EVALUATION CRITERIA
Pursuant to LDC section 10.08.00 and Chapter 3 C.1 of the Administrative Code, staff’s recommendation
to the reviewing body shall be based upon a finding that the granting of the conditional use will not
adversely affect the public interest and that the specific requirements governing the individual conditional
use, if any, have been met. Further, satisfactory provision and arrangement have been made concerning
the following matters, where applicable.
On a separate page, provide a narrative statement describing a request for a conditional use
and a detailed response to the criteria listed below. Specify how and why the request is
consistent with each of the criteria.
a.Describe how the project is consistent with the Collier County Land Development Code and Growth
Management Plan. Include information on how the request is consistent with the applicable section
or portions of the Future Land Use Element.
b.Describe the existing or planned means of ingress and egress to the property and proposed structure

Residential Multi-Family-6 (RMF-6) Zoning District and Urban Residential Subdistrict Future Land Use
Designation. The subject property consists of ± 1.9 acres located at the northeast corner of the
intersection of School Drive and Delaware Avenue East.
a. Describe how the project is consistent with the Collier County Land Development Code and Growth
Management Plan. Include information on how the request is consistent with the applicable section
or portions of the Future Land Use Element.
Response: The RMF-6 District permits churches as a Conditional Use. The application and proposed
master plan identifies all the required elements for a conditional use, as required by the LDC.
b. Describe the existing or planned means of ingress and egress to the property and proposed structure
thereon with particular reference to automotive and pedestrian safety and convenience, traffic flow
and control, and access in case of fire or catastrophe.
Response: The means of ingress and egress to the property are currently proposed along Delaware
Avenue East. Weekday vehicular and pedestrian traffic control/access shall likely remain the same
with the proposed land use being sought.
c. Describe the effect the conditional use will have on neighboring properties in relation to noise, glare,
economic impact, and odor.
Response: The proposed church will have a minimal effect on neighboring properties most days of
the week. The majority of traffic/trips are proposed during worship services on Tuesday and
Saturday evenings at 7:30p.m. and again on Sunday afternoons at 4:00p.m. Landscape buffers and
water management areas adjacent to existing residential land uses/zoning will be utilized to reduce
any potential for noise or glare.
d. Describe the site’s and the proposed use’s compatibility with adjacent properties and other properties
in the district.
Response: The subject property is bordered to the north, east, south and west by single-family and
mobile home residential land uses and zoning; adjacent to and, opposite existing right-of-ways.
School Drive and Delaware Avenue East both directly border the subject property. The RMF-6 District
permits Churches as a Conditional Use. Although the property could be developed with a variety of
residential uses, its location at an intersection, the church’s membership being local to the area and
its mission to provide a place of worship to the existing community make the property uniquely
suited for the development of a church. It is the applicant’s contention and vision that the property

is more suited for a non-residential land use that will fit into the fabric of the neighborhood while
meeting the design and development standards of Collier County and the Immokalee community.
e. Please provide any additional information which you may feel is relevant to this request.
Response: The subject property is currently owned by the applicant, and members of the existing
Church are all local to the region. Upon the successful completion of the conditional use application,
the proposed church will be found consistent and permitted per the requirements of the LDC and its
design and development standards.
Future Land Use Element Provisions
Policy 5.4:
New developments shall be compatible with, and complementary to, the surrounding land uses, as set
forth in the Land Development Code (Ordinance 04-41, adopted June 22, 2004 and effective October 18,
2004, as amended).
The RMF-6 District permits churches as a Conditional Use. The application and proposed master plan

Policy 7.1
The County shall encourage developers and property owners to connect their properties to fronting
collector and arterial roads, except where no such connection can be made without violating intersection
spacing requirements of the Land Development Code.
The means of ingress and egress to the property are currently proposed at Delaware Avenue East.
Policy 7.2
The County shall encourage internal accesses or loop roads in an effort to help reduce vehicle congestion
on nearby collector and arterial roads and minimize the need for traffic signals.
An internal access loop roadway is not possible for this small of a site. The applicant has, however,
planned for internal circulation provided within the design of the master concept plan.
Policy 7.3
All new and existing developments shall be encouraged to connect their local streets and their
interconnection points with adjoining neighborhoods or other developments regardless of land use type.
Interconnections to adjoining parcels are not feasible to the east, because the surrounding Mobile Home
zoned parcel(s) are all developed. Future connection to the undeveloped parcel to the north is not being
sought at this time, but it may be feasible to provide a future connection if the land uses are compatible
and appropriate at the time of site development plan approvals for the individual sites.

