I understand a representative of EMS will be at this meeting to address this response time issue. From a planning standpoint the original plan had a Park Site located at the corner of Fiddler's Creek Parkway and Sandpiper,with a lake to the north and a waterway to the east. This park would have also acted as visual open space in the center of the development and when we purchased,we relied on this location convenient to our homes. Board members stated that many of the concerns raised were legitimate, but it can not always be a win-win situation for everyone involved. My purpose in contacting you is to ask you to take into consideration the issues that were raised in the statement I made today which is copied below. Linda Viegas Fiddler's Creek CDD2 Board Member Good Morning, My name is Linda Viegas, I am a year round Florida resident, my husband and I live in the Aviamar section of Fiddler's Creek which abuts Sandpiper Drive. When we bought our lot in 2012 we did our due diligence and were told that an assisted living facility was planned on the other side of Sandpiper, and there would be two entrances to Fiddler's Creek from US41: Sandpiper Drive and Fiddler's Creek Parkway.The application you are reviewing now changes the assisted living area to a commercial site and eliminates the Fiddler's Creek Parkway entrance. The new proposed entrance on the submitted plan is into the Estancia village. We were told at an April 17th Town Hall meeting at Fiddler's Creek that the Developer is working to sell the Estancia village as a separate community which would not be part of Fiddler's Creek eliminating that second entrance. Therefore, the only entrance to Fiddler's Creek from US41 will be Sandpiper Drive. A road that is now planned to also be the main entrance to a grocery store anchored commercial site, a grocery store that has another location less than 4 miles away. A grocery store that we were told is going to dig up Sandpiper in order to lay down "heavy duty pavement" to support the 18 wheelers that will be using Sandpiper for their deliveries, and for their trash trucks. A grocery store that has a billboard sign at all their entrances for their current stores. That means the only entrance to Fiddler's Creek from US41 will have a billboard sign listing a grocery store, 1 and whatever other tenants come into that commercial site.That is not what we were told would be the signage for the main US 41 entrance into Fiddler's Creek when we bought our lot. There is no traffic light at this sole US41 entrance, and there will not be one for years. The Florida Department of Transportation requires traffic studies and warrants before a traffic light will be considered. It takes years for those studies to be done and for the light to be installed. The cost to install the traffic light when it is finally done, and to maintain Sandpiper will be borne by the Fiddler's Creek residents. Since the need for both will be significantly increased due to the use of the road by the grocery store, they should contribute to the costs. In addition, in Section 18 of the Vested Rights Determination it states that the Developer is obligated to provide the traffic signal. Therefore the Developer should pay for the traffic signal. Sandpiper Drive is a public road which means the additional traffic coming into Sandpiper has a right to ask to use it as a short cut to 951. We were told by the Developer in the town hall meeting that the Fiddler's Creek Parkway entrance was being eliminated so that short cut for the public could not be used. Now the likelihood that the public will use Sandpiper as a short cut will increase. Even WINK news during their traffic segment has recommended the public use Fiddler's Creek Parkway to Sandpiper as a short cut from 951 to US41 and vice versa when one of those highways has a blockage. On the plans reviewed at the Fiddler's Creek Town Hall meeting, the proposed US41 entrance directly into the commercial site says Right in/Right out. I was told by the engineer that even though there is a median cut there,the Florida Department of Transportation would not allow the westbound traffic to cross over through the median.That means it is safe to estimate the vast majority of both the eastbound and westbound traffic for the grocery store and other commercial tenants will be using the Sandpiper entrance. The plans also show a road connecting the Estancia Village to the commercial site that goes to Sandpiper allowing a projected 1,500 additional unit owners access to Sandpiper. There are three Rezone Findings in your staff report which I reviewed that I would like to address. Specifically traffic, living conditions, and property value.Your staff report states Fiddler's Creek is considered vested for traffic impacts, but I respectfully suggest the potential traffic increases based on this proposed commercial site, and the fact there is only one entrance into Fiddler's Creek from US41 based on the new proposal, have not been considered. Since the commercial site is inside Fiddler's Creek and will be using Sandpiper Drive which is inside Fiddler's Creek, traffic will be increased by more than just the approved 6,000 units in Fiddler's. The proposed change will create and excessively increase traffic congestion on Sandpiper and on US41 especially at peak times (during season, holidays, and sporting events) and