EXECUTIVE SUMMARY
Recommendation to provide after-the-fact approval for the submission of an Emergency
Watershed Protection Program grant application to the US Department of Agriculture, Natural
Resources Conservation Services to address the existence of storm related debris in Collier
County waterways and to maintain an appropriate conveyance system for an adequate flood
protection level of service (LOS), in the amount of $6,476,678.18 with an estimated required local
match in the amount of $1,962,629.75.
OBJECTIVE: To receive after-the-fact approval from the Board of County Commissioners to submit
an Emergency Watershed Protection Program grant application to the US Department of Agriculture,
Natural Resources Conservation Services to address the existence of storm related debris in Collier
County waterways and to maintain an appropriate conveyance system for an adequate flood protection
level of service (LOS). Collier County CMA #5330 Grant Coordination requires that the Board of
County Commissioners approve all grant applications.
CONSIDERATIONS: On April 6, 2018, the Collier County Capital Project Planning, Impact Fees and
Program Management, was notified that funds have become available through the US Department of
Agriculture, Natural Resources Conservation Service, with a very limited timeframe to provide all
necessary documentation.
The Emergency Watershed Protection Program allows communities to address serious and long -lasting
damages with the flexibility to act quickly to help local communities cope with adverse impacts
resulting from natural disasters. Emergency Watershed Protection does not require a disaster
declaration by federal or state officials for program assistance to begin, but ultimately partial funding
must be provided by the state Legislature.
Collier County CMA #5330 authorizes the County Manager to approve the submittal of grant
applications with subsequent Board of County Commissioners action at the next available Board
meeting to ratify the approval as “after-the-fact.”
FISCAL IMPACT: If the grant request is awarded, the anticipated grant funding will be
$6,476,678.18 with an estimated required local match of $1,962,629.75 available in the Stormwater
Capital Fund 325. Source of match funds are transfers from the General Funds.
GROWTH MANAGEMENT IMPACT: The proposed construction projects are in accordance with
the goals, objectives, and policies of all applicable sections of the Stormwater Management and the
Conservation and Coastal Management elements of the Growth Management Plan.
LEGAL CONSIDERATIONS: The Board will have the opportunity to accept or reject the funds if the
grant is approved. Accordingly, this Office has no issue with respect to the legality of this request,
which is appropriate for Board action and requires a majority vote for Board action. -JAK

Assistance and Real Property Acquisition Policies Ac1 of

treatment of persons displaced or whose property is

Accordingly, by accepting this award the corporation recipient acknowledges: ( I ) that it does not have a Federal tax
delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which alljudicial
and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to
an agreement with the authority responsible for collecting the tax liability, and (2) that it has not been convicted ofa
felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debaning
official ofthe USDA has considered suspension or debarment ofthe recipient corporation based on these convictions
and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests ofthe
Govemment. If the recipient fails to comply with these provisions, the agency will annul this agreement and may recover
any funds the recipient has expended in violation ofthe above cited statutory provisions.

Application for Federal Assistance, for Hurricane lrma Debris Removal from Collier County
waterways, in the amount of S8,439,307.93
The Capital Project Planning, lmpact Fees & Program Management Division is submitting an appllcation
to USDA, Natural Resources Conservation Services in the amounl of 56,476,678.L8, for Federal Assista nce,
in order to address the existence of storm related debris in Collier County waterways and to maintain an
appropriate conveyance system for an adequate flood protection level of service (LOS), a matter of public
health, safety and welfare.
There is an estimated cost-share required for this application in the amount of S f ,962,629.75. Source of
match funds are ad valorem taxes and are available within Stormwater Capital Fund (325).
The funding opportunity was announced on April 6, 2018 with a due date of less than one week. Due to
the short turnaround, we are requesting that the County Mana8er approve the application for submittal
followed by after the fact approval by the Board of County Commissioners at the May 22,?OLB SCC
meeting.
