EXECUTIVE Sill MARL
Recommendation to authorize staff to notify applicant of the County's cancellation of two "As Is"
Contract for Sale and Purchase contracts for prgperties in the Neighborhood Stabilization
Program (NSP) for failure to obtain financing and notify the title company to return the escrow
deposits to the applicants.
OBJECTIVE: To cancel "As Is" Contract for Sale and Purchase contracts and return the
deposits in order to sell the properties to future eligible NSP applicants.
CONSIDERATION: On December 1, 2009, the Board adopted Ordinance No. 2009 -63,
establishing policies, procedures, and a standard form to be used by the Board when selling and
conveying real property under the NSP.
The Board approved standard form "As Is" Contract for Sale and Purchase (Contract) was used
for two transactions: (1) Jerome Beldorin and Zilaine Beldorin- Beauplan and (2) Ruth D. Parlier
where the parties were pre - qualified for financing.
Ordinance No. 2009 -63, requires $1,000 in earnest money deposit to be given at the time of
Contract execution. Mr. & Mrs. Beldorin's escrow deposit is 51,000.00 and Ms Parlier's escrow
deposit is 53,381.00. Both transactions met the minimum deposit requirement, but closing dates
had not been scheduled because financing could not be obtained.
Staff believes that both Mr. & Mrs. Beldorin and Ms. Parlier have used reasonable diligence to
obtain financing. Additionall,_ there are presently qualified buyers waiting to purchase both the
NSP home...
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: Lines 42 -43 of the Contracts state:
"If Buyer does not deliver to Seller written notice of Loan Approval by Loan Approval Date,
Seller may cancel this Contract by delivering written notice (Seller's Cancellation Notice) to
Buyer, but not later than seven (7) days prior to Closing."
Lines 45 -46 of the Contracts state:
"If Buyer has used reasonable diligence but does not obtain Loan Approval by Loan Approval
Date, and thereafter either party elects to cancel this Contract, the deposit(s) shall be returned to
the buyer."

The Board may cancel both Contracts for the failure to obtain financing. If the Board finds that
the Buyer has used reasonable diligence to obtain financing it may return the deposit to the
Buyer. This item is legally sufficient and requires a majority vote for Board action. - JBW
RECOMMENDATION: That the Board of County Commissioners approve and authorize staff
to notify the Beldorins and Ms. Parlier of the County's cancellation of "As Is" Contract for Sale
and Purchase contracts for properties in the Neighborhood Stabilization Program (NSP) and

AMENDMENT TO SALE AND PURCHASE CONTRACT
THIS AMENDMENT Is entered into by and between COLLIER COUNTY, a Political
Subdivision of the State of Florida, (Seller) and RUTH DARLENE PARLIER, a single
woman, (Purchaser). Purchaser and Seller entered into that certain "As Is" Contract for Sale
and Purchase effective as of December 29, 2010 (the "Agreement'). Purchaser and Seller wish
to amend the Agreement with the following terms and conditions:
1. Line 15 of the Agreement is revised to reflect that the Purchase Price shall be
Ninety Two-Thousand and no /100 Dollars ($92,000.00).
2. Line 20 of the Agreement is revised to reflect that the 1st Mortgage amount is
Sixty-Eight Thousand, Three - Hundred, Seventy -Nine and No /100 Dollars ($68,379.00).
3. Line 21 of the Agreement Is revised to reflect that the 2nd Mortgage Amount
shall be Twenty - Thousand, Two-Hundred Forty and no /100 Dollars ($20,240.00).
4. Lines 115 through 117 of the Agreement are revised to read: "Buyer will
receive $27,600 from the Collier County Neighborhood Stabilization Program. Buyer will
use $20,240.00 (22% of the purchase price) for principal reduction and the remaining
balance of $7,360.00 will be used for closing costs, prepaid items, and any discount
points associated with the first mortgage transaction,"
Except as expressly provided herein, the Agreement between the Purchaser and the
Seller remains In full force and effect according to the terns and conditions contained therein,
and said terms and conditions are applicable hereto except as expressly provided otherwise
herein.