Policy 7.4
The County shall encourage new developments to provide walkable communities with a blend of
densities, common open spaces, civic facilities and a range of housing prices and types.
Sidewalks/pathways will be provided to and from the site, as appropriate and as required by the LDC.

County Utility Dedication Statement: If the project is located within the service boundaries of
Collier County’s utility service system, a notarized statement shall be provided agreeing to
dedicate the water distribution and sewage collection facilities within the project area to the
Collier County Utilities. This shall occur upon completion of the construction of these facilities in
accordance with all applicable County ordinances in effect at that time. This statement shall also
include an agreement that the applicable system development charges and connection fees will
be paid to the County Utilities Division prior to the issuance of building permits by the County. If
applicable, the statement shall contain an agreement to dedicate the appropriate utility
easements for serving the water and sewer systems.

Within 30 days of adoption of the Ordinance, the owner or developer at their expense shall record in the
Public Records of Collier County a Memorandum of Understanding of Developer Commitments or Notice
of Developer Commitments that contains the legal description of the property that is the subject of the
land use petition and contains each and every commitment of the owner or developer specified in
the Ordinance. The Memorandum or Notice shall be in form acceptable to the County and shall comply
with the recording requirements of F.S. §695. A recorded copy of the Memorandum or Notice shall be
provided to the assigned Principal Planner, Zoning Services Department, within 15 days of recording of
said Memorandum or Notice.

x Introduction:
o Good evening. My name is Oliver Sendall and this is Jessica
Harrelson, and we are with Davidson Engineerin. We are the land
development consultants representing the applicant, Iglesia
Pentecostes Peniel Immokalee, Inc.
o Here with us tonight is Fred Hood, the Senior Planner - also with
Davidson Engineering.
o James Sabo, with the Collier County, is also in attendance tonight.
He is the reviewing planner for Collier County Growth Management.
o Per the Collier County Land Development Code, tonight’s meeting
will be recorded. At the end of my presentation I will be happy to
answer any questions you may have regarding the proposed
development.
x Size and Location:
o The subject site is located approximately 80 feet to the east of School
Drive in the northeast quadrant of the intersection of School Drive
and East Delaware Ave., in Section 3, Township 47 South, Range 29
East (Immokalee).
o The subject site is ±1.9 acres.

x Details of the Application:
o The applicant is seeking a Conditional Use for the site, which is
located within the Residential Multi-Family-6 (RMF-6) Zoning District.
The Conditional Use will permit for a church, religious facility, or
place of worship.
o The LDC currently provides for the following permitted uses in the
RMF-6 District:
o Single-family homes, duplexes, multi-family dwellings, family care
facilities and educational plants.
o The proposed church will be designed to accommodate up to 300-
seats.
o The means of ingress and egress to the property are currently
proposed along Delaware Avenue East.
o Currently, the majority of traffic/trips are proposed during worship
services on Tuesday and Saturday evenings at 7:30p.m. and again on
Sunday afternoons at 4:00p.m.
o Landscape buffers and water management areas adjacent to existing
residential land uses/zoning will be utilized to reduce any potential
for noise or glare.
x Conditional Use Process
o The Conditional Use has received approval from County Staff and is
now ready to be scheduled for public hearings.
o A total of two (2) public hearings will be held, with the first being
with the Hearing Examiner and the second and final hearing with the
Board of County Commissioners.
o The County will notify you, as the surrounding interested parties, of
these hearings.
o That ends my brief presentation and I will now answer any questions
you may have.

