EXECUTIVE SUMMARY
Recommendation to approve current policy on use of resident beach parking permits,
adopt an annual pass option for non - residents at Sun -N -Fun Lagoon, and approve current
policy on use of beach parking /garage.
OBJECTIVE: To provide an update to the Board of County Commissioners on current policies
related to the Parks and Recreation Department.
CONSIDERATIONS: On April 10, 2012, during Commissioner Communications, the Board of
County Commissioners requested staff to bring back a presentation on the current policies
related to:
Issuance of resident beach parking permits
Purchase of annual pass for non - residents at Sun -N -Fun Lagoon
Use of beach parking/garage
Each of these items will be considered separately for discussion.
Resident Beach ParkinLy Permits
Recently, the Parks and Recreation Advisory Board ( PARAB) reviewed the current policy
related to issuance of beach parking permits. The current policy (Attachment A) allows for a
"free permit" to be given to those individuals who demonstrate either full time residency in
Collier County or proof of property ownership where ad valorem property taxes are paid.
PARAB reviewed the policy due to the request of an individual, who lived in a modular home
community, and requested information on why he was eligible for a "free" permit and his
neighbor was not. The PARAB learned that one individual was a full time County resident who
was eligible for the "free" beach permit; however the other was not a full time resident nor paid
ad valorem property taxes on his modular home and was required to pay the non - resident $50
annual permit fee.
This policy was established by Resolution in 1995. The Parks and Recreation Advisory Board
with a quorum present voted to continue the current policy by a vote of 3 -1 on May 16, 2012.
Staff recommends maintaining current policy.
Purchase of Annual Pass for Non - Residents at Sun -N -Fun Lagoon
Recently, the Parks and Recreation Department was approached by a former resident who now
lives in Lee County requesting that a non - resident annual pass be developed for her families' use
of Sun -N -Fun Lagoon. In addition, she requested that the admission fee associated with the Sun -
N -Fun Lagoon be the same for both residents and non - residents.

In review of the request, the Parks and Recreation Department analyzed the number of residents
in Lee County who attended the Park during FY 11. A total of 2,679 individuals were identified
as Lee County residents through zip code analysis of attendees. During the same time period, a
total of 57,495 Collier County residents were visitors to the facility. Of the 57,495 visitors, there
were 545 memberships sold or less than 1% of the total. Each membership sold resulted on
average (8) visits to the Park. The average family size related to memberships is (4). A table
depicting the relationships of the data above is as follows:

Allowing for a non - resident membership would impact fees in the following manner for current
revenues associated with Sun -N -Fun. If one were to extrapolate from the current policy that
allows Collier County residents to purchase annual memberships, whereby 19% from total
revenues come from these memberships, it is anticipated that would result in a reduction from
$22,345 to $18,010 for Lee County residents.

By instituting an annual membership fee for non - residents, the assumption is that most would be
sold to Lee County residents. A projection of additional revenues to off -set the loss of $4,335 is
demonstrated below:

PARAB voted 4 -0 to approve a revision in the fee policy to create a non - resident annual
membership pass.
Staff recommends revising the fee policy to reflect a non - resident membership pass.
Use of Beach Parking /Garage
The Board of County Commissioners voted to change the Ordinance related to beach parking by
stipulating that only those individuals with beach parking stickers or other means of
demonstrating payment of the daily rate for beach parking may park in designated beach parking
facilities from dawn to dusk (see Attachment B). Currently, this policy is enforced through the
Collier County Park and Recreation Rangers program and any individual who is identified as
parking for some other reason than visiting the beach may be cited by these staff.
The purpose of designating beach parking facilities only for beach parking stems from the
demand on facilities by current seasonal (tourists) and resident beach park facilities users.
Parking is at a premium at Clam Pass, Marco Island South Beach, Vanderbilt Beach, and
Barefoot Beach facilities. Allowing parking for other uses will reduce beach parking
opportunities for tourists and residents alike.
PARAB voted 4 -0 to maintain current policy related to beach parking.
Staff recommends maintaining the current policy.
FISCAL IMPACT: Fiscal impact is not considered as a part of this item.
1. There is no fiscal impact by maintaining current policy related to beach parking permits.
2. Offering a non - resident membership to Sun -N -Fun Lagoon will not significantly alter
fiscal impact; however, historical data is required to fully capture this change in patron
behavior at this location.
3. There is no fiscal impact related to maintaining the current policy related to beach
parking /garage facilities.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office,
requires majority vote, and is legally sufficient for Board action. — CMG
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
RECOMMENDATION(S): That the Board of County Commissioners approves:
1. Maintaining current policy related to issuance of beach parking stickers for resident and
property owners in Collier County.
2. Allowing for a revision of the fee policy to establish a non - resident membership passes
for Sun -N -Fun Lagoon.
3. Maintaining current beach parking facility policy.

