EXECUTIVE SUMMARY
Recommendation to approve the release of a $13,113.07 lien for payment of $1,563.07, in
the Code Enforcement Action entitled Board of County Commissioners vs. Philip R.
Bradley IV and Nancy F. Bradley, Code Enforcement Board Case Number
CEPM20100010050, relating to property located at 4945 Barcelona Circle, Collier County,
Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accept an offer to release a
$13,113.07 code enforcement lien, for payment of $1,563.07, in relation to Code Enforcement
Board case number CEPM20100010050.
CONSIDERATIONS: As a result of code violations at 4945 Barcelona Circle, the Code
Enforcement Board ordered the imposition of a lien ( "Lien ") against the owners Philip R. Bradley
IV and Nancy F. Bradley, in Code Enforcement Case Number CEPM20100010050. The lien
was recorded in the Official Public Records on June 8, 2011, at O.R. Book 4690, Page 248, and
the lien encumbers all real property owned by Philip R. Bradley IV and Nancy F. Bradley..
Based on accrued fines for the non - compliance period of 80 days at $150 per day, operational
cost of $80.57 and county abatement cost of $1,032.50, the accrued lien amount is $13,113.07
for pool water unmaintained and dark in color. The property was brought into compliance on
March 8, 2011 by contractors hired by Collier County to abate the violation. Federal National
Mortgage Association obtained a Certificate of Title (via foreclosure) to the property on January
24, 2012. Pursuant to Resolution 2012 -46, the property was brought into compliance prior to
Federal National Mortgage obtaining Certificate of Title.
The property owner, Federal National Mortgage Association, has paid operational costs of
$80.57, county abatement cost of $1,032.50 and fines for administrative costs of $450. Upon
approval, fines of $11,550 will be waived.
FISCAL IMPACT: The property owner has provided payment of $1,563.07. If approved by the
Board, accrued fines in the amount of $11,550 will be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action and requires a
majority vote for approval. -JW
RECOMMENDATION: That the Board waive the fines in the amount of $11,550, accept
payment of $1,563.07 and release the Lien, and also authorize the Chairman to sign the
attached release of lien.

RELEASE AND SATISFACTION OF LIEN
KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA is the owner and holder of a
certain lien against all real and personal property owned by:
Philip R. Bradley IV and Nancy F. Bradley,
Respondents
The lien was recorded on June 8, 2011 in Official Records Book 4690, Page 248, in the
Official Records of Collier County, State of Florida. The lien secures the principal sum of
Thirteen Thousand one hundred thirteen dollars and seven cents, plus accrued interest
and penalties, if any, and imposes certain obligations against real property situated in
Collier County, Florida, which property is described as follows:
NAPLES SOUTH UNIT 1 BLK 6 LOT 5
4945 Barcelona Circle Naples, FL
Collier County, a political subdivision of the State of Florida, by execution of this Release
and Satisfaction of Lien, acknowledges payment as approved by the Board of County
Commissioners as satisfaction of the lien and hereby cancels said lien.
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction
of Lien in the Official Records of Collier County, Florida, to acknowledge that the lien
ceases to exist.