Response: LDC Sections 4.06.02 D, 4.06.05 D and 4.06.05 N specify what plant materials are
required for water management areas within required yards and buffers. No additional notes
are required or needed for this conditional use application as it would be redundant to cite
governing LDC provisions.
Environmental Review, Craig Brown
1. Submit a current aerial photograph and clearly delineate the subject site boundary lines. Provide
FLUCFCS overlay and vegetation inventory identifying upland, wetland and exotic vegetation
(Admin. Code Ch. 3 G.1. Application Contents #24).
Response: Please find the aerial FLUCCS exhibit attached to this submittal.
2. Please indicate with a note on the Master Plan no preserve is required.
Response: Acknowledged. Please see the revised Conceptual Site Plan.
Historical Review, Fred Reischl
1. Indicate that the project is not within the Probability Area or Historical Structure, or submit a

Response: Please see the attached Historical/Archaeological Waiver request, included with this
submittal.
Zoning Review, James Sabo
1. Traffic Impact Study, See Chapter 7, Insufficient, initial paragraph of TIS has incorrect property
size and area of the proposed project site.
Response: Acknowledged. Please see the revised TIS. The size and area of the proposed project
site have been made consistent with the remainder of the application materials.
2. Section 4.05.02 Design Standards, Parking Matrix required, Insufficient, an administrative parking
reduction has been requested in concert with the Conditional Use request. A parking matrix must
be provided for review.
Response: Section 4.05.02 identifies the parking requirements for each use(s) within Collier
County, and there is a companion APR request in concert with the CU application. However,
provision of a parking matrix is not a requirement for conditional use concept plans. The
proposed seats identified in the APR and the justifications therein, along with the number of
spaces proposed in that APR application, supply enough for that separate application to move
forward independently of this Conditional Use Application.
Should staff require a parking matrix for the APR application, the agent may provide a
conceptual parking matrix and design for additional review independent of this application.
3. Section 4.02 Open Space Required, Open Space Provided, Insufficient, information and
calculations for the open space requirements and the open space provided as part of the project
must be included and detailed.
Response: Per LDC Section 4.02.01 B.2, the provision or calculation of open space is not required
for properties less than 5 acres in size. The subject property is 1.90 acres and therefore, the
request is unnecessary.
County Attorney Review, Scott Stone
1. Please provide a list of all shareholders or those with an equitable interest in the owner company.
Response: Please see the attached Disclosure of Interest that outlines each registered officer of
the Florida Not for Profit Corporation.
2. Your application included a zoning condition of approval (re traffic control). Is that something staff
has asked you to add?
Response: The condition of approval submitted was not requested by Staff, but it has been our
experience that this is a typical condition of approval requested for Churches. If this is not
needed, it will not be included in the recorded Resolution.
3. See markups on proposed conceptual site plan, to be provided by planner in separate e-mail.
Response: Acknowledged. Please see the revised Conceptual Site Plan.
Informational Comments:
1. A 5' wide 10:1 area will need to be provided where the water management areas overlap with the
landscape buffer.
Response: Acknowledged. This will be taken into consideration during time of site design and
SDP.
2. Site is required to be in compliance with the intent of LDC 3.08.00(A)(4)(i)(ii). Any required clean

