties and
functions of the Planning Commission. The above referenced applicants have related experience in the
area of architectural review and building construction.
Based upon the information contained in their applications, Brad Schiffer is qualified to serve on this
advisory board while Ray Allain doesn't qualify since he is not a resident of District 2.

This 9 member committee was created by authority of Chapter 67 -1246, Laws of FL. On
09/03/85 the BCC adopted Res. No. 85 -190, expressing intent to consider an ordinance
consolidating functions of Coastal Area Planning Commission and Immokalee Area Planning
Commission into CCPC. On 09/24/85, Ord. No. 85 -51 created the CCPC, which was repealed
by LDC Ord. 91 -102. This committee assists in the formulation and review of the
Comprehensive Land Use Plan, Land Development Code, and amendments to both, and then
submits their recommendations to the Board for final decision. Members are required to file a
Form 1 Statement of Financial Interest each year with the Supervisor of Elections. Terms are 4
years.
On 1 -8 -03 at an LDC Mtg the BCC amended the LDC (sec. 5.2.3.2) to include a member of the
School Board. The BCC determined on 10/14/03 that they will be a non - voting member.
