EXECUTIVE SUMMARY
Recommendation to approve Request for Proposal (RFP) 12 -5895 Impact Fee Study final
firm rankings and to negotiate a contract for Board approval.
OBJECTIVE: To approve the rankings of consulting firms and negotiate a contract in order to
secure a firm to provide impact fee consulting services for the next four (4) years.
CONSIDERATIONS: Due to the ongoing requirements of effectively managing the impact fee
program, which often requires the expertise of outside consultants, Collier County needed to
secure a firm to provide consulting services for impact fees. Examples of the types of services to
be provided under this contract are: impact fee update studies, impact fee indexing calculation
updates, reviews of independent and alternative fee calculations and attendance and presentations
at meetings related to impact fees and associated subject matter.
The Request for Proposal (RFP) was issued in accordance with Florida Statute 287.055,
Consultants' Competitive Negotiation Act, and was publicly advertised on May 3, 2012. Email
notices were sent to 1,394 addresses, 54 contacts downloaded the solicitation, and two (2) firms
responded by the due date of May 25, 2012.
A Selection Committee meeting was held on June 25, 2012 and after review, scoring and
discussion of the proposals, by consensus of the members, the firms were ranked as follows:
1. Tindale- Oliver and Associates, Inc.
2. Duncan Associates
GROWTH MANAGEMENT IMPACT: Impact fees provide financial resources for the
construction and/or expansion of the County's capital infrastructure, as necessary to
accommodate growth. Development is required to contribute its fair share of the cost of
providing public facilities necessitated by growth, however impact fees may not be collected in
excess of the amount reasonably anticipated to fund such improvements. Services to be provided
by the selected consultant help to ensure the fair, accurate and equitable administration of the
impact fee program.
FISCAL IMPACT: The cost of impact fee update studies and indexing are funded by the
applicable Impact Fee Trust Funds. General impact fee consulting costs are budgeted through
the Impact Fee Administration, Fund 107. The cost of studies, indexing and other impact fee
consulting services vary based on the complexity of the task. Formal impact fee update studies
are required (at least) every three (3) years and typically have ranged in cost from approximately
$60,000 for a Fire or EMS Impact Fee Update to more than $100,000 for a Road or School
Impact Fee Update study.
LEGAL CONSIDERATIONS: To limit potential objection, this item was structured to comply
with the Florida Consultants' Competitive Negotiation Act (Fl. Stat. Sec. 287.055, often referred

to as the "CCNA "). The CCNA provides that "Each agency shall publicly announce... each
occasion when professional services must be purchased..." and that "The agency shall select no
fewer than three firms deemed to be the most highly qualified to perform the required services."
The Act is silent as to when there are less than three qualified or responsive firms. In this
instance, only two firms responded to the RFP. That we received but two responses is not
surprising, in that in putting out this RFP staff learned that a number of firms that once did this
highly specialized work did not survive the Great Recession. It is the opinion of the County
Attorney that given the circumstances unique to this item, short listing the only two responsive
firms is consistent with the intent and purpose of the CCNA. Accordingly, it is the opinion of
the County Attorney that this item is legally sufficient, requiring majority support for Board

RECOMMENDATION: That the Board of County Commissioners approve the recommended
rankings for RFP No. 12 -5895 and authorize contract negotiations with the top ranked firm, Tindale-
Oliver and Associates, Inc. Following negotiations, this matter will be brought back to the Board to
seek approval of the resultant contract. In the event that agreement cannot be reached with the top - ranked
firm, the Board authorizes negotiation in accordance with Florida Statute 287.055.