including construction phases of the development particularly when Sandpiper is being dug up and paved with heavy duty pavement. The living conditions of the Aviamar residents will be adversely impacted by this commercial site due to the noise of truck and vehicular traffic, especially from the beep, beep when trucks back up, the constant glow of parking lot and store lights, and as already mentioned the increased traffic at the one entrance/exit a large number of Fiddler's Creek residents already use. Living conditions will be most impacted in season, during holidays and major sporting events when the commercial site will be most active. I would ask the Board if they would want to live adjacent to a grocery store and commercial site, or if they feel that will adversely impact property values. I am told by realtors that are very familiar with Fiddler's that property adjacent to shopping areas is less desirable and that my property value will be negatively impacted. 2 I respectfully ask that the Board delay approval of this application and take a closer look at the traffic implications, the living conditions, and the effect on property values of Aviamar residents that will be impacted by putting a grocery store anchored commercial site in this location. Per Commissioner Bill McDaniel, the Collier County Interactive Growth Model (CIGM) will be available this month to use for zoning applications so I would request that model be used for this rezoning to assess the current impacts based on all the other approved growth projects in the area. If this Board decides not to delay approval and does move forward with this application, at a minimum I would request the following be added to the PUD: • The dumpsters for the commercial site must be placed as far away from the Aviamar residents as possible to diminish the noise of trucks when backing up and emptying the dumpsters. Also to keep any potential rodents away from Aviamar. • All delivery bays for the grocery store and other retailers must be placed as far away from the Aviamar residents as possible to diminish the noise of the delivery trucks when backing up and making deliveries. • All delivery trucks and trash trucks must use the direct entrance into the commercial site from US41 rather than Sandpiper Drive. • All deliveries and trash removal must be done after 8 a.m. and before 10 p.m. • The Developer (who is obligated per the Vested Rights Determination), owner, grocery store, and all commercial site tenants must contribute to the cost of the traffic light and the maintenance of Sandpiper Drive. Its proximity to medical facilities and amenities for food and products is already ideal (all within 2 miles). The proposed rezoning to allow a Publix on 41 abutting the property is our estimate is poor. It will increase traffic in the area and make the large residential region susceptible to challenges that nearly all of us would want to avoid. In fact, many of us moved here to leave this level of traffic and inconvenience. Many of us are older and as such would likely reconsider our decisions if such a project proceeds. Furthermore, I would understand if access to a resource like Publix was a 20 minute commute. But in fact, within 2 miles is a Walmart and another mile further is another Publix. And in the other direction on the island (Marco) is another Publix making access to such a store convenient and close. It makes no sense to change and offer yet another. My purpose in contacting you is to ask you to take into consideration the issues that were raised in the statement I made today which is copied below. Linda Viegas Fiddler's Creek CDD2 Board Member Good Morning, My name is Linda Viegas, I am a year round Florida resident, my husband and I live in the Aviamar section of Fiddler's Creek which abuts Sandpiper Drive. When we bought our lot in 2012 we did our due diligence and were told that an assisted living facility was planned on the other side of Sandpiper, and there would be two entrances to Fiddler's Creek from US41: Sandpiper Drive and Fiddler's Creek Parkway. The application you are reviewing now changes the assisted living area to a commercial site and eliminates the Fiddler's Creek Parkway entrance. The new proposed entrance on the submitted plan is into the Estancia village. We were told at an April 17th Town Hall meeting at Fiddler's Creek that the Developer is working to sell the Estancia village as a separate community which would not be part of Fiddler's Creek eliminating that second entrance. Therefore, the only entrance to Fiddler's Creek from US41 will be Sandpiper Drive. A road that is now planned to also be the main entrance to a grocery store anchored commercial site, a grocery store that has another location less than 4 miles away. A grocery store that we were told is going to dig up Sandpiper in order to lay down "heavy duty pavement" to support the 18 wheelers that will be using Sandpiper for their deliveries, and for their trash trucks. A grocery store that has a billboard sign at all their entrances for their current stores. That means the only entrance to Fiddler's Creek from US41 will have a billboard sign listing a grocery store, and whatever other tenants come into that commercial site. That is not what we were told would be the signage for the main US 41 entrance into Fiddler's Creek when we bought our lot. 1 There is no traffic