EXECUTIVE SUMMARY
Recommendation to adopt a position regarding East Naples Fire Control and Rescue
District's proposal to the Collier County Legislative Delegation to expand the District's
boundaries by adding property currently within the Isles of Capri Fire Department MSTU.
OBJECTIVE: To present data and options to the Board for its use in establishing a position on
the proposed annexation into the East Naples Fire District (ENFD) of property currently part of
the Isles of Capri Fire MSTU.
CONSIDERATIONS: Staff learned recently that an item requesting support for the expansion of
the East Naples Fire District has been placed on the agenda for the Collier County Legislative
Delegation Workshop with the Board of County Commissioners to be heard on November 14,
2012. The subject property represents approximately six blocks within the Fiddlers Creek PUD.
The Property Appraiser's office estimates the value of this property as twelve percent (12 %) of
the taxable value of the Isle of Capri MSTU or approximately $121,500 in ad valorem taxes.
The Isles of Capri FY13 net operation budget is $1,262,600 of which only $191,000 is operating
expense. The only way to reduce the budget to meet such a shortfall is to reduce staffing by 2
FTEs (approx $66,000 each with benefits), a reduction of 25% of line personnel. The alternative
is to increase revenues either with an increase in millage rate of approximately .3 mils or a
transfer from the General Fund.
A minimum of two firefighters are required to operate an engine; however, to perform interior
structural firefighting, State Statute requires that a minimum of two firefighters enter the building
and a minimum of two remain outside (2 in /2out). With current staffing levels, two of the three
shifts are staffed with three firefighters. The fourth member can be made up with an EMS
Paramedic /Firefighter or command staff (when available). Shifts with less than three personnel,
require response from an additional engine, which delays the handling of the call.
Leave time (at least 10 shifts per year per employee) that results in staffing of less than two
personnel on a shift is covered with either job bank personnel or overtime. Currently, this
occurs with each leave day only on one of the three shifts. If staffing is reduced to two per shift
on all three shifts, every leave day will have to be covered with temporary staff or the use of
overtime.
The County applied for a FEMA Staffing for Adequate Fire and Emergency Response (SAFER)
grant to supplement fire service levels in the Isle of Capri. Award notices for this grant are
expected by July 2013. This grant contains a non - supplanting clause meaning that the funds
must be used for additional services or capabilities not to replace resources. This annexation
will result in a loss of revenue in FY14. If there is a reduction in staffing resulting from
annexation, the County would be in violation of the terms and conditions of the grant. If
awarded, the County's options would be to accept the grant and fully fund all 11 positions or
reject the award.
FISCAL IMPACT: Annexation of these properties into ENFD will decrease ad valorem taxes to
the Isles of Capri Fire District by approximately $121,500.

the Executive Summary.
RECOMMENDATION: That the Board takes one of the following actions:
1. Oppose the proposed annexation;
2. Support the proposed annexation;

4. Support the proposed annexation contingent upon award and acceptance of the
FEMA SAFER grant.

The East Naples Fire Control & Rescue District ( "District'') is requesting that the Collier
County Legislative Delegation consider the attached proposed local bill for the 2013 . Legislative
Session. The purpose of the local bill is to expand the boundary of the East Naples Fire Control
and Rescue District so that the remaining portion of the Fiddler's Creek development is included
within the District's jurisdiction. A copy of the proposed bill is attached hereto as Attachment A.
A more detailed explanation of the proposal follows.
Currently, the Fiddler's Creek subdivision in Collier County is split between the East
Naples Fire Control & Rescue District and the Isle of Capri Fire Control and Rescue District. As
such, neighbors are subject to differing millage rates and response times. Pepper Tree Village,
Whisper Trace Condominiums, Bent Creek Village, and Mallard's Landing Village are the only
portions of Fiddler's Creek that are Iocated within the Isle of Capri Fire Control and Rescue
District. Early this year, representatives from the Board of Directors of the Pepper Tree Village
Association, Inc., Whisper Trace Condominium Association, Inc., Bent Creek Village
Association, Inc., and Mallard's Landing Village Association, Inc. (collectively, the
"Associations"), approached the District to seeks its assistance in having the Associations
incorporated into the District's boundary. A map showing the two districts and the area of
proposed incorporation is attached hereto as Attachment B.
In or about June, 2012, Cardinal Management Group of Florida, Inc., on behalf of the
Associations conducted a straw poll to ensure that the property owners of the Associations
approved of the incorporation. On June 12, 2012, Cardinal Management submitted a letter to the
District stating that 96% of the property owners that voted were in favor of the incorporation.
Over 70% of the property owners participated in this vote. A copy of the correspondence from
Cardinal Management Group of Florida, Inc. is attached hereto as Attachment C.
If this proposed local bill is adopted, the property owners within the Associations will
benefit in two significant ways. First, the millage rate for fire and rescue service will drop from
2.0 mils to 1.5 mils. Second, and more importantly, the response time for fire and rescue service
will drop from approximately 7 minutes to less than. 3 minutes.
Based upon the above, we ask that the delegation support and introduce the proposed
local bill.
