EXECUTIVE SUMMARY
Recommendation to approve the Site Improvement Plan and authorize the Chair to sign the
Compliance Agreement for Star Mobile Home Park located at 1507 Immokalee Drive, Immokalee,
Florida.
OBJECTIVE: That the Board of County Commissioners (Board) approve the Site
Improvement Plan (SIP) for Star Mobile Home Park and authorize the Chair to sign the attached
Compliance Agreement.
CONSIDERATIONS: The property owner of Star Mobile Home Park submitted a Site
Improvement Plan (SIP); application number PL20100001866. The SIP application meets the
standards established by the Non-Conforming Mobile Home Park Overlay Subdistrict Land
Development Code (LDC) Section 2.03.07(G):
G. Immokalee Urban Overlay District. To create the Immokalee Urban Overlay District
with distinct subdistricts for the purpose of establishing development criteria suitable for
the unique land use needs of the Immokalee Community. The boundaries of the
Immokalee Urban Overlay District are delineated on the maps below.
6. Nonconforming Mobile Home Park Overlay Subdistrict. Establishment of special
conditions for these properties which by virtue of actions preceding the adoption of
Ordinance No. 91-102, on October 30, 1991, were deemed to be nonconforming as a
result of inconsistencies with the land development code, and are located within the
Immokalee Urban Boundary as depicted on the Immokalee Area Master Plan.
b. Required site improvement plan application. The property owners of all
nonconforming mobile home developments/parks that were in existence before
November 13, 1991, i.e., that predate Ordinance No. 91-102, the land development code,
shall be required to submit a site improvement plan (SIP) meeting the standards set forth
below by January 9, 2003 or thereafter within the time frame set forth in an order of the
Code Enforcement Board finding a violation of this section, or by the date set forth in a
Compliance or Settlement Agreement entered into between Collier County and a property
owner acknowledging such a violation and also establishing the date by which such
violation will be cured through the SIP submittal process set forth below.
The property owner has participated in the meetings in regard to the Immokalee Mobile Home
Parks proposed LDC amendment, however wishes to move forward with obtaining Board
approval for the submitted SIP. Approval of the submitted SIP will allow the property owner to
replace mobile homes and increase the mobile home park's revenue. The SIP, which meets the
development criteria established for the Immokalee community, will be issued upon approval by
the Board of County Commissioners. This action will cure the violation pursuant to the current
LDC.

All fees outlined in the Collier County Growth Management Division Fee Schedule for the SIP
application have been paid. The current LDC also requires an inspection of the mobile homes for
minimum housing code standards and minimum floor area requirements for approval of an SIP.
Staff recommends that the BCC waive the property maintenance inspection fee for inspections of
the mobile homes associated with the SIP submission.
It should be noted, that the property was identified within the Immokalee Mobile Home
assessment that was presented to the BCC in December 2011. The assessment indicated that a
portion of the MH Park was nonconforming because it is now zoned RMF-6 and C-4, and
qualified as a nonconforming mobile home park based upon the zoning in 1974 was I-MHTT,
which allowed for mobile home parks.
FISCAL IMPACT: With Board approval the $200 property maintenance inspection fee will be
waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: The Compliance Agreement was drafted by the County
Attorney. This item is legally sufficient for Board action and requires a majority vote for
approval. -JAK
RECOMMENDATION: That the Board approve the Star Mobile Home Park Site
Improvement Plan (SIP) and authorize the Chair to sign the Compliance Agreement, which has
met the requirements of 2.03.07.G.6 of the Collier County LDC.