As required by Sections 120.569 and 120.60(3), Fla. Stat., the following is notice of the opportunities which
may be available for administrative hearing or judicial review when the substantial interests of a party are
determined by an agency. Please note that this Notice of Rights is not intended to provide legal advice. Not
all of the legal proceedings detailed below may be an applicable or appropriate remedy. You may wish to
consult an attorney regarding your legal rights.
RIGHT TO REQUEST ADMINISTRATIVE HEARING
A person whose substantial interests are or may be affected by the South Florida Water Management District’s
(SFWMD or District) action has the right to request an administrative hearing on that action pursuant to
Sections 120.569 and 120.57, Fla. Stat. Persons seeking a hearing on a SFWMD decision which affects or
may affect their substantial interests shall file a petition for hearing with the Office of the District Clerk of the
SFWMD, in accordance with the filing instructions set forth herein, within 21 days of receipt of written notice of
the decision, unless one of the following shorter time periods apply: (1) within 14 days of the notice of
consolidated intent to grant or deny concurrently reviewed applications for environmental resource permits and
use of sovereign submerged lands pursuant to Section 373.427, Fla. Stat.; or (2) within 14 days of service of
an Administrative Order pursuant to Section 373.119(1), Fla. Stat. "Receipt of written notice of agency
decision" means receipt of written notice through mail, electronic mail, or posting that the SFWMD has or
intends to take final agency action, or publication of notice that the SFWMD has or intends to take final agency
action. Any person who receives written notice of a SFWMD decision and fails to file a written request for
hearing within the timeframe described above waives the right to request a hearing on that decision.
If the District takes final agency action which materially differs from the noticed intended agency decision,
persons who may be substantially affected shall, unless otherwise provided by law, have an additional Rule
28-106.111, Fla. Admin. Code, point of entry.
Any person to whom an emergency order is directed pursuant to Section 373.119(2), Fla. Stat., shall comply
therewith immediately, but on petition to the board shall be afforded a hearing as soon as possible.
A person may file a request for an extension of time for filing a petition. The SFWMD may, for good cause,
grant the request. Requests for extension of time must be filed with the SFWMD prior to the deadline for filing
a petition for hearing. Such requests for extension shall contain a certificate that the moving party has
consulted with all other parties concerning the extension and that the SFWMD and any other parties agree to
or oppose the extension. A timely request for an extension of time shall toll the running of the time period for
filing a petition until the request is acted upon.
FILING INSTRUCTIONS
A petition for administrative hearing must be filed with the Office of the District Clerk of the SFWMD. Filings
with the Office of the District Clerk may be made by mail, hand-delivery, or e-mail. Filings by facsimile will not
be accepted. A petition for administrative hearing or other document is deemed filed upon receipt during
normal business hours by the Office of the District Clerk at SFWMD headquarters in West Palm Beach,
Florida. The District’s normal business hours are 8:00 a.m. – 5:00 p.m., excluding weekends and District
holidays. Any document received by the Office of the District Clerk after 5:00 p.m. shall be deemed filed as of
8:00 a.m. on the next regular business day. Additional filing instructions are as follows:
x Filings by mail must be addressed to the Office of the District Clerk, P.O. Box 24680, West Palm
Beach, Florida 33416.

x Filings by hand-delivery must be delivered to the Office of the District Clerk. Delivery of a petition to
the SFWMD's security desk does not constitute filing. It will be necessary to request that the
SFWMD's security officer contact the Office of the District Clerk. An employee of the SFWMD's
Clerk's office will receive and file the petition.
x Filings by e-mail must be transmitted to the Office of the District Clerk at clerk@sfwmd.gov. The filing
date for a document transmitted by electronic mail shall be the date the Office of the District Clerk
receives the complete document. A party who files a document by e-mail shall (1) represent that the
original physically signed document will be retained by that party for the duration of the proceeding
and of any subsequent appeal or subsequent proceeding in that cause and that the party shall
produce it upon the request of other parties; and (2) be responsible for any delay, disruption, or
interruption of the electronic signals and accepts the full risk that the document may not be properly
filed.
INITIATION OF AN ADMINISTRATIVE HEARING
Pursuant to Sections 120.54(5)(b)4. and 120.569(2)(c), Fla. Stat., and Rules 28-106.201 and 28-106.301, Fla.
Admin. Code, initiation of an administrative hearing shall be made by written petition to the SFWMD in legible
form and on 8 1/2 by 11 inch white paper. All petitions shall contain:
1.Identification of the action being contested, including the permit number, application number, SFWMD
file number or any other SFWMD identification number, if known.
2.The name, address, any email address, any facsimile number, and telephone number of the petitioner
and petitioner’s representative, if any.
3.An explanation of how the petitioner’s substantial interests will be affected by the agency
determination.
4.A statement of when and how the petitioner received notice of the SFWMD’s decision.
5.A statement of all disputed issues of material fact. If there are none, the petition must so indicate.
6.A concise statement of the ultimate facts alleged, including the specific facts the petitioner contends
warrant reversal or modification of the SFWMD’s proposed action.
7.A statement of the specific rules or statutes the petitioner contends require reversal or modification of
the SFWMD’s proposed action.
8.If disputed issues of material fact exist, the statement must also include an explanation of how the
alleged facts relate to the specific rules or statutes.
9.A statement of the relief sought by the petitioner, stating precisely the action the petitioner wishes the
SFWMD to take with respect to the SFWMD’s proposed action.

