EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to execute a Resolution repealing Resolution No.2009-296 and a Resolution establishing a revised Collier County Public Library Fees and Fines Schedule. OBJECTIVE: To repeal Resolution No. 2009-296 that provides the Library Fines and Fees, and adopts the attached resolution. CONSIDERATIONS: Library fines and fees were last modified in FY2009. Since then several public meeting rooms in libraries have been provided for use by the public and one is recommended for limited use after library hours. The proposed changes also make the charges more consistent among all libraries. Minor policy changes also necessitate minor changes. The Library Advisory Board recommends the following changes to the Fines and Fees schedule: • Remove circulation rules and overdue charges for State Library films. They are no longer available. • Change `Video' to DVD on the `Loan and Computer Usage Rules and Fines table: • Allow renewal of all materials,unless another library patron has placed a hold on the item. • Charges for use of library meeting rooms as listed on EXHIBIT"A". o Includes charge for after hours use of South Regional Library meeting room. FISCAL IMPACT: Approval of the revised Fines and Fees Schedule should have a positive impact on the FY2013 General Fund Budget of the Collier County Public Library. Anticipated revenue from all Library Fines, Fees and meeting room use should net approximately $395,000 in the FY2013 General Fund Budget. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, requires majority vote, and is legally sufficient for Board action. —CMG GROWTH MANAGEMENT IMPACT: None RECOMMENDATION: To repeal Resolution No. 2009-296 and adopt the attached revised Resolution No. 2012- that lists new Fines and Fees for Collier County Public Library. RESOLUTION NO. 2012 - A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, REPEALING AND SUPERSEDING RESOLUTION NO. 2009-296, IN ORDER TO ESTABLISH REVISED COLLIER COUNTY PUBLIC LIBRARY FINES AND FEES. WHEREAS, Collier County Ordinance No. 88-71 confirmed the creation of the Library Advisory Board to act on behalf of the Board of County Commissioners (Board) in the establishment of policies relating to the Collier County Library System; and WHEREAS, Ordinance No. 88-71, as subsequently amended, also provides that the Library Advisory Board will advise the Board on all Library Department issues including fees, budgets, capital planning, staffing levels, and other library related programs and shall furnish budget recommendations for each forthcoming fiscal year for the operation of the County's library system; and WHEREAS, Collier County Library fines and fees are currently enumerated in Resolution 2009-296 as approved by the Board on December 15, 2009; and WHEREAS, Collier County recently established additional meeting rooms in its libraries to meet public need; and WHEREAS, the Library Advisory Board is recommending that the Board revises its library fines and fees schedule to include the fees associated with the new meeting rooms,correct inconsistencies in the fees charged by the different library branches, and update certain policies and procedures to reflect current practice. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that: 1. The Collier County Public Library Fines and Fees Schedule is hereby approved and attached to this Resolution as Exhibit"A." 2. This Resolution repeals and supersedes Resolution No. 2009-296 in its entirety. 3. The above-referenced Fines and Fee Schedule shall become effective on the day following adoption of this Resolution.
