EXECUTIVE SUMMARY
Recommendation to approve the release of liens in the amount of $55,288.24 for payment of
$8,488.24, in the Code Enforcement Action against Terry Dilozir, relating to properties
located at 5322 Catts Street, 4035 22 "d Avenue SE, 4301 201h Place SW, and 4913 18th
Avenue SW, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release
$55,288.24 in code enforcement liens for payment of $8,488.24.
CONSIDERATIONS: As a result of code violations at 5322 Catts Street, the Code Enforcement
Board ordered the imposition of a lien ( "Lien ") against the owner Terry Dilozir in Code
Enforcement Case Number CEPM20100005779. The lien was recorded in the Official Public
Records on July 15, 2011, at O.R. Book 4702, Page 129, and the lien encumbers all real property
owned by Terry Dilozir. The fine amount of $47,250 is based on accrued fines for the non-
compliance period of 189 days at $250 per day pertaining to an unmaintained pool without a
proper pool barrier. The property was brought into compliance by the County on April 29, 2011.
This property also has outstanding liens and County abatement costs for lot mowing charges in
the amount of $1,411.31.
Pursuant to Resolution 2012 -46, the amount of $4,199.04 will be paid upon approval from the
Board of County Commissioners for the property located at 5322 Catts Street. This represents
$450 in fines, $112.73 in operational costs and $3,636.31 in County abatement costs.
In addition, there are three properties that are owned by Terry Dilozir with liens filed on the
property. Property located at 4035 22nd Avenue SE has a lien in the amount of $246.10. Property
located at 4301 20t1, Place SW has unpaid liens and fees in the amount of $2,218.80. Property
located at 4913 18t1' Avenue SW has liens and fees in the amount of $1,824.30. The total due for
these three properties is $4,289.20.
FISCAL IMPACT: Once payment of $8,488.24 is received, representing County's costs and
fines, the accrued fines in the amount of $46,800 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary,
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action and requires a
majority vote for approval. -JW
RECOMMENDATION: That the Board waive the fines in the amount of $46,800, release the
liens upon receipt of payment of $8,488.24 and authorize the Chairman to sign the attached
release of lien.

RELEASE AND SATISFACTION OF LIEN
KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA is the owner and holder of a
certain lien against all real and personal property owned by:

The lien was recorded on July 15, 2011 in Official Records Book 4702, Page 129, in the
Official Records of Collier County, State of Florida. The lien secures the principal sum of
Forty Nine Thousand five hundred eighty seven dollars and seventy three cents, plus
accrued interest and penalties, if any, and imposes certain obligations against real
property situated in Collier County, Florida, which property is described as follows:

5322 Catts Street Naples, FL
Collier County, a political subdivision of the State of Florida, by execution of this Release
and Satisfaction of Lien, acknowledges payment as approved by the Board of County
Commissioners as satisfaction of the lien and hereby cancels said lien.
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction
of Lien in the Official Records of Collier County, Florida, to acknowledge that the lien
ceases to exist.
