EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approves a Resolution declaring a
public purpose for the receipt and acceptance of a $65,000 donation from CDC Land
Investments, Inc. to the Bayshore Beautification Municipal Service Taxing Unit (MSTU) for the
streetscape design and roadway construction costs of Thomasson Drive and Hamilton Avenue
(MSTU Fiscal Impact: None)
OBJECTIVE: To approve a Resolution to accept a $65,000 donation from CDC Land Investments,
Inc. for the streetscape design and roadway construction costs of Thomasson Drive and Hamilton
Avenue.
CONSIDERATIONS: CDC Land Investments, Inc. is the current owner of Sabal Bay Planned Unit
Development (PUD) that borders Thomasson Drive and Hamilton Avenue. On March 13, 2012, the
Board heard and approved a request to amend the Sabal Bay PUD. A portion of the Sabal Bay project
lies within the Bayshore Beautification MSTU boundary, and any houses built in that section will
contribute to the MSTU revenues.
CDC Land Investments, Inc. has voluntarily and unilaterally offered to donate $65,000 to the Bayshore
Beautification MSTU (Exhibit A) for the sole purposes of designing and improving Hamilton Avenue
and Thomasson Drive to assist in the beautification and improvement of these County roads. Graphics
of Sabal Bay PUD and the proposed project area are attached as backup.
CDC agrees to deposit $65,000 with the Bayshore Beautification MSTU within 30 days of the
approval by the Collier County Board of County Commissioners (BCC) of the final design contract for
the streetscape improvements along Hamilton Avenue and Thomasson Drive from Bay Street to
Normandy Drive. If the final design contract is not approved by the BCC by January 1, 2015, this
pledge shall expire.
FISCAL IMPACT: None, other than staff time. A future budget amendment to recognize the
donation will be required when the actual donation is received.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is legally
sufficient, and requires majority vote for approval. -STW
GROWTH MANAGEMENT IMPACT: None.

RESOLUTION NO. 2012-
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY DECLARING A PUBLIC PURPOSE FOR THE
RECEIPT AND ACCEPTANCE OF A $65,000 DONATION TO BE
EXPENDED ONLY FOR THE STREETSCAPE DESIGN AND ROADWAY
CONSTRUCTION COSTS ALONG HAMILTON AVENUE AND
THOMASSON DRIVE FROM BAY STREET TO NORMANDY DRIVE.
WHEREAS, the Board of County Commissioners of Collier County finds there is a
compelling public purpose for the beautification and improvement.of the County's roads along
Hamilton Avenue and Thomasson Drive from Hamilton Avenue to Lombardi Drive;
WHEREAS, CDC Land Investments, Inc. has voluntarily and unilaterally offered to
donate $65,000 to the Bayshore Beautification MSTU for the sole purposes of designing and
improving Hamilton Avenue and Thomasson Drive from Bay Street to Normandy Drive;
WHEREAS, the Board finds that there is a compelling public purpose for the Bayshore
Beautification MSTU to receive and accept a donation to assist in the beautification and
improvement of County Roads in the Bayshore Beautification MSTU;
WHEREAS, the Board authorizes the Bayshore Beautification MSTU to accept the
monetary donation and to spend the donation in a manner consistent with the stated public
purpose; and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board hereby declares that there is a public purpose to accept a $65,000
monetary donation from CDC Land Investments, Inc. to be used for the sole purposes
of streetscape design along Thomasson Drive and Hamilton Avenue from Bay Street
to Normandy Drive.

Re: Streetscape Design Pledge — Sabal Bay PUD
CDC Land Investments Inc. (CDC) has been working; with the Bayshore
Beautification MSTU on the streetscape design along Thomasson Drive and Hamilton
Avenue for several years.
CDC supports this important neighborhood improvement, and agrees to deposit
$65,000 with the Bayshore Beautification MSTU within 30 days of the approval by
the Collier County Board of County Commissioners (BCC) of the final design
contract for the streetscape improvements along Hamilton Avenue and Thomasson
Drive from Bay Street to Normandy Drive. The $65,000 is required to be expended
only for the streetscape design and construction costs and no other purpose.
With the exception of financial obligations which are imposed upon. all property
owners within the MSTU and /or CRA, the $65,000 payment satisfies all other
obligations of CDC in regards to the MSTU and CRA. If the final design contract is
not approved by the BCC by January 1, 2015, this pledge shall expire.

1. Is Thomasson Drive included in the Bayshore CRA/MSTU?
A portion of Sabal Bay is inside the CRA & MSTU boundaries. See maps.
If it isn't, I heard this is being considered. Please confirm or deny if this is the case.
A MSTU Boundary has been 'considered; however no Sabal Bay land is contemplated to
be included, See maps.
2. The Sable Bay developer contribution of $65,000 for road design related to the Thomasson Dr.
improvements without more (such as MSTU assessments, impact fees etc.) - is unacceptable.
This contribution was offered by the developer, not solicited.
t. The donation was to assist the IVISTU in the funding of the "design" of the road
improvements. The portion of Sabal Bay that is within the MSTU will continue to
contribute their appropriate millage (CRA & MSTU).
This amount will increase as the land is developed and taxable structures are built.
3. Please provide a description of all road improvement plans for the Bayshore CRA and MSTU, and
for Thomasson Drive, including anticipated costs.
* Bayshore Drive lighting, sidewalks, landscape and irrigation improvements in 1997 -
1 999.
* Bayshore Drive south of Thomasson Drive pedestrian scale improvements
(sidewalks, lights, landscape and drainage treatments) in 2011 - $943,599.
Bayview Drive and Lunar Street planned for pedestrian scale improvements only
(sidewalks, lights, landscape and drainage treatments) in 2012 & 2014 respectively —
estimated construction costs $417,000 and $449,000 respectively.
Thomasson Drive & Hamilton Avenue roads are in conceptual design phase — cost
will not be determined until design is chosen. See map.
4. Please provide the list of all roads contemplated for inclusion in the Bayshore CRA/MSTU.
* See map.
* MSTU boundary expansion has been discussed in order to capture the portion of
Thomasson Drive between the MSTU boundary and Orchard Lane to allow MSTU
funds to be 'collected and expended' on the improvements.
* Properties captured in the expansion would be those with Idirect' benefit from the
improvements. All land south of the proposed expansion area is government land
(school board or County Parks). with Collier County
IVISTU Boundary expansion would be completed in accordance
ordinances, policies and procedures.
5. Sable Bay, which is part of the Bayshore CRA and MSTU, should be obligated the same way as
all properties in the CRA/MSTU.