light at this sole US41 entrance, and there will not be one for years. The Florida Department of Transportation requires traffic studies and warrants before a traffic light will be considered. It takes years for those studies to be done and for the light to be installed. The cost to install the traffic light when it is finally done, and to maintain Sandpiper will be borne by the Fiddler's Creek residents. Since the need for both will be significantly increased due to the use of the road by the grocery store, they should contribute to the costs. In addition, in Section 18 of the Vested Rights Determination it states that the Developer is obligated to provide the traffic signal. Therefore the Developer should pay for the traffic signal. Sandpiper Drive is a public road which means the additional traffic coming into Sandpiper has a right to ask to use it as a short cut to 951. We were told by the Developer in the town hall meeting that the Fiddler's Creek Parkway entrance was being eliminated so that short cut for the public could not be used. Now the likelihood that the public will use Sandpiper as a short cut will increase. Even WINK news during their traffic segment has recommended the public use Fiddler's Creek Parkway to Sandpiper as a short cut from 951 to US41 and vice versa when one of those highways has a blockage. On the plans reviewed at the Fiddler's Creek Town Hall meeting, the proposed US41 entrance directly into the commercial site says Right in/Right out. I was told by the engineer that even though there is a median cut there, the Florida Department of Transportation would not allow the westbound traffic to cross over through the median. That means it is safe to estimate the vast majority of both the eastbound and westbound traffic for the grocery store and other commercial tenants will be using the Sandpiper entrance. The plans also show a road connecting the Estancia Village to the commercial site that goes to Sandpiper allowing a projected 1,500 additional unit owners access to Sandpiper. There are three Rezone Findings in your staff report which I reviewed that I would like to address. Specifically traffic, living conditions, and property value. Your staff report states Fiddler's Creek is considered vested for traffic impacts, but I respectfully suggest the potential traffic increases based on this proposed commercial site, and the fact there is only one entrance into Fiddler's Creek from US41 based on the new proposal, have not been considered. Since the commercial site is inside Fiddler's Creek and will be using Sandpiper Drive which is inside Fiddler's Creek, traffic will be increased by more than just the approved 6,000 units in Fiddler's. The proposed change will create and excessively increase traffic congestion on Sandpiper and on US41 especially at peak times (during season, holidays, and sporting events) and including construction phases of the development particularly when Sandpiper is being dug up and paved with heavy duty pavement. The living conditions of the Aviamar residents will be adversely impacted by this commercial site due to the noise of truck and vehicular traffic, especially from the beep, beep when trucks back up, the constant glow of parking lot and store lights, and as already mentioned the increased traffic at the one entrance/exit a large number of Fiddler's Creek residents already use. Living conditions will be most impacted in season, during holidays and major sporting events when the commercial site will be most active. I would ask the Board if they would want to live adjacent to a grocery store and commercial site, or if they feel that will adversely impact property values. I am told by realtors that are very familiar with Fiddler's that property adjacent to shopping areas is less desirable and that my property value will be negatively impacted. I respectfully ask that the Board delay approval of this application and take a closer look at the traffic implications, the living conditions, and the effect on property values of Aviamar residents that will be 2 impacted by putting a grocery store anchored commercial site in this location. Per Commissioner Bill McDaniel, the Collier County Interactive Growth Model (CIGM) will be available this month to use for zoning applications so I would request that model be used for this rezoning to assess the current impacts based on all the other approved growth projects in the area. If this Board decides not to delay approval and does move forward with this application, at a minimum I would request the following be added to the PUD: • The dumpsters for the commercial site must be placed as far away from the Aviamar residents as possible to diminish the noise of trucks when backing up and emptying the dumpsters. Also to keep any potential rodents away from Aviamar. • All delivery bays for the grocery store and other retailers must be placed as far away from the Aviamar residents as possible to diminish the noise of the delivery trucks when backing up and making deliveries. • All delivery trucks and trash trucks must use the direct entrance into the commercial site from US41 rather than Sandpiper Drive. • All deliveries and trash removal must be done after 8 a.m. and before 10 p.m. • The Developer (who is obligated per the Vested Rights Determination), owner, grocery store, and all commercial site tenants must