EXECUTIVE SUMMARY
Recommendation to accept a Donation Agreement and a Utility Easement from
the Foxfire Community Association of Collier County, a Florida non - profit
corporation, to the Collier County Water -Sewer District for installation and
maintenance of a monitoring well and for access on, over and across the
Foxfire Golf Course, at an estimated cost not to exceed $100, Project Number
74401.
OBJECTIVE: The public purpose is to acquire easements for access, construction,
and maintenance of a groundwater monitoring well required for a Florida Department
of Environmental Protection permit modification to reduce ground water monitoring
requirements for the reclaimed water system.
CONSIDERATIONS: The Collier County Wastewater Department currently
oversees 28 groundwater monitor wells that are located in various areas throughout
the county including the North, South and Pelican Bay areas. By rule, monitor wells
are required in areas that receive spray irrigation effluent and do not have lined
ponds. Many of these areas include golf courses. The county has been monitoring
many of the wells since the early 1990's. The sampling and analysis has increased
on some of the wells, specifically the South end of the sewer district over the years
to include all metals. There has been a reduction on sampling and analysis on some
of the wells specifically in the Pelican Bay area.
Staff has developed a regional ground water monitoring plan as required by Section
3 of the Florida Department of Environmental Protection (FDEP) permits for both
wastewater plants. By developing a regional ground water monitoring plan, the
county will realize a reduction of the monitoring requirements and costs associated
with the two water reclamation facilities permits.
To achieve the next phase of the regional ground water monitoring plan, staff will
include monitoring well abandonment, repairs, relocate existing wells, and install
replacement wells as needed to improve the revised monitoring well network under
the modified FDEP - permitted monitoring plan. Staff has received FDEP permit
modifications for both North and South Wastewater facilities to reduce the
groundwater monitor wells from 28 to 8 and reduce the required testing parameters
on the existing 8 wells for sampling and testing. Working with FDEP, staff has
identified which monitoring wells will be abandoned, which will remain, and what
locations new wells are required to be installed. By reducing the monitoring
requirements, permit compliance can be achieved at a lower cost.
This project is consistent with the 2008 Wastewater Master Plan update adopted by
the Board on June 24th, 2008, under Agenda Item 16G. This project is referenced in
the Wastewater Master Plan, Table 8 -1, Page 7of 7, Line 155.

It has been determined that a new ground water monitoring well is required to
replace the existing ground water monitoring well within the Foxfire Golf Course.
The existing well is approximately 15 years old and requires replacement due to
degradation of the well integrity. An easement is required for placement of, and
access to the new well.
The attached Utility Easement has been reviewed and approved by the Public
Utilities Division, and the County Attorney's Office.
A location map of the proposed Easement is attached for ease of reference.
FISCAL IMPACT: The total cost will not exceed $100 for the recording of
documents. Funding is available and is consistent with the FY12 Capital Budget
approved by the Board on September 22, 2011. Source of funds is Wastewater
User Fees, Fund 414.
The potential estimated present value cost savings based on the regional
groundwater monitoring plan, to reduce the monitoring wells will be $4,664 quarterly,
$18,656 annually, and a projected savings of $186,560 present value over the next
10 years.
GROWTH MANAGEMENT IMPACT: This project is consistent with, and furthers the
goals, objectives and policies of the Collier County Growth Management Plan.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. This
item requires a majority vote. - JBW
RECOMMENDATION: That the Board of County Commissioners of Collier County,
Florida, as the Governing Body of Collier County and as Ex- Officio the Governing
Board of the Collier County Water -Sewer District:
1. Approves and authorizes the Chairman to execute the attached Donation
Agreement and any and all othe, County Attorney's Office approved documents
related to this transaction.
2. Accepts the Easement and directs the County Manager or his designee to
proceed to acquire the Easement and to follow all appropriate closing procedures,
and to record the Easement in the Public Records of Collier County, Florida.

DONATION AGREEMENT
THIS DONATION AGREEMENT (hereinafter referred to as the "Agreement ") is
made and entered into by and between FOXFIRE COMMUNITY ASSOCIATION OF
COLLIER COUNTY, INC., a Florida non profit corporation, whose mailing address is
1030 Kings Way, Naples, Florida 34104 -4988, (hereinafter referred to as "Owner "), and
the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS
THE GOVERNING BODY OF COLLIER COUNTY AND AS EX- OFFICIO THE
GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT,
(hereinafter referred to as "County"), whose mailing address is 3335 Tamiami Trail East,
Suite 101, Naples, Florida 34112 -5356.
WITNESSETH:
. WHEREAS, County has requested that Owner convey to the County a perpetual,
non - exclusive utility easement for the purpose of access, installation, and maintenance
of a ground water monitoring well and other utility appurtenances over, under, upon and
across the lands described in Exhibit "A" (said utility easement hereinafter referred to as
the "Property "), which is attached hereto and made a part of this Agreement;
WHEREAS, Owner recognizes the benefit to Owner and desires to convey the
Property to the County for the stated purposes, on the terms and conditions set forth
herein, said terms including that no compensation shall be due and payable for the
Property requested by County; and
NOW, THEREFORE, in consideration of these premises, the sum of Ten Dollars
($10:00), and other good and valuable consideration, the receipt and sufficiency of
which is hereby mutually acknowledged, it is agreed by and between the parties as
follows:'
1. Owner shall convey the Property via a Utility Easement to County at no cost
to the County, unless otherwise stated herein.
2. County will be responsible for all repairs, maintenance, and related costs for its
above - ground and in- ground infrastructure within the easement area. This provision
shall survive Closing and is not deemed satisfied by the conveyance of Easement.
3. County has confirmed the ownership of the lands underlying the Easement to
be granted pursuant hereto, and Owner and all its related entities make absolutely no
representations or certifications with regard to same. This provision shall survive
Closing and is not deemed satisfied by the conveyance of Property.

4. Owner is aware and understands that this Agreement is subject to the
acceptance and approval by the Board of County Commissioners of Collier County,
Florida.
5. The County shall pay for all costs of recording the conveyance instrument, and
recording costs for any curative instruments, in the Public Records of Collier County,
Florida. The cost of a title commitment shall be paid by County.
6. This Agreement and the terms and provisions hereof shall be effective as of
the date this Agreement is executed by both parties and shall inure to the benefit of and
be binding upon the parties hereto and their respective heirs, executors, personal
representatives, successors, successor trustees, and /or assignees, whenever the
context so requires or admits.
7. Conveyance of the Property by Owner is contingent upon no other provisions,
conditions, or premises other than those so stated above; and the written Agreement,
including all exhibits attached hereto, shall constitute the entire Agreement and
understanding of the parties, and there are no other prior or contemporaneous written or
oral agreements, undertakings, promises, warranties, or covenants not contained
herein.
8. This Agreement is governed and construed in accordance with the laws of the
State of Florida.

to a ground water monitoring well, and other equipment or improvement appurtenant
thereto or thereunder for the purpose of constructing, operating, and mair taining water
utility facilities thereon. The easement granted herein shall constitute easements
running with the land and shall burden the lands described above.
