EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners acting as the Community
Redevelopment Agency (CRA) approve the conveyance of a 15 -foot wide utility easement by the
CRA to the Immokalee Water and Sewer District on CRA owned property as depicted on the
attached location map and Exhibit "A" of the attached Utility Easement to accommodate an
existing sanitary sewer line running through said parcel at a cost not to exceed $1,656.50.
OBJECTIVE: To convey a 15 -foot wide utility easement to the Immokalee Water and Sewer
District in order to memorialize access and utility rights to be granted to the Immokalee Water
and Sewer District for the accommodation of an existing sanitary sewer line which lies on a
portion of the Immokalee CRA future stormwater pondsite property.
CONSIDERATIONS: In December, 2010 the Immokalee CRA acquired a parcel of land in
Immokalee to be used as a stormwater retention pond, with the ultimate goal of alleviating
flooding and water quality concerns throughout the downtown area of Immokalee.
It was recently discovered that the Immokalee Water & Sewer District has an active sanitary
sewer line running across a small portion of said parcel. Therefore, a utility easement is being
created to accommodate the existence and any ongoing future maintenance of this utility line,
which may co -exist with the stormwater retention pond.
FISCAL IMPACT: Sufficient budget exists within Immokalee CRA Trust Fund (186) to pay
for the desired easement. Total cost shall not exceed $1,656.50 ($98800 for the Agnoli, Barber
& Brundage, Inc. sketch with embedded legal description, $650.00 for Collier County Real
Property Management transactional fees, and $18.50 for recording fees).
LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote for
Board action. - JBW
GROWTH MANAGEMENT IMPACT: This item has no impact on the Growth Management
Plan.
ADVISORY BOARD RECOMMENDATION: The Immokalee Local Redevelopment
Advisory Board on June 20, 2012 will consider conveyance of the subject utility easement to the
Immokalee Water & Sewer District as well as use of CRA trust funds to cover the associated
costs. This matter is expected to receive the advisory boards' endorsement.
RECOMMENDATION: That the Board of County Commissioners, acting as the Community
Redevelopment Agency (CRA):
1. Authorize the Chairman to execute the attached Utility Easement; and
2. That the Board direct the Immokalee CRA Executive Director and the County Manager or
their respective designees to proceed to follow all appropriate closing procedures and to
record the Utility and Access Easement in the Public Records of Collier County, Florida.

Utility Easement
THIS EASEMENT, made and entered into this day of ' 2012 by the
COLLIER COUNTY COMMUNITY REDEVELOPMENT AGENCY (11MMOKALEE CRA), whose mailing
address is 1320 N. 15th Street, Suite 2, Immokalee Florida 34142, hereinafter referred to as
"Grantor ", to the IMMOKALEE WATER AND SEWER DISTRICT, an independent special district,
whose mailing address is 1020 Sanitation Road, Immokalee, Florida 34142, its successors and
assigns, hereinafter referred to as "Grantee ".
W ITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration
paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby
conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a perpetual,
non - exclusive easement, license, and privilege for wastewater utility purposes, on, over, upon,
across and through the following described lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions and reservations of record
This is NOT homestead property.
To have and to hold THE SAME UNTO THE Grantee together with the right to enter upon
said land, excavate, and place or remove materials for the purpose of constructing, operating,
and maintaining wastewater utility facilities thereon. Grantor and Grantee are used for singular
or plural, as the context requires.
IN WITNESS WHEREOF, the Grantor has executed this Agreement this day of