contribute to the cost of the traffic light and the maintenance of Sandpiper Drive. We are opposed to proposed rezoning the parcel along R 41 to permit the construction of the Publix commercial development. We see no need to have another Publix development abutting our property and are particularly concerned about the permanent safety, security and privacy hazards that allowing such a rezoning would cause for us and our fellow residents here at Fiddler's. Trying to cross over to R 41 from the Fiddler's exit is a life- threatening driving risk that we try to avoid by exiting from the long way around Collier Blvd side of Fiddler's. There's no light at the R 41 exit now and none planned for many years. Rational planning would dictate that traffic light safeguards would be a precondition to any commercial development proposal. Lights are needed now. Having this immediate safety responsibility in the hands of a Federal agency that waits for years to compile accident and fatality statistics to justify a future installation defies not only public safety needs but shows no common sense. Driving dangers and traffic congestion are of paramount concern to us. Layer on the immediate dangers of construction disruptions and permanent future impairments to our privacy, security and property, this Publix development rezoning proposal screams for a denial. I'll add a personal affront to these concerns. Isn't it a violation of the trust we placed in Fiddler's when we invested in a home here, to have the Developer's promised plans for a second clubhouse and spa, golf course and tennis courts and park space amenities rescinded in favor of this contradictory development rezoning proposal. That breach of faith violation alone should be sufficient grounds to disallow this Publix development on pure fairness to Fiddler's homeowners based on bad faith by Fiddler's developers. We respectfully appreciate the consideration you will give to our objections and ask that you act to deny this R 41 Publix rezoning proposal. Sincerely. My major concern with this request, as shown on their revised Master Plan, is their deletion of the un-built extension of Fiddler's Creek Parkway from where it now terminates out to State Road 41. Over 2300 current property owners assumed this collector road and gated entrance would be completed. The Fiddler's Creek Parkway Extension would be the closest entrance to 951/41 intersections and I believe the shortest response time for "EMS" for parts of the community, therefore the most desirable. I understand a representative of EMS will be at the this meeting to address this response time issue. 1 From a planning standpoint the original plan had a wonderful Park Site located at the corner of Fiddler's Creek Parkway and Sandpiper , with a beautiful lake to the north and a waterway to the east. This Park would of also acted as visual open space in the center of the development and when we purchased we relied on this location convenient to our home. I would hope that in your review and approval you will look out for all of us residents and consider the Original Master Plan as it relates to major roadways, EMS response time, parks and open green space. We want the developer to complete our community as fast as possible and move on so that we can control the community and do what's best for the resident's. Fiddler's Creek is a great community and was designed originally with care to be the Premier Community in the Region. Please look at the original master plan and compare to the proposed plan. Realistically, I think he would have a problem making it a mobile home park as the area is well below the required Base Flood Elevation. Back when I was with the county we looked at this site as an option for FEMA trailer just in case the need ever arose. FEMA said that they could not use that site due to the low elevation. One option they could consider is a high end Motor Coach park similar to Pelican Lakes. Regardless, eventually something will be build there and I definitely prefer it be something decent and somewhat compatible with Fiddler's. As I mentioned during the meeting I still think the density is too high for the Coastal High Hazard Area (CHHA). Currently they have an existing density for MH of just over 7 units/acre. They are proposing to reduce it to approximately 6.4 units/acre. That is still too high considering that the CHHA allows for only 3 units/acre. Fiddler's Creek is 3.55 units/acre. 1 Of course their claim is that they current density is"grandfathered" by the clause in the GMP. I not sure that is entirely correct as they are seeking a complete rezoning to PUD with new development standards. My assessment is that the BCC could reduce the density to a more acceptable level. One option they may want to explore is putting lower units along the fence line especially along the Bent Creek Village property line. Maybe consider 1 story over parking along the fence line. Yes,the tree damage was a dumb move on the developer's part and caused more unneeded anxiety. Unfortunately,the messages going out to the community is raising even more anxiety and frankly is a stretch. This development will not destroy the harmony of Fiddler's. I live on Mulberry Lane away from the proposed development and frankly other than the first few houses on the south end of Mulberry,there will be little to no impact. It is the area