COUNTY, a political subdivision of the State of Florida ("Purchaser"), and to AMERICAN GOVERNMENT SERVICES
CORPORATION ("title agent") and COMMONWEALTH LAND TITLE INSURANCE ("title insurer"), to induce Purchaser to
purchase and title insurer to insure the fee simple title to that certain real property described below,and Seller further states:
1. Affiant is the Vice President of CG II, LLC, a Florida limited liability company ("Seller") and as such, has knowledge
regarding the subject property.
2. Seller is the sole owner in fee simple and now in possession of the real property together with the improvements located
thereon described as follows:

3. Affiant hereby affirms and attests that,to the best of their knowledge,the Oil,Gas and Sulphur Lease between and among Lee
County Land Company, et al. dated December 3, 1940 and recorded December 28, 1940 in Deed Book 9, Page 560 of the
Public Records of Collier County, Florida; and the Oil, Gas and Mineral Lease by and between J.E. Price, Sr. and Aliese
Potter Price,husband and wife and J.W. Rettig,Jr. and Jo Kubena,husband and wife, dated May 17, 1975 and recorded June
9, 1975 in Official Records Book 624, Page 333, of the Public Records of Collier County, Florida; have expired under the
terms therein.
4. That, to the best of their knowledge, no mining, drilling or other work has taken place on the captioned property or on any
property abutting, adjoining or contiguous thereto, pursuant to the above described lease, during the period of Seller's
ownership
5. Affiant understands that making a false statement under oath,knowing it to be false, is a misdemeanor of the first degree and
is punishable by a definite term of imprisonment not exceeding one year as provided in Chapter 775 of the Florida Statutes.
