EXECUTIVE SUMMARY
Recommendation to accept staffs progress report for locating a potential All Terrain Vehicle
(ATV) site and that the Board adopt the proposed Resolution establishing the Collier County ATV
Park Ad Hoc Committee, which Resolution also appoints the initial members to this Committee.
OBJECTIVE: To explore and identify opportunities to locate an ATV facility for Collier
County residents.
CONSIDERATIONS: In 2011, Collier County and the South Florida Water Management
District entered into a Settlement Agreement wherein the District paid Collier County $3 million
to dispose of litigation arising out of a 2003 Agreement between the parties in which the District
was to convey 640 acres to Collier County for recreational ATV use. Since that settlement, the
Collier County Growth Management Division and Collier County Parks and Recreation
Department have been tasked with searching for land appropriate and suitable for an ATV Park
site.
An initial public information meeting was held on September 28, 2011, to solicit input from
stakeholders. More than 100 people attended. At the meeting staff gathered input from the
riders themselves as to where a potential ATV Park site could be located and what they hope to
obtain in regards to acreage and amenities. Since that initial meeting, the following actions have
been undertaken:
1. A Web page was created at www.colliergov.net /atvpark for interested parties to obtain
information and post comments;
2. Phase I analysis with Stantec Consulting Services, Inc., has identified potential areas that
do not appear to be environmentally sensitive, and could therefore be utilized for ATV
park purposes;
3. Staff is in the process of communicating with all property owners within the identified
areas to determine whether they would be interested in selling or leasing their property
and/or entering into a public /private partnership to develop and operate an ATV park; and
4. Staff has confirmed with the State of Florida that the site of the recently closed Hendry
County Correctional Facility is currently not available.
A second public meeting was held on March 29, 2012, to update stakeholders on the process
being undertaken to identify an ATV Park site as well as the progress thus far. At the meeting, a
newly developed map prepared with assistance from the County's consultants was reviewed
showing those attending the meeting the areas within Collier County that appear to have the
acreage, terrain and environmental characteristics necessary to support an ATV Park. They were
also informed that letters are in the process of being sent to 73 property owners who own more
than 200 of the parcels identified to determine if there is interest in discussing the options
available for the use of private land for an ATV Park.

A. Purchase or lease of private land;
B. Easements for the establishment of ATV trails over private land to connect with lands
of other property owners;
C. Private /public partnership where private property owners develop and operate an
ATV Park on their land with possible assistance and/or funding by the County; and
D. Volunteer assistance and funding from the ATV community.
Staff requests that the Board establish a one year Ad Hoc Committee to assist staff in exploring
and identifying potential ATV Park sites, with the goal of producing recommendations to the
Board. A request went out for all those who might be interested in serving on such a committee.
Staff has reviewed the applications and recommends that the Board approve the following
citizens to serve on the Committee:
Close, Jeff
Garcia, Felix
Harraden, Jonathan
Menendez, Mario
Pelletier, Joe
Should other citizens submit applications and ask to participate, those applications will be
brought to the Board.
FISCAL IMPACT: No additional budget is being requested at this time.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: Ordinance No. 01 -55 provides in relevant part that "The
commission may, by resolution, appoint an ad hoc or task force committee for a specific project,
if the duration of the committee does not exceed three years duration. The resolution must set
forth the duties and responsibilities of the committee and contain language that automatically
dissolves the committee within the specified year from the date of adoption of the committee
members by the commission." The proposed Resolution was prepared by the County Attorney,
is legally sufficient, and requires majority vote for approval. —JAK
RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida:
1) Accepts staff's progress report; and
2) Adopts the proposed Resolution establishing the Collier County ATV Park Ad Hoc
Committee, which Resolution also appoints the initial members to this Committee.