previously referred to as Diamond Shores. In any case they are holding a NIM on May 10th at 5:30 pm at the South Regional Library.They are proposing to change zoning from Mobile Homes to Residential with either 130 single family or 280 multi-family units. The multi-family would be at least three story buildings, probably plus roof eaves. In any case,the developer requested an easement to cross Fiddler's Creek CDD and Pepper Tree Village Association property to tie in to a potable water main. We both said no. We said no because this developer hat racked 50 ficus trees along a landscape buffer of Fiddler's Creek 1 CDD and the CDD is now faced with the cost of removal and replacement of the trees.The developer and the CDD are in a dispute over his actions. Notwithstanding his actions above, he never once approached Fiddler's Creek with an early look at his plans.The residents are totally against the increased density of a three or four story milti-family units bordering our community. In addition we don't want to have to "see" a three story building when we look that direction. When and if he moves forward with the zoning request, he will need a super majority of the BCC for approval. I trust that you will closely monitor the opinions of the residents of Fiddler's Creek in opposing any multi-family buildings on that tract. I am not an engineer but the County has very qualified staff to check and evaluate this PUD application. It seems he is relying a lot here on an assertion that Mr. Albaugh who is the Developer will have to bring in loads of fill to bring the level up to above flood level by the required amount. The regulation, as I understand it, requires that the "first" floor of the dwelling be a certain number of feet above sea level. Mr. Albaugh will accomplish this by puffing the first floor of the living area above the garages, thus no fill. I am certain that between Mr. Yovanovich, Patrick Vanesse (Engineer) and Eric Johnson on County Staff, they can more factually inform you concerning Mr. Bury's assertions. I would seek their comments before I would schedule any meeting with this guy. I do not agree with his assertions, assumptions or contentions that the buildings proposed would"tower" over the fence line. The revised PUD application commits to a max height of 45 feet above ground period around the perimeter. This development given its recent modifications, is a MUCH better alternative than another trailer park, which he could put in there right now if he wanted to given its current zoning. I also do not agree that"many" of his neighbors object to what is now being proposed after the modifications resulting from the first NIM. He is way off base. The revised/amended plan will reduce the density some 60 units from what he could build. I am absolutely certain that the County, the S WFWMD and others will do a thorough review of this application for compliance prior to approval. I am just suggesting that you get staff input/rebuttal prior to meeting with him. Bob Slater(president of Bent Creek HOA), myself(president of Pepper Tree HOA) and Dave Yates (president of Mulberry Row HOA)have all attended the NIMs, and endorsed the revised plans. IF (big if)the revised PUD application violates current 1 zoning, environment or water management regulations, I am sure that these will be pointed out and/or corrected before or during the Planning Commission and BCC hearings. I've been following it closely, and just drove back there to see how it looked, but couldn't get any further than the wood wall that separated the property. I know you've been working hard, and I also attended that NIM. I really like the project and feel it will definitely add a new and positive demention to that area. Do you know if they will address the road along Port au Prince? It was mentioned about a year ago, and at that time I also seem to remember they would improve the road, add some lights and landscaping, and really give a new appearance to that front area. Do you have any word on that? I've already talked to the developers representative, and said I think they are doing a great job in listening to the surrounding community and working with them. This is the proposed Antilles development directly adjacent to Fiddler's Creek which used to be the old trailer park. Over the last year and a half I have worked with Mr. Dennis Albaugh and his team to modify their original plan which would have placed three or four story buildings along the boundary with Fiddler's Creek. At their first NIM, many residents of Fiddler's Creek as well as myself, attended and voiced our objection to that concept and having to look at the back of tall buildings. Subsequent to that NIM I had several meetings with Mr. Albaugh and eventually he revised his concept and reduced the number of units but more importantly limited the height of the buildings to 35 feet around Fiddler's boundary. Additionally, he agreed to a greatly enhanced buffer along the property line which will effectively shield all view of their buildings. A second NIM was held and also well attended and there was no one there speaking in opposition to the revised concept. I attended the Planning Commission hearing on the petition and spoke in favor. The petition received unanimous support from the Planning Commission. The item is on the Summary Agenda and hopefully it will stay there.
