EXECUTIVE SUMMARY
Recommendation to approve a Budget Amendment for contracted services with American
Traffic Solutions (ATS) for Traffic Infraction Detector Program (Red Light Running
Camera Enforcement System) support. (Fiscal Impact: $171,000)
OBJECTIVE: To gain Board approval of a Budget Amendment transferring $171,000 from
General Fund (001) Contingency Reserves to the Intersection Safety Cost Center to fund the
remaining FY 2012 monthly reoccurring costs for the operation of the Traffic Infraction Detector
Program (TID Program), also known as the Red Light Running Camera Enforcement System.
CONSIDERATIONS: On February 28, 2012, the Board of County Commissioners approved a
Settlement Agreement between Collier County and American Traffic Solutions (ATS) relative to
the TID Program. Under the terms of this settlement, Collier County paid ATS the sum of
$522,454 for previously provided services that had been unpaid, in exchange for the County
being released from all claims and amounts owed prior to January 1, 2012. Further, the
Settlement and Release Agreement provided that ATS will continue to provide TID Program
operational support at nineteen (19) monitored approaches for a recurring monthly fee of
$28,500 or $256,500 for FY 2012 and an annual amount of $342,000 in subsequent years.
The FY 2012 adopted budget of $680,000 was sized on anticipated fee collections during FY
2012 and is insufficient to cover the cost of settlement ($522,500), monthly contractual services
($256,500) and estimated administration and reimbursements ($72,000). The total budget
appropriation necessary for FY 2012 is anticipated to be $851,000 and will require a budget
amendment in the amount of $171,000. Historical or prior year revenues collected over expenses
for this program are part of the General Fund (001) balance. General Fund (001) reserves are
sufficient to fund the remainder of contractual services for FY 2012.
FISCAL IMPACT: Since FY 2009, revenues over expenses connected with the traffic
infraction detector program totals $1,625,300. This revenue has manifested itself in beginning
fund balance within the General Fund from one fiscal year to the next. Current budgeted
contingency reserves in the General Fund total $6,563,115. A budget amendment in the amount
of $171,000 from General Fund contingency reserves is necessary to establish sufficient budget
after payment of the contractual settlement and continue program operations through year ending
FY 2012.
Recurring costs for traffic infraction detection program beginning in FY 2013 will be covered
fully from traffic fines assessed.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office,
does not present a legal issue and only requires a majority vote for Board approval —SRT.
GROWTH MANAGEMENT IMPACT: This action will result in no growth management
impact.