RESOLUTION NO. 2012 -
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, ESTABLISHING THE COLLIER
COUNTY ATV PARK AD HOC COMMITTEE, AND APPOINTING THE
INITIAL MEMBERSHIP.
WHEREAS, in 2011, Collier County and the South Florida Water Management District
entered into a Settlement Agreement wherein the District paid Collier County $3 million to
dispose of litigation arising out of a 2003 Agreement between the parties in which the District
was to convey 640 acres to Collier County for recreational ATV use; and
WHEREAS, it has been the desire of the Board of County Commissioners to utilize
these funds to locate and establish an ATV Park; and
WHEREAS, the Collier County Growth Management Division and Collier County Parks
and Recreation Department have conducted public information meetings to solicit input from
stakeholders and ATV riders in this search for land suitable for an ATV Park site; and
WHEREAS, Collier County Ordinance No. 2001 -55, as amended, provides that the
Board of County Commissioners may, by resolution, appoint an ad hoc or task force committee
for a specific project, if the duration of the committee does not exceed three years duration; and
WHEREAS, the Board of County Commissioners desires to establish an ATV Park Ad
Hoc Committee to assist the Board in identifying lands appropriate and suitable for an ATV
Park.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Creation and Purpose of the ATV Park Ad Hoc Committee.
Pursuant to the provisions of Collier County Ordinance No. 2001 -55, as amended, the
Board of County Commissioners hereby establishes the Collier County ATV Park Ad Hoc
Committee (Committee) to assist the Board in researching and identifying lands based on
acreage and amenities that are appropriate and suitable for an ATV park.

Appointment of Members, Terms of Office, Failure to Attend
Meetings.
There shall be seven members to this Committee, who shall serve a one year term. The
Board hereby appoints Jeff Close, Felix Garcia, Jonathan Harraden, Mario Menendez, and Joe
Pelletier to the Committee. Additional and replacement members shall, to the extent possible, be
comprised of community members who are ATV riders and who have demonstrated a substantial
interest in working with Collier County staff to determine a potential site for the ATV Park.
If any member of the Committee is absent from two or more consecutive meetings
without satisfactory excuse, such member's position may be declared vacant by the Board as
prescribed by Collier County Ordinance No. 2001 -55, as amended, or its successor ordinance.
SECTION THREE: Officers, Quorum, and Composition.
At the Committee's first meeting, the membership shall elect a Chair and Vice - Chair.
The presence of a majority of the memberships shall constitute a quorum. The Committee shall
follow Robert's Rules of Order for the transaction of business and shall keep records of the
meetings, findings, and determinations. The members of the Committee shall serve without
compensation, but may be reimbursed for travel, mileage, and/or per diem expenses if approved
in advance by the Board.
SECTION FOUR: Functions, Powers, and Duties of the Committee.
The functions, powers, and duties of this Committee shall be to aid and assist the Board
in researching and identifying lands appropriate and suitable, based on acreage and amenities, for
an ATV park. Additionally, the Committee may evaluate options for the use of private land for
the establishment of an ATV Park. These options include but are not limited to:
A. Purchase or lease of private land;
B. Easements for the establishment of ATV trails over private land to connect with
lands of other property owners;

C. Private /public partnerships where private property owners develop and operate an
ATV Park on their land with possible assistance and/or funding by the County;
and
D. Volunteer assistance and funding from the ATV community.
SECTION FIVE: Dissolution of Committee.
Unless extended by Resolution of the Board, this Committee shall automatically sunset
without further action one year from the date of this Resolution.

SETTLEMENT AGREEMENT AND MUTUAL RELEASE BETWEEN COLLIER
COUNTY AND THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT
THIS SETTLEMENT AGREEMENT AND MUTUAL RELEASE (hereinafter referred
to as the "Agreement ") is entered into and made on the date when it has been executed by the
last of the parties to sign it, by and between Collier County (hereinafter referred to as "the
County "), a political subdivision of the State of Florida, and the South Florida Water
Management District, (hereinafter referred to as "SFWMD" or "District ").
WITNESSETH:
WHEREAS, Collier County is a Plaintiff in Case No. 09 -7419 CA filed in the Circuit
Court for the Twentieth Judicial Circuit in a contractual litigation dispute; and
WHEREAS, Collier County has claimed, inter alia, monetary damages against the
SFWMD for a failure to convey 640 acres MOL of land to the County for recreational purposes
pursuant to a 2003 Agreement; and
WHEREAS, Collier County and the SFWMD wish to fully and completely resolve their
differences and disputes as they relate to the aforementioned litigation.
NOW, THEREFORE, in consideration of the mutual covenants, promises and
consideration set forth in this Agreement, including the above - referenced "Whereas" clauses;
and with the intent to be legally bound, the County and the District agree as follows:
l . This Agreement will fully settle any and all claims of, by, for and on behalf of the
Plaintiff, Collier County, in this action against the South Florida Water Management District
("District ") in Case No. 09- 7419 -CA, pending before the 20th Judicial Circuit, styled Collier
County v. South Florida Water Management District.
2. The conditions of this Agreement are dismissal of Case No. 09- 7419 -CA, filed by
Collier County in the 20'x' Judicial Circuit, styled Collier County v. South Florida Water