A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, ESTABLISHING AND
IMPLEMENTING BEACH PARKING FEES AND RULES PROPOSED
BY THE COUNTY'S PARKS AND RECREATION DEPARTMENT
THAT SPECIFY THE DOCUMENTATION REQUIRED TO PROVE
ELIGIBILITY TO BE ISSUED A STICKER TO INDICATE THAT A
VEHICLE IS EXEMPT FROM PAYMENT OF BEACH PARKING
FEES BASED UPON THE APPLICANT'S RESIDENCY IN COLLIER
COUNTY, FLORIDA; REPEALING RESOLUTION NO. 95-543
WHEREAS, by adoption of Resolution No. 95 -543 on September 26, 1995, the
Board of County Commissioners of Collier County, Florida, formally affirmed the
County's policies regarding fees for parking vehicles at the County's beach parking
facilities as specified in that Resolution; and
WHEREAS, eligibility for exemption from payment of beach parking fees is
based upon resideficy in Collier County because ad valorem taxes assessed against
residential real property located in Collier County, plus other taxes that are paid by
permanent residents partially pay for the County's expenses and the City of Naples'
expenses related to the subject public beach facilities; such taxes are not paid by persons
who are not permanent residents of Collier County or who do not own such real property.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:-

These Rules may be amended from time -to -time by Resolution(s) of the Board of County
Commissioners of Collier County.
The Board of County Commissioners makes the following findings of fact:
1. Most motor vehicles that are parked at the County's beach parking
facilities are occupied by people who are not residents of Collier County.
2. Costs to provide beach parking facilities and to police, maintain and repair
beaches, and to expand such parking facilities or construct new beach parking facilities
increase with the increasing numbers of vehicles that are parked at those beach parking
facilities.
3. This Resolution is to facilitate collection of those parking fees.
SECTION TWO. APPLICABLE BEACH FACILITY LOCATIONS.
1. Parking fees apply to the following beach parking facilities in Collier
County.
a. Barefoot Beach Access.
b. Barefoot Beach Park.
C. Vanderbilt Beach Access.
L Calm Pass Park-
e. North GuleBeach Access.
f. Tigertail Beach.
g. South Marco Beach Park.
2. Additional beach parking facilities may be added to this list from time -to-
time by Resolution(s) adopted by the Board of County Commissioners.

SECTION THREE. BEACH FACILITY PARKING FEES.
The County's beach parking fees are:
A. $1400 per vehicle per day for each parking space that is not metered; and
B. Seventy -five cents ($0.75) per hour per vehicle for each parking space that
is individually metered.
C. The fees are collected through parking meters or by direct collection by
authorized county personnel at the respective beach parking facility.
SECTION FOUR. VEHICLE EXEMPTION FROM BEACH FACILITY
PARKING FEES FOR PERMANENT COLLIER
COUNTY RESIDENTS; PROOF OF RESIDENCY IN
COLLIER COUNTY.
A_ No vehicle shall be exempt from any beach facility parking -fees unless the
vehicle days a valid beach parking sticker issued by Collier County or by the City of
Naples.
H. Attached to this Resolution as Exhibit "A" are Rules proposed by the
Collier County Parks and Recreation Department, entitled `Beach Facilities Parking Fees
Exemptie - Documentation Required to Prove Residency in Collier County."
C. The attached Rules (Exhibit "A ") are hereby approved by the Board of
County Commissioners as the County's policies regarding the documentation that is
required to be submitted to County's staff to prove that the applicant is eligible to be
issued a sticker to be affixed to a vehicle to indicate that the vehicle is exempt from
payment of beach parking fees at specified beach facilities in Collier County.

