EXECUTIVE SUMMARY
Recommendation to approve Petition VAC- PL20120000308, to disclaim, renounce and vacate the
County and the Public interest in part of the 30 -foot wide Public Road right -of -way Easement as
originally recorded in the Public Records of Collier County, Florida, located in Section 26,
Township 48 South, Range 26 East, Collier County Florida being more specifically shown in
Exhibit "A ".
OBJECTIVE:
To adopt a Resolution to vacate the County and the Public interest in part of the 30 -foot wide Public Road
right -of -way Easement as originally recorded in Official Record Book 182, page 230, Official Record
Book 182, page 232, Official Record Book 1012, page 1178, Official Record Book 1431, page 535, of the
Public Records of Collier County, Florida, located in Section 26, Township 48 South, Range 26 East,
Collier County Florida being more specifically shown in Exhibit "A ".
CONSIDERATIONS:
Petition VAC- PL20120000308 has been received by the Engineering Services, Growth Management
Division, Planning and Regulation from Robert Stiegele, as owner /petitioner of Centerline Homes
Enterprises Three, LLC. This vacation request is intended to vacate a part of the 30 -foot wide Public Road
right -of -way Easement not being used at this time and not intended to be used in the future. Letters of no
objection from abutting property owners have been received from all who responded. Certified mail
receipts exist for those who elected not to respond.
FISCAL IMPACT:
Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to Vacate"
fee from the petitioner which covers the County's cost of recording and processing the Petition.
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this vacation.
ENVIRONMENTAL ISSUES:
There are no outstanding environmental issues.
HISTORICAL /ARCHAEOLOGICAL IMPACT:
There are no historical or archaeological impacts.

The County Attorney's Office has reviewed and approved this item for legal sufficiency. This item is

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
RELATING TO PETITION VAC- PL20120000308, TO
DISCLAIM, RENOUNCE AND VACATE THE COUNTY AND
THE PUBLIC INTEREST IN PART OF THE 30 -FOOT WIDE
PUBLIC ROAD RIGHT -OF -WAY EASEMENT AS
ORIGINALLY RECORDED IN THE PUBLIC RECORDS OF
COLLIER COUNTY, FLORIDA, LOCATED IN SECTION 26,
TOWNSHIP 48 SOUTH, RANGE 26 EAST, COLLIER
COUNTY FLORIDA BEING MORE SPECIFICALLY SHOWN
IN EXHIBIT "A ".
WHEREAS, pursuant to Sections 336.09 and 336.10, Florida Statutes, Petitioner,
Robert Stiegele, as owner /petitioner of Centerline Homes Enterprises Three, LLC., has
requested the vacation of the County and the Public interest in part of the 30 -foot wide
Public Road right -of -way Easement as originally recorded in Official Record Book 182,
page 230, Official Record Book 182, page 232, Official Record Book 1012, page 1178,
Official Record Book 1431, page 535, of the Public Records of Collier County, Florida,
located in Section 26, Township 48 South, Range 26 East, Collier County Florida being
more specifically shown in Exhibit "A ".
WHEREAS, the Board has this day held a public hearing to consider petitioner's
request, and notice of said public hearing was given as required by law; and
WHEREAS, the granting of the Petitioner's request will not adversely affect the
ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County interest in part
of the 30 -foot wide Public Road right -of -way Easement as specifically depicted in Exhibit
`A' is hereby vacated, extinguished, renounced and disclaimed, and this action is declared
to be in the Public interest and for the Public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby
directed to record a certified copy of the Resolution in the Public Records.