Management District, with prejudice, each party to bear its own fees and costs.
3. This Agreement constitutes full settlement of and release of any and all claims of,
by, for, on behalf of, and between the Plaintiff, Collier County, and the District, including the
Big Cypress Basin, involving any temporary, interim, and/or permanent recreational /ATV site,
and /or any expenses and /or obligations associated with any such recreational /ATV site, as set
forth in the Complaint in Case No. 09- 7419 -CA, filed by Collier County in the 20`" Judicial
Circuit, styled Collier County v. South. Florida Water Management District, and /or arising from
the Agreement entered into by the parties on or about October 8, 2003 as to all recreational /ATV
site issues or obligations, and/or the Agreement entered into by the parties on or about June 14,
2007, even though Collier County asserts that the 2007 Agreement is unenforceable, as to all
recreational /ATV site issues or obligations.
4. In consideration of this settlement and mutual release between the parties, the
District shall make a lump -sum payment of Three Million Dollars and 00 /100 ($3,000,000.00)
from the District to the Plaintiff, Collier County, one -half of which will be paid from District ad
valorem taxes and /or District general funds and one -half of which will be paid from Big Cypress
Basin ad valorem funds.
5. The payment of Three Million Dollars and 00/100 ($3,000,000.00) to Collier
County from the District for the Settlement and Mutual Release contemplated herein will not
reduce existing funding to Collier County from the District's 2011 budget.
6. In addition, the parties agree to enter into the attached Second Amendment to
Cooperative Agreement (C- 11759) between the SFWMD and Collier County, extending the
Canal Maintenance Cooperative Agreement until September 30, 2012,
7. SFWMD shall, within thirty (30) days of the execution of this Agreement by the
parties, or in any event; no later than June 30, 2011, provide the County with the sum of Three

Million Dollars ($3,000,000.00) by check or wire transfer. The County shall provide the District
with wiring instructions within fifteen (15) days from the effective date of this Agreement.
8. Upon receipt of the funds set forth above, the County shall dismiss, with prejudice
its Complaint against SFWMD by filing a Stipulated Notice of Dismissal With Prejudice, each
party to bear their own respective attorneys' fees and costs with the Trial Court in the
aforementioned litigation.
9. The County and SFWMD acknowledge and agree that this Agreement is intended
to and shall be binding upon their respective boards, officials, officers, employees, and
representatives.
10. The County and SFWMD acknowledge and agree that this Agreement is the
product of mutual negotiation and no doubtful or ambiguous language or provision in this
Agreement is to be construed against any party based upon a claim that the party drafted the
ambiguous provision or language or that the party was intended to be benefited by the
ambiguous provision or language.
11. This Agreement may be amended .only by a written instrument specifically
referring to this Agreement and executed with the same formalities as this Agreement.
12. The laws of the State of Florida shall govern this Agreement.

I have been working for Collier County EMS for the last 18 years. I currently hold the position of Lt. Paramedic and am the training officer and a team leader for the
Search and Rescue Team.
For the last 6 years our family hobby has been off road jeeping and camping. I am an experienced Jeep mechanic and off road fabricator. I have organized large
scale clean ups at the ptaces we used to recreate off road.
I have belonged to the Caloosa Jeepers of SW Florida for approximately 6 years and am currently a forum moderator.
I would like to be part of an active process working towards an off road park. I have been to the ATV meetings and belive I have a realistic approach to
this project. I want to ensure that this park is not just ATV specific. There are many types of off road recreation.

Experience: I have enjoyed off road vehicles for years. Our family as been to Ocala National Forest (ONF) on numerous occasions with
friend, family and several members from online RV forums. We have also road in the Croom Recreational area in Brooksville, FL. We enjoyed riding
Picayune Forest before k was lost to the everglade restoration project. We have participated in clean up days at ONF. We have ridden in private ATV parks
such as Durham town Plantation in Georgia. I have a good understanding of how ATV issue affects the public and local government.