SECTION FIVE. RESTRICTED PARSING AREAS.
Pursuant to Section FOUR of Collier County Ordinance No. 80-47, as amended, each
parking space at any the above -listed "Applicable Beach Facility Locations" is a
geographic area where vehicle parking is prohibited except for vehicles that either display
a valid vehicle parking sticker or the applicable beach parking fees have been paid to park
that vehicle.
SECTION SIX. PAREING PROHIBITED AT "EXPIRED" PARIKING
METERS.
Pursuant to Section FOUR of Collier County Ordinance No. 80-47, as amended, at each
of the above -listed "Applicable Beach Facility Locations" no parking space controlled by
an individual parking meter shall be occupied by any vehicle when the parking meter
reads "expired." Such parking is "prohibited" except when the respective metered
parking fees have been paid into the parking meter applicable to the respective vehicle.
SECTION SEVEN. PARKING CITATIONS.
Pursuant to Chapter 89 -449, Laws of Florida, as now or hereafter amended, and pursuant
to Resolution(s) that may be adopted from time- to-time by the Board of County
Commissioners in conjunction with Chapter 89 -449, Collier County Park Rangers are
authorized by that Special Act to issue parking citations at each beach facility in
acc: Bence with Ordinance No. 80-47, as now or hereafter amended, or as that Ordinance
may be superseded in function by subsequent ordinance(s).

SECTION EIGHT. REPEAL OF RESOLUTION NO. 95-543.
Collier County Resolution No. 95 -543, expressing the County's current policies
regarding exemptions from these beach facilities parking fees, adopted on September 26,
1985, is hereby repealed in its entirety.

PROOF REQUIRED TO SHOW THE RESIDENCY REQUIRED FOR
COLLIER COUNTY FREE BEACH FACILTI'IES PARKING STICKER(S)
1. PERMANENT RESIDENT: Proof required for a beach facilities free parking
sticker based upon permanent residency ( "domicile') in Collier County is either (i) a
'Florida Driver's License . showing a Collier County residence address or (ii) Voter
Registration Card showing a Collier County residence address, plus one (1) of the
following issued to the ,person shown on the Driver's License or on the Voter
Registration Card for each vehicle that is to receive a sticker:
Mehicle(s) owned by the Permittee. Florida Vehicle Registration of the vehicle.
Leased Vehicle(s). A lease/use agreement for the vehicle.
Company Vehicle. Written permission from employer authorizing that employee to drive
the vehicle that is to receive a sticker. The vehicle can be employer -owned or otherwise
provided to the employee by the employer, such as vehicle leased by the employer.
2. RESIDENT WHO OWNS AD VALOREM TAXED RESIDENTIAL REAL
PROPERTY. This alternative is available for a person who is not a permanent resident
of Collier Countyor who is a_permanent resident but does not_choose_to submit theroof
required to show his/her domicile in Collier County. County staff must see a Driver's
License (valid in Florida but issued anywhere), and either a deed or a then current real
property tax bill or other written proof showing the following: Fee title ownership
showing complete year -round title to Collier County ad valorem taxed real property in
residential use owned by the person shown on the Driver's License, plus one of the
following issued to the person shown on the Driver's License:
Vehicle Owned by the Applicant. Current Registration (for anywhere) for each vehicle
that is to receive a parking sticker.
Leased Vehicle. A kase/use agreement for each leased vehicle that is to receive a sticker.
Company Vehicle. Written permission from the vehicle operator's employer authorizing
that employee to driive the vehicle that is to receive a sticker. The vehicle can be
employer -owned or otherwise provided to that employee by the employer, such as a
vehicle leased by the employer.

PURPOSE AND INTENT; PROVIDING FOR APPLICABILITY; 9
PROVIDING FOR LIMITATIONS ON PUBLIC PARKS AND BEACH
ACCESS PARKING AND IMPLEMENTATION OF THIS ORDINANCE BY
COUNTY RESOLUTION; PROVIDING FOR CONFLICT AND
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF
LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Chapter 125, Florida Statutes, establishes the right and power of counties to
provide for the health, welfare and safety of existing and future residents of the county by enacting
and enforcing regulations concerning the use of property necessary for the protection and benefit
of the public; and
WHEREAS, Collier County currently provides parking lots and garages for public parks
and beach access intended to benefit those members of the public seeking recreation; and
WHEREAS, contrary to the intended public benefit of these public park and beach access
parking facilities, certain public parking garages and lots are being used for commercial overflow
parking and private uses; and
WHEREAS, the Board of County Commissioners desires to adopt regulations relating to
public parks and beach access parking facilities in order to preserve their intended benefit, which is
to provide adequate public park and beach access parking for Collier County citizens and visitors.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: Title.
This Ordinance shall be known and may be cited as the "Collier County Public Parks and
Beach Access Parking Ordinance."

