HEARING EXAMINER DECISION
PETITION NO. VA-PL20170003867 — Steven and Amanda Boge request a variance from
Section 4.02.01.A of the Collier County Land Development Code, to reduce the minimum
rear yard setback from 75 feet to 40.41 feet to the existing detached garage for the
residential dwelling structure on property in the Estates Zoning District located on the
north 1/2 of Tract No. 103, Golden Gate Estates Unit No. 35 in Section 7, Township 49
South, Range 26 East, Collier County, Florida.
DATE OF HEARING: May 10, 2018
STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant and the
recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section
9.04.03 of the Land Development Code has been met and the petition should be approved.
ANALYSIS:
One letter of objection was received and no members of the public attended this meeting other
than the applicant.
The existing platted lot has frontage on two streets and is considered a corner lot. Corner lots
require a front yard setback along both frontages while the remaining setbacks are considered
side yard setbacks; rear setback standards are not applied.
The existing structures are within the north one-half of the lot. The owner intends to split this lot
into two separate lots. This would result in the southern portion becoming a corner lot, and the
northern portion, where the existing structures exist, would become a single frontage lot.
As a single frontage lot, there would be a change to one of the side yards applied to the northern
lot. The previous allowed side yard setback of thirty-feet would become a rear yard required to
have seventy-five feet.
As a result, one existing structure would be within the seventy-five-foot setback, and the basis
for this variance is to allow that structure to remain as shown on Exhibit"A".
DECISION:
The Hearing Examiner hereby approves Petition No. VA-PL20170003867 filed by Steve and
Amanda Boge, for a variance from LDC Section 4.02.01.A to reduce the minimum rear yard
setback from 75 feet to 40.41 feet to the existing detached garage for the residential dwelling

structure on property located at 6411 Sable Ridge Lane, Naples, Florida, as shown in the Survey
Sketch attached as Exhibit"A", and as subject to the condition(s) set forth below.

LEGAL DESCRIPTION: Tract No. 103, Golden Gate Estates, Unit No. 35, according to the
Plat thereof recorded in Plat Book 7, page 35, of the Public Records of Collier County, Florida.
CONDITIONS:
1. All other applicable state or federal permits must be obtained before commencement of
the development.
2. This variance is for the existing structure as shown on Exhibit "A". All future structures
will conform to the standards of the Land Development Code.

any way create any rights on the part of the applicant to obtain a permit from a state or federal
agency and does not create any liability on the part of the county for issuance of the permit if the

agency or undertakes actions that result in a violation of state or federal law.
APPEALS:
This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as
amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners
or the Board of Zoning Appeals, as appropriate. Appeals must be filed within 30 days of the date
the Hearing Examiner Decision is rendered.
