EXECUTIVE SUMMARY
Recommendation to waive the daily charges for the lane rental fee for East Radio Road
MSTU, and direct the County Manager to amend the Lane Rental Fee (per day) Incentive
Program to exempt all future County Projects from such Fee, when the project is a County
sponsored enhancement within or adjacent to the right of way.
OBJECTIVE: To exempt all County Projects from the Lane Rental Fee (per day) Incentive
Program.
CONSIDERATIONS: Radio Road MSTU has requested the BCC waive the rental /closure fee
in order to finish the beautification project. Taking monies out of one taxpayer's pocket and
placing it in the other does not make sense. The residents along Radio Road between Santa
Barbara and Davis Boulevard have agreed to tax themselves to beautify the County. The County
should have asked the contractor what was the required time frame for lane closure and charge
accordingly or do not charge a fee on the County's projects. County staff agrees that it makes
little sense for the County to charge itself for this or any other County project when the project is
a County sponsored enhancement within or adjacent to the right of way.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is
legally sufficient, and requires majority vote for approval. -JAK
RECOMMENDATION: Specifically, to waive the daily charges for the lane rental fee for East
Radio Road MSTU, and generally, to direct the County Manager to amend the Lane Rental Fee
(per day) Incentive Program to exempt all future County Projects from such Fee, when the
project is a County sponsored enhancement within or adjacent to the right of way.

Subject: Request for exemption — ROW Lane Rental Fees
Dear Commissioners:
On January 31, 2012, . 73% of the voters approved a ballot question for a loan to advance the construction of the
beautification project on Radio Road East of Santa Barbara Boulevard to Davis Boulevard. As a result of this
overwhelming support, the Radio Road East MSTU Advisory Board is now taking the necessary steps to
complete the project as quickly as possible.
At their February 1, 2012 the Advisory Board, staff, and District 3 Commissioner Tom Henning reviewed the
project plans and discussed ways to lower the cost of the project to the taxpayers. During the review, it was
noted that standard ROW Permit Fees will be assessed as a "per day" charge for lane rental/closure on Radio
Road and could potentially result in significantly higher project cost to the residents. The lane rental /closure
fees vary in cost from $300 to $1,000 per day depending on time of year that the permit is issued (see attached
Exhibit A) and when the traffic lane is closed. The fees are higher during the tourist season and at peak traffic
hours to discourage requests for lane closures.
In order to minimize project costs, the Advisory Board request that the lane closure permit fees for the Radio
Road .East of Santa Barbara Blvd. beautification project be exempted or reduced to cover only the cost for the
ROW Section personnel to process the permit and complete any required inspections. The MSTU Advisory
Board strongly objects to its residents, who have chosen to assess themselves at a higher millage to pay for the
project, paying penalty fees when they overwhelmingly support the expeditious completion of the project.
Please accept this letter as the Radio Road East of Santa Barbara Boulevard MSTU Advisory _Board's request
for the exemption from any lane closure fees associated with the upcoming beautification project.