The procedures for pursuing mediation are set forth in Section 120.573, Fla. Stat., and Rules 28-106.111 and
28-106.401–.405, Fla. Admin. Code. The SFWMD is not proposing mediation for this agency action under
Section 120.573, Fla. Stat., at this time.

1.0 GENERAL METHODOLOGIES
For the purpose of structural analysis, the structure utilized will be a 115ft spun concrete I-pole
structure based on information provided by FPL. The information provided by FPL was utilized to
develop a PLS-Pole model for analysis.
A foundation analysis for the standard 33ft set depth was performed as part of this project.
Geotechnical information utilized for analysis was provided by Ardaman & Associates, Inc. the
standard embedment depth of 33ft was analyzed with the use of MFAD foundation design
software. It was assumed that the structure foundation will be augured and backfilled with
crushed rock in accordance with FPL standard A-88039-7 as shown in Appendix G.
Transmission hardware components are based on FPL standards, unless otherwise stated, and no
hardware was analyzed as part of this structural analysis. The cellular canister antenna, cellular
equipment attachments, and 5ft steel extension at the top of the pole have been designed by
others and were not analyzed as part of this structural analysis.
1.1 LOADING CONFIGURATION
1.1.1 Structure Framing
The structure was analyzed to support three deadend OHGW’s to provide shielding to the
adjacent Alligator Substation tower at heights detailed in the structure detail drawing in
Appendix F. Cellular canister antenna and cellular RRUS racks heights and configurations for the
analyses were based upon the FPL provided data.

1.1.3 Structure Loads Criteria
Structure has been designed to support three (3) 7#8 AW overhead ground wires (OHGWs), one
(1) cellular canister antenna , and two (2) cellular RRUS equipment racks. Through analysis it was
determined that the controlling load case for both the foundation and spun concrete I-Pole is
NESC 250C Extreme Wind load case in the direction of negative 45degrees from the positive
angle bisector. The following table details the load factors associated with each loading case
that was utilized for analysis. It should be noted that the ultimate concrete pole strength was
analyzed for load cases NESC 250B Light and NESC 250C. For load cases NESC 250D and FPL
everyday wind, the pole capacity was analyzed utilizing the zero tension capacity.

1.1.5 Cellular Array Antenna Loading Criteria
For the cellular canister antenna and two (2) cellular RRUS equipment racks, loading was
developed in accordance with TIA 222-G under load case previously presented. The above
ground heights of the cellular antenna and RRUS racks were provided by FPL. The following
tables summarize the loading utilized for the cellular attachments.

1.2 CONCRETE POLE ANALYSIS
Under the OHGW and antenna loads previously detailed, the 115ft spun concrete I-pole was
modeled in PLS-Pole with the use of the information provided by FPL. For analysis, a 33ft standard
set depth was assumed. The 115ft spun concrete I-pole was found to have a maximum usage of
31% under 135mph extreme wind loading. The loading of the pole is detailed in the PLS-Pole
short and long reports in appendices C and D respectively.
1.3 FOUNDATION ANALYSIS
A foundation analysis was performed for the standard 33ft set depth with the use of the design
software MFAD and geotechnical information provided by Ardaman & Associates, LLC in
Appendix I. For analysis, it was assumed that the top 3ft of soil was loose in nature, therefor,
conservative soil parameters were utilized. It was assumed that the structure foundation will be

augured and backfilled with crushed rock in accordance with FPL standard A-88039-7 as shown

The following comments are informational and/or may include stipulations:
Applicants who are converting a paper submittal to E-Permitting must resubmit
complete sets of all plans, signed and sealed, even if they were previously approved
on an earlier review. As a reminder, all documents that are required to be signed
and sealed must be digitally signed and sealed when submitting through our
E-Permitting process. On the cover letter please identify that previous submittals
were done through paper and that this submittal is by E-Permitting. Also,
identification of the changes in cover letter (ex. See note #23 Civil Plan Sheet 4)
improves the efficiency of the resubmittal review.
When addressing review comments, please provide a cover letter outlining your
response to each comment. Include a response to completed reviews with
stipulations.
Please be advised that Sections 10.02.03.H.1, and 10.02.04.B.3.c require that a
re-submittal must be made within 270 days of this letter.
