EXECUTIVE SUMMARY Recommendation to approve Change Order No. 4 to Contract # 09-5278 for an additional 942 days with Stanley Consultants, Inc., for Design & Post Design Construction Related Services for the Intersection Capacity Improvements to the US 41 and SR/CR 951 Intersection and Resurfacing, Restoration and Rehabilitation (3R) roadway improvements to SR 951; project#60116; Fiscal Impact $0.00. OBJECTIVE: To add 942 days to the terms of the contract for completing the design and post design construction services for the Resurfacing, Restoration and Rehabilitation (3R) segment of the Project a/k/a the US41 and SR/CR 951 Intersection Improvement and 3R Improvements of SR 951. CONSIDERATIONS: The 3R segment of the project began with a separate design schedule and it was intended to go to construction ahead of the US41 and SR/CR 951 intersection improvements. The FDOT is providing funding through a Joint Participation Agreement (JPA) for both CEI and construction for this segment; and, construction funding for the intersection improvements. The Board approved the JPA for the CEI services on September 11, 2012, under agenda item 16.A.13. The FDOT and staff has since agreed that in order to allow flexibility between the different funding mechanisms, both segments of the improvements should be let for construction simultaneously. The 3R project has a design completion date of October 9, 2012. The Intersection design segment will be completed in March 2013 with the right of way phase due to be completed in June 2013. Construction of both segments is not anticipated until late fall of 2013. This Change Order No. 4 will allow the 3R segment to match the schedule of the intersection improvements segment and retain the Engineer of Record, Stanley Consultants, for the duration of the design and post design construction phases of the projects. FISCAL IMPACT: There are no fiscal impacts as a result of this change order no. 4. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and only requires a majority vote for approval—SRT. GROWTH MANAGEMENT IMPACT: The project has been adopted in the CIE and is consistent with the Long Range Transportation Plan. RECOMMENDATION: That the Board of County Commissioners approves the Change Order No. 4 to contract 09-5278 to Stanley Consultants, Inc. (this box must be initialed by Project Manager) ❑Add new task(s) ! ❑ Change task(s) ❑ Delete task(s) (I Other(specify): Time Extension Provide a detailed and specific explanation of the requested change(s)to the task(s)and/or the additional ys added: The Florida Department of Transportation (FDOT) entered into a Memorandum of Agreement with Collier County on November 10th, 2009 to provide reimbursement for the US41 & SR/CR 951 intersection improvement(Phase 1)and the SR 951 Restoration, Rehabilitation and Resurfacing (Phase 1A). A Joint Participation Agreement detailing the terms of the reimbursement will be drafted and taken to the Board for approval in March/April 2013. The segment of the project known as Phase 1A was intended to be constructed under a separate construction contract and from the beginning the designs pursued different time tables for completion. Since the November 2009 MOA, the FDOT has revised the memorandum of agreement to allow flexibility of funding between the two projects and now intends to have both segments (Phase 1 and Phase 1A) let under one construction contract. Additional days are therefore needed to allow the Phase 1A project to be on the same schedule for design completion, construction and post design services as the Phase 1 segment. 2. Provide detailed rationale for the requested change: The design and post design completion of Phase 1A will terminate on October 9, 2012. It is anticipated that construction project(Phase 1 and Phase 1A) will begin in the first quarter of FY2014 with 2-year construction durationor the reasons provided in item 1 above, additional days are being requested to extend the schedule of Phase 1A. v 3. Provide explanation why change was not anticipated in original scope of work: The segments were different in scope and complexity and also they had different funding sources from the State. They were kept as separate projects for these reasons. Phase 1A is receiving state funds for construction/CEI in amount of$7,775,576 and Phase 1 is receiving a County Incentive Grant Program (CIGP) for construction only in the amount of$3,180,888 with a local match of 50% or approximately $8,005,019. The probable construction cost of Phase 1A is not anticipated to require the total $7.78M and the probable construction cost of Phase 1 will exceed $11M. Therefore; the state determined that for ease of funding the two segments they should both be let under one construction contract . These differences could not have been anticipated at the onset of the design. 4. Describe the impact if this change is not processed: The mechanism for completing the design is a valid contract.