SECTION TWO: Purpose and Intent.
The purpose of this Ordinance is to provide, maintain and ensure the availability of parking
for those members of the public who seek access to Collier County public parks and beaches.
SECTION THREE: Applicability.
This Ordinance shall apply to, and be enforced in, all unincorporated areas of Collier
County, Florida.
SECTION FOUR: Public Parks and Beach Access Parking.
Public Parks and Beach Access Parking is to be utilized solely for the purpose of accessing
public parks and beaches. It shall be a violation of this Ordinance for anyone to park in an area
designated as "Public Park Parking" or "Public Beach Access Parking" who is not utilizing a
public park or beach during the hours from dawn to dusk.
SECTION FIVE: Designation of Public Parks and Beach Access Parking by Resolution.
A. The County Manager, or his designee, shall investigate and make recommendations to the
Board of County Commissioners concerning which areas to designate as Public Park
Parking or Public Beach Access Parking. Recommendations shall be in accordance with
the terms of this Ordinance in an effort to protect the public's ability to access the public
parks and beaches of Collier County as well as to aid in the implementation of the
conditions set forth in this Ordinance.
B. Upon the advice of the County Manager or his designee, the Board of County
Commissioners may, by Resolution, designate certain areas owned or leased by the County
as Public Park Parking or Public Beach Access Parking.
C. Upon the Board of County Commissioners enacting a Resolution designating certain areas
owned or leased by the County as Public Park Parking or Public Beach Access Parking,
such parking facilities, parking lots or portions thereof so designated shall be posted

specifying the restrictions or prohibitions, as enacted by the Board of County
Commissioners.
D. The presence of a beach parking permit upon a vehicle shall not be considered as evidence
of intent to go to the beach.
SECTION SIX: Penalty for Violations.
Pursuant to Section 318.14, Florida Statutes, any person cited for a violation of this
Ordinance shall be deemed to be charged with a noncriminal violation and shall be assessed a civil
penalty of thirty dollars ,($30.00). The distribution of fines and provisions for late payment
penalties shall be in accordance with Section 130 -46, as it may be amended, of the Collier County'
Code of Laws and Ordinances.
SECTION SEVEN: Conflict and Severability.
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any
phrase or portion of this Ordinance invalid or unconstitutional, such portion shall be deemed a
separate, distinct and independent provision and such holding shall not affect the validity of the
remaining portion.
SECTION EIGHT: Inclusion in the Code of Laws and Ordinances.
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-
Iettered to accomplish such, and the word "ordinance" may be changed to "section ", "article ", or
any other appropriate word.
SECTION NINE: Effective Date.
This Ordinance shall become effective upon filing with the Department of State.

WHEREAS, on July 27, 2010, Board of County Commissioners (Board) adopted
Ordinance No. 2010 -29, the "Collier County Public Parks and Beach Access Parking Ordinance
to address the use of certain public garages and lots for commercial overflow parking and
privates uses which is contrary to the intended public benefit of these public park and beach
access facilities; and
WHEREAS, in an effort to protect the public's ability to access the public parks and
beaches of Collier County, the Board considered the recommendations of County staff and
determined that certain County -owned or County - leased lands should be designated as Public
Park Parking or Public Beach Access Parking in accordance with Ordinance No. 2010 -29; and
WHEREAS, the Board wishes to implement the provisions of Ordinance No. 2010 -29
including the prohibition against anyone parking in an area designated as "Public Park Parking"
or "Public Beach Access Parking" who is not utilizing a public park or beach during the hours
from dawn to dusk.
NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the following County -owned or
County -leased lands are hereby designated as "Public Park Parking" or "Public Beach Access
Parking."

BE IT FURTHER RESOLVED that this Resolution shall become effective upon posting
of appropriate signage specifying the restrictions or prohibitions enacted by the Board of County
Commissioners.
THIS RESOLUTION ADOPTED after motion, second, and majority vote favoring same