COMPLIANCE AGREEMENT
THIS COMPLIANCE AGREEMENT is made and entered into as of September 25,
2012, by and between Star Mobile Home Park, whose address is 1507 Immokalee Drive,
Immokalee, FL 33916, hereinafter called the "Owner" and Collier County, a political subdivision
of the State of Florida, hereinafter called the"County."
RECITALS:
WHEREAS, Section 2.03.07.G.6 of the Collier County Land Development Code (LDC)
sets forth the Immokalee Nonconforming Mobile Home Park Overlay Subdistrict, providing for
the"Establishment of special conditions for these properties which by virtue of actions preceding
the adoption of Ordinance No. 91-102, on October 30, 1991, were deemed to be nonconforming
as a result of inconsistencies with the land development code, and are located within the
Immokalee Urban Boundary as depicted on the Immokalee Area Master Plan;" and
WHEREAS, the expressed purpose and intent of this Subdistrict was "to recognize that
there are nonconforming mobile home parks in the Immokalee Urban Area, to provide incentives
to upgrade these parks while requiring the elimination of substandard units, and to allow park
owners to take advantage of alternative development standards in order to cause some upgrading
of conditions that would normally be required of conforming mobile home parks;" and
WHEREAS, LDC Section 2.03.07.G.6 provides a process whereby"The property owners
of all nonconforming mobile home developments/parks that were in existence before November
13, 1991, i.e., that predate Ordinance No. 91-102, the land development code, shall be required
to submit a site improvement plan (SIP) meeting the standards set forth below by January 9,
2003, or thereafter within the time frame set forth in an order of the Code Enforcement Board
finding a violation of this section, or by the date set forth in a Compliance or Settlement
Agreement entered into between Collier County and a property owner acknowledging such a
violation and also establishing the date by which such violation will be cured through the SIP
submittal process set forth below;" and
WHEREAS, LDC Section 2.03.07.G.6 further provides that "The site improvement plan
(SIP) master plan shall illustrate the way existing buildings are laid out and the infrastructure
(i.e. utilities, streets, drainage, landscaping, parking and the like) to serve those buildings. The
number and location of buildings shall be reviewed for consistency with Code requirements (i.e.
setbacks, space between buildings, density, and the like). Similarly, the SIP shall serve to
provide a basis for obtaining approval of required infrastructure improvements such as those
referenced herein. The approved SIP showing all of the above shall become the official record
acknowledging the legal use of the property. Failure to initiate this process within the time
frames set forth above, will result in a Code violation in which the property owner will be
required to immediately remove all mobile homes which have not received a building permit and
all mobile homes deemed to be unsafe and unfit for human habitation, and otherwise contrary to

the County's housing code unless otherwise prohibited by state law;" referring to Section
10.02.05 F. of the LDC for the specific requirements concerning the SIP submission; and
WHEREAS, in keeping with this process, the Owner wishes to enter into a Compliance
Agreement with Collier County, under the terms and conditions set forth below.
WITNESSETH:
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and
valuable consideration exchanged amongst the parties, and in consideration of the covenants
contained herein, the parties agree as follows:
1. All of the above RECITALS are true and correct and are hereby expressly
incorporated herein by reference as if set forth fully below.
2. Applicant has submitted a Site Improvement Plan (Exhibit "A"), which Collier
County Zoning and Planning staff has determined meets the standards established by Section
2.03.07.G.6 of the Collier County Land Development Code (LDC).
3. The Owner shall have three years to complete the work depicted in Exhibit "A,"
or apply for an extension as provided for within Section 10.02.05.F of the LDC.
4. This is the entire agreement between the parties with respect to the matters set
forth herein, and any prior agreements or understandings of any kind are hereby merged and
integrated herein. Except as otherwise provided herein, this Agreement shall only be amended
by mutual written consent of the parties hereto or by their successors in interest.
5. This Agreement shall be recorded by the County in the Official Records of Collier
County, Florida, within fourteen (14) days after the County enters into this Agreement. The
Owner shall pay all costs of recording this Agreement. The County shall provide a copy of the
recorded document to the Owner upon request.
6. In the event of a dispute under this Agreement, the parties shall first use the
County's then-current Alternative Dispute Resolution Procedure. Following the conclusion of
this procedure, either party may seek appropriate relief.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed
by their appropriate officials, as of the date first above written.
