Recommendation to adopt a Resolution to hold a public I hearing to consider vacating a portion of State
Road 29 (Copeland Avenue South), Application No. VACS,- PL20120001606.
OBJECTIVE:
Pursuant to Florida Statute 336.09, the Board of County
to consider the vacation of a portion of any public road.
CONSIDERATIONS:

The Engineering Services Department has received a re q est from A. Rony Joel, PE, as Agent for the
adjacent property owner to vacate a portion of Copeland Avenue South. The proposed vacation is for a
portion of Copeland Avenue South which is not utilized as roadway. The hearing will be advertised in
a local paper of general circulation pursuant to Statute 336.10, and the adjoining property owners will
be given notice as well.
FISCAL IMPACT:
The application fee of 52,000.00 covers staff review and
for advertising fees.
GROWTH MANAGEMENT IMPACT:
There is no Growth Management Impac-_.
LEGAL CONSIDERATIONS:
This item has been reviewed by the County Attorney, is
for approval. This is the first step in a two step statutory 1

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, TO DECLARE A PUBLIC HEARING
FOR CONSIDERATION OF PETITION VAC- PL20120001606, TO
DISCLAIM, RENOUNCE, AND VACATE THE COUNTY AND PUBLIC
INTEREST IN A PORTION OF STATE ROAD NO. 29 (COPELAND
AVENUE, SOUTH) BEING A 200 -FOOT PUBLIC ROAD RIGHT -OF-
WAY LOCATED IN SECTION 23, TOWNSHIP 53 SOUTH, RANGE 29
EAST, COLLIER COUNTY, FLORIDA, MORE SPECIFICALLY SHOWN
IN EXHIBIT "A."
WHEREAS, Petitioner, A. Rony Joel, has requested that a public hearing be held
pursuant to Sections 336.09 and 336.10, Florida Statutes, to consider disclaiming, renouncing,
and vacating the County and public interest in a. portion of State Road 29, also known as
Copeland Avenue South, which is a 200 -foot public road right -of -way more specifically
described in Exhibit "A," attached hereto; and
WHEREAS, Petitioner does hereby request that the Board of County Commissioners
take appropriate action, including the adoption of a resolution setting the date and time of a
public hearing to consider disclaiming, renouncing, and vacating the County's interest in the
above described right -of -way.
NOW, THEREFORE, BE IT RESOLVED BY BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that pursuant to Section 336.09,
Florida Statutes, in a regular session of the Board of County Commissioners, a public hearing to
consider disclaiming, renouncing and vacating the County's interest in the above described right -
of -way will be held on October 9 2012, at 9:00 a.m., or as soon thereafter as practical, in the
Boardroom, 3rd Floor, Administration Building, Collier County Government Center, 3299
Tamiami Trail East, Naples, Florida.
THIS RESOLUTION ADOPTED after motion, second and majority vote favoring
same, this 1 lth day of September, 2012.

Commencing at the Baseline of Survey P.T. Station 170 +23.48, according to the above referenced
Right —of —Way Map. thence South 89'36' 16" East, a distance of 50.00 feet to the intersection of the east
right —of —way line of said State Road No.29 (having a 100 —foot wide right —of —way) and which intersection is
the Point of Beginning; thence along said east right —of —way line the following 2 courses; (1) continuing
