EXECUTIVE SUMMARY Recommendation to approve an after-the-fact substantial amendment for a City of Naples HUD Community Development Block Grant-Recovery(CDBG-R)project. OBJECTIVE: To process an amendment to the HUD Action Plan finalizing the grant funded sidewalk installation project in River Park. CONSIDERATIONS: CDBG-R funding became available as part of the American Recovery and Reinvestment Act (ARRA) of 2009. In order to receive this funding, staff prepared a public notice for a substantial amendment to the Collier County FY2008 HUD Action Plan. This action followed the instructions in the published"Notice of Program Requirements". Typically at the time a substantial amendment is made, project details are known. However, when this funding become available, in order to comply with the short time restraints stipulated by HUD, staff had to submit and advertise generic project descriptions. Since then, the project was developed in more detail, and has been completed. HUD provided feedback in late 2011 that another project should be selected. The City of Naples had not started the project so the City chose a compliant sidewalk project in lieu of landscaping. **NOTE 2: Both the original sub recipient agreement and the amendment#3 were publicly advertised for both City Council and County Board of Commissioners meetings. As outlined in the 2nd substantial amendment advertisement, the completed project was for sidewalks in the River Park area(Census Tract 7), a low/moderate income area within the City of Naples. This revised project was approved by the City of Naples on January 18, 2012 and by the Board of County Commissioners on January 24, 2012 (Item No.16D9). Throughout all of the history, the same CDBG eligible activity of Public Facilities remained consistent. Staff was not certain whether HUD requires the proposed (2"d) substantial amendment, since there is no change to the CDBG eligible activity (Public Facilities) or location (Census Tract 7). In order to be clear, staff has been in contact with HUD regarding this issue. As of the writing of this executive summary, HUD has not provided a determination to staff as to whether a substantial amendment is required or not. Discussions with HUD will continue until resolution and should HUD determine staff does not need a substantial amendment prior to the Board meeting, the item will be withdrawn. However, in an abundance of caution, HHVS advertised the substantial amendment to avoid missing the chance to do so, if it was determined to be the best course of action. HHVS requests approval of the after-the-fact substantial amendment to fully outline the project City of Naples undertook and completed. There is no risk in having made this advertisement. The current advertisement for substantial amendment was published in the Naples Daily News on October 10, 2012. It was required to run for seven days, and no public comments were received. Approval of this after-the-fact substantial amendment will allow the City to be reimbursed for their fully completed and compliant CDBG-R project. Approval of the substantial amendment is the only remaining item keeping the reimbursement from being made to the City of Naples for this project, and consequently approval of this item is expected to result in reimbursement being processed. Reimbursement and then subsequent drawdown of funds needs to be completed by October 31, 2012 in order to close the grant. FISCAL IMPACT: If approved there will be no effect on ad valorem or general fund dollars. Funds are available within the HUD ARRA Grants Fund (125) for Community Development Block Grant ARRA (CDBG-R 33081). GROWTH MANAGEMENT IMPACT: There is no Growth Management Plan impact by this action. LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote -JBW. RECOMMENDATION: Approval of an after-the-fact substantial amendment of the FY2008 HUD Action Plan, allowing payment to the City of Naples for a completed CDBG-R project.
